It is not the fault of anybody, for instance, that the LP was not able to give a counter figure of the election results because it had no Party Agents in majority of the polling units across the Federation, as they had no Form EC 8a to use in tallying the results. This was very crucial to the case and LP and their lawyers could not provide that.

I have always listened to Dele Farotimi and I must say that I have usually been on the same page with him on some of his postulations on the state of affairs of the country. On this interview he granted here, however, I would like to say that I disagree with him on many of the the things he said here, and I will point them out below. In the first place, he disagreed with Pa Clarke's submission that the PDP and LP Lawyers did not do their home work well. Even the Justices at both the PEPC and the Supreme Court made the same point to the Lawyers of the PDP and LP. For instance, both PDP and LP claimed they won the election and one of the burden of proof on them is to cone to the PEPC with a tally of the Form EC 8a, which their Party Agents signed at the collation centres across the Federation, to compare with INEC's figures to ascertain whether they won or not. This was not done by the Lawyers, so, what do people want the Justices to compare with, to enable them overturn the election result? LP brought For EC 8a from only 6 States and these tallied with INEC figures!!! I think the Lawyers of LP and PDP should take the advice of those telling them that they did not prepare well very seriously and plan on plugging all holes to make their cases water tight next time. On the argument by LP Lawyers that a Presidential Candidate MUST score 25% in the FCT to be declared winner, both the PEPC and Supreme Court Justices, in my opinion, have properly interpreted the law by stating that the FCT has no special status and should just be added to the 36 States before you find two-thirds, which a candidate to be declared as winner of the Presidential election must attain. My reason is simple. This same provision was in the 1979 Constitution, without the FCT, because it was not yet created. By the time those who drafted the 1999 Constitution drafted it, the FCT had now been in existence. In order not to disenfranchise the residents of the FCT, the drafters of the 1999 Constitution now added it to the 36 States, to make 37 entities, two-thirds of which the winner must score 25% in, to be declared winner. How the PDP and LP Lawyers now think that an entity that was brought into reckoning, so as not to be disenfranchised, should now have superior status over the 36 States, beats my imagination!!! What the Justices in both the PEPC and the Supreme Court ruled on that is, therefore logical. Now, Dele Farotimi also goes on to state that the Supreme Court Justices are delivering conflicting Judgements. Well, I do not see any conflicting Judgement or pronouncements by the Justices of the Supreme Court. Maybe Dele Farotimi can give examples, so we can be convinced after checking them out. On the uploading of results to iRev, again, Dele Farotimi should check the Electoral Law again, to see that how the result is transmitted is rested at the discretion of the INEC leadership. INEC stated that they would upload the results to the iRev, but they stated that there was a glitch. The glitch does not, however, invalidate the results, which all Party Agents in all the polling units have, anyway, which they can collate and use in proving their case if INEC declared a wrong result. What I think Dele Farotimi should be pushing for, is for the amendment of our electoral laws to insist on uploading the results online, no matter what, so elections can be cleaner in future. On the issue of forgery of certificate, in spite of the fact that PDP brought new evidence to the Supreme Court, which is rarely accepted, the Supreme Court Justices still went ahead to admit the evidence. The Supreme Court Justices stated that they are in possession of two letters from CSU, one authenticating the Certificate and another discrediting it, with Justice Okoro asking the PDP Lawyer, which one they should rely on!!! My position on this is that the Supreme Court is not a Court of entertaining such matters, until it receives an appeal from a lower Court. What the PDP Lawyers should be doing now, is to file a suit on the resolution of the authenticity of the certificate, before another round of election in 2027. Why should CSU send two conflicting letters on the certificate? Since the PDP and LP always think they have always prepared their cases well, they may not take to this advice now and then, bungle the chances of letting us all get to the bottom of this certificate issue. My brother, Dele Farotimi should know, as a Lawyer, that sentiments and emotions don't win cases in Courts, but the presentation of facts, figures and other relevant evidence that will be very difficult to be sidetracked with technicalities. He should stop playing to the gallery, by saying things he thinks his audience want to hear, so that they can continue to praise him. He should always give useful advice that could help the course, such as admitting that the Lawyers were not thorough and give useful advice on how we can achieve the right path for the country. We all want a better Nigeria, but we must not relent. We must always continue to look for legal means of outwitting the status quo. The PDP and LP Lawyers should swallow their pride, admit their sloppiness in handling their clients cases, pursue other options that can prevent undesirable leadership still making it to governance, going forward from 2027.

It is not a matter of supporting or not supporting, judgements will always be handed, based on law. Let me give you an example. The same ruling that the Supreme Court gave on the uploading of the results to the iRev in this Presidential appeal case, which now favours President Tinubu and APC, is the same judgement that they handed down in the Osun State Governorship appeal that kept Governor Adeleke of PDP as Governor of Osun State today. Are you now saying that it is okay when they earlier gave the same ruling in the Osun State case in favour of PDP, but not right for them to give the same ruling for the APC case? What I am saying, in essence, is that it doesn't really matter who is involved or which political party is involved, the Courts will still rule according to what the law says and unless the law is changed, things will continue to happen this way that we all do not want. Coming on social media and abusing or swearing for people for the views they have on issues will not change anything. Only proactive call for the amendment of the various sections of the law, that make all these manipulations possible is the only way to change things for the better and not whining or drowning in sentiments and emotions. I rest my case.

Because he knows that LP does not have a strong enough case to upturn the election results. He knows. He's just playing to the gallery by always saying what the LP members like to hear, so they will be praising him like they are doing in the comment section here. He could have helped the LP Lawyers assemble a strong case, if they had one, but he couldn't, since they did not, and he knows.
It is not the fault of anybody, for instance, that the LP was not able to give a counter figure of the election results because it had no Party Agents in majority of the polling units across the Federation, as they had no Form EC 8a to use in tallying the results. This was very crucial to the case and LP and their lawyers could not provide that.
Hopeless is an understatement ,Nigerian judiciary completely doesn't exist.

I have always listened to Dele Farotimi and I must say that I have usually been on the same page with him on some of his postulations on the state of affairs of the country.
On this interview he granted here, however, I would like to say that I disagree with him on many of the the things he said here, and I will point them out below.
In the first place, he disagreed with Pa Clarke's submission that the PDP and LP Lawyers did not do their home work well.
Even the Justices at both the PEPC and the Supreme Court made the same point to the Lawyers of the PDP and LP.
For instance, both PDP and LP claimed they won the election and one of the burden of proof on them is to cone to the PEPC with a tally of the Form EC 8a, which their Party Agents signed at the collation centres across the Federation, to compare with INEC's figures to ascertain whether they won or not. This was not done by the Lawyers, so, what do people want the Justices to compare with, to enable them overturn the election result? LP brought For EC 8a from only 6 States and these tallied with INEC figures!!!
I think the Lawyers of LP and PDP should take the advice of those telling them that they did not prepare well very seriously and plan on plugging all holes to make their cases water tight next time.
On the argument by LP Lawyers that a Presidential Candidate MUST score 25% in the FCT to be declared winner, both the PEPC and Supreme Court Justices, in my opinion, have properly interpreted the law by stating that the FCT has no special status and should just be added to the 36 States before you find two-thirds, which a candidate to be declared as winner of the Presidential election must attain.
My reason is simple. This same provision was in the 1979 Constitution, without the FCT, because it was not yet created. By the time those who drafted the 1999 Constitution drafted it, the FCT had now been in existence. In order not to disenfranchise the residents of the FCT, the drafters of the 1999 Constitution now added it to the 36 States, to make 37 entities, two-thirds of which the winner must score 25% in, to be declared winner. How the PDP and LP Lawyers now think that an entity that was brought into reckoning, so as not to be disenfranchised, should now have superior status over the 36 States, beats my imagination!!! What the Justices in both the PEPC and the Supreme Court ruled on that is, therefore logical.
Now, Dele Farotimi also goes on to state that the Supreme Court Justices are delivering conflicting Judgements. Well, I do not see any conflicting Judgement or pronouncements by the Justices of the Supreme Court. Maybe Dele Farotimi can give examples, so we can be convinced after checking them out.
On the uploading of results to iRev, again, Dele Farotimi should check the Electoral Law again, to see that how the result is transmitted is rested at the discretion of the INEC leadership. INEC stated that they would upload the results to the iRev, but they stated that there was a glitch. The glitch does not, however, invalidate the results, which all Party Agents in all the polling units have, anyway, which they can collate and use in proving their case if INEC declared a wrong result.
What I think Dele Farotimi should be pushing for, is for the amendment of our electoral laws to insist on uploading the results online, no matter what, so elections can be cleaner in future.
On the issue of forgery of certificate, in spite of the fact that PDP brought new evidence to the Supreme Court, which is rarely accepted, the Supreme Court Justices still went ahead to admit the evidence. The Supreme Court Justices stated that they are in possession of two letters from CSU, one authenticating the Certificate and another discrediting it, with Justice Okoro asking the PDP Lawyer, which one they should rely on!!!
My position on this is that the Supreme Court is not a Court of entertaining such matters, until it receives an appeal from a lower Court. What the PDP Lawyers should be doing now, is to file a suit on the resolution of the authenticity of the certificate, before another round of election in 2027.
Why should CSU send two conflicting letters on the certificate?
Since the PDP and LP always think they have always prepared their cases well, they may not take to this advice now and then, bungle the chances of letting us all get to the bottom of this certificate issue.
My brother, Dele Farotimi should know, as a Lawyer, that sentiments and emotions don't win cases in Courts, but the presentation of facts, figures and other relevant evidence that will be very difficult to be sidetracked with technicalities. He should stop playing to the gallery, by saying things he thinks his audience want to hear, so that they can continue to praise him. He should always give useful advice that could help the course, such as admitting that the Lawyers were not thorough and give useful advice on how we can achieve the right path for the country.
We all want a better Nigeria, but we must not relent. We must always continue to look for legal means of outwitting the status quo.
The PDP and LP Lawyers should swallow their pride, admit their sloppiness in handling their clients cases, pursue other options that can prevent undesirable leadership still making it to governance, going forward from 2027.

It is not a matter of supporting or not supporting, judgements will always be handed, based on law.
Let me give you an example. The same ruling that the Supreme Court gave on the uploading of the results to the iRev in this Presidential appeal case, which now favours President Tinubu and APC, is the same judgement that they handed down in the Osun State Governorship appeal that kept Governor Adeleke of PDP as Governor of Osun State today. Are you now saying that it is okay when they earlier gave the same ruling in the Osun State case in favour of PDP, but not right for them to give the same ruling for the APC case?
What I am saying, in essence, is that it doesn't really matter who is involved or which political party is involved, the Courts will still rule according to what the law says and unless the law is changed, things will continue to happen this way that we all do not want.
Coming on social media and abusing or swearing for people for the views they have on issues will not change anything.
Only proactive call for the amendment of the various sections of the law, that make all these manipulations possible is the only way to change things for the better and not whining or drowning in sentiments and emotions.
