Please tell me you were not driving a CMV without a dashcam... it would make great evidence to help you beat that BS. I guess we just have to stop in the middle of the highway and not miss the scales...
I sometimes think some of these DOT or police have had a traumatic thing happen to them that revolved around a truck driver and just want revenge. Maybe their mother cheated on their father with a truck driver, and they take it out on every trucker! Actually, i think they become jaded by hearing so many stories from truck drivers who dont try to do it right, so when one like yourself who does thing in the up and up gets stopped they dont believe you.
Yep that's how it works. It's sucks but that's the way it is. Look out for yourself first. The law states to move over or slow down. You should have just slowed down as long as you're under the speed limit you're good.
Maybe because I question everything and have general suspicion, but early morning heavy traffic you got someone pulled over I’m assuming several hundred yards from the scale house entrance….and just so happens there’s another patrolman sitting before the entrance, positioned to be able to give chase shout he need to…..come on.
Where does DOT get the power to punitively take you out of service? Can they elect to take you out of service for a few years? This makes them judge, jury, prosecutor, and jailer. What happened to due process? I understand being taken out of service for situations requiring correction until correction is made.
The rule of thumb is to reduce your speed 20 mph beneath the speed if you cannot get over safely. Would have been best to just slow it down and stay in that right lane given the open scale. You are right, I am noticing an uptick in enforcement actions out here, and it seems to typically be geared toward straight trucks or hotshot trucks. Human nature is lazy by default, they will pick the easy low-hanging fruit every time if given the choice. Hopefully you can get out of that violation.
Sounds like you were in the NY/CT area where they had 9 cops chasers just pulling everyone over that day IN THE RAIN!!! was nuts, all day pulling people over. If you were forced to miss the weigh station try to pull over into the station exit road.Park and walk back to the station and tell the weigh master what happened.I have heard this may work to avoid a ticket.

Well, if the officer does not show up the judge will throw it out. If he does show up, there is a good chance it still get's thrown out. In the future I would just slow down and not move over, I always try to whether I'm hauling something or in my car but sometimes you can't. DOT officers not being human and understanding this situation is just stupid, but look who is currently their top boss....

Take a map and show where the traffic stop was, show where weigh station is, show the reduced speed, and if you have dash cam footage show that as well. As you are just beginning to see, justice is a game so come ready to play the game and win. People are just waking up to the fact that police are not about public safety, even tho they sometimes do protect the public. Policing is enforcement of laws, and the laws are established to protect the wealthy and to generate income for the state. That was their mandate then as it is now. It keeps people in their respective clsds, and you guessed it, each class you go down the more the police are present. Thats why you dont see seat belt stops in wealthy neighborhoods. Obviously i could write a ton more, but this is your introduction and i sincerely hope you look into it. The cop was operating in his allowed capacity- he could have let you off but he didnt. It isnt his fault, he is given that discretion. It is the politicians from the local and state level that set the laws that the cops enforce, so aside from fighting the ticket in court, it would be real action and using your freedom to write your representatives and the representatives of the district the event happened in. Heck, get signatures that would force fmcsa to edit the code. It is possible, unless you decide to do nothing as most might. May want to try to do a public records request on the traffic stop you moved over for. Might help bolster your case.
