Government should own some responsibility when they are charging Fee's. Government office's don't have records in place but expect society to provide all documents. The basic criteria to form a society is 5 members. Once society is formed it should be automatically conveyed to the society/convenience. ALSO LAWYER'S LICENSES SHOULD BE CANCELED WHO INCORPORATE CLAUSES FOR FUTURE DISPUTE ON BEHIND OF CLIENTS PURPOSELY.
Can registered Hsg Society go for redevelopment in absence of Conveyance or Deemed conveyance? Hsg Society is registered in 2003.Area comes under R central ward of Mumbai municipality. One member out of 83 members is maint payment defaulter for 15 years. Property tax payment is upto date as on 31 Dec 2024.
Unless and Until Property Taxes and Stamp Duty are Individual Liability, Society's Redevelopment and Rebuilding is not possible. Once Agreement for Sale is executed its Deemed to be conveyed then it's automatically deemed conveyed especially for CONDOMINIUMS. Registrars should have the right to convey within 30 days. For Redevelopment the default persons should be handed over the final possession through the Registrar after proofs of Stamp Duty paid, the way probate is obtained. Why should Society give any undertaking because it's the government department's responsibility to see that all documents are in order. Government charges Fee's and puts society to work on their behalf.
