Backstory: This lady, Stetler, RV Sales of Broward, is mad at Marcus because Camping World and Mark Bellissimo (Equestrian Show Holdings LLC) after they CW sponsored this event and as a result her business lost its sponsorship spot and also Mark, ESH, served her no trespassing warning letters to stay off all of their property which keeps her from being able to compete or participate in future events at the property. Which she claims was given without any substantiated reason and wasn't given a chance to defend herself. She's arguing for damages because she claims it was done with malicious intent by both parties to negatively affect her company and reputation. Backstory for the Backstory: She claims Marcus and Camping World knew about her company's hardships because recently they bought several RVs at auction that were repossessed from her company for nonpayment and then afterwards took her sponsorship spot at the show. She called and reported to the police and festival runners accusing CW of "stealing her inventory." As a result of her phone calls to the Fl Dept of Highway Safety and Motor Vehicles concerning these particular RV permits officers were at the show investigating the permit numbers on the CW RVs that were parked at the show. Also this is what led to Mark Bellissimo banning her from being a sponsor, because she was interfering and trying to stir up problems with one of their sponsors (CW). It is so sad and so hard for me to see company’s starting to go under and the good people that work their rear ends off to do everything they can to keep their jobs and keep the business afloat. This all just seems to me like a lady that some were along the line messed up with her finance company. Like things got financially tight and instead of paying for units when they are sold/funded and keep the funds to try and fix/help the company or for something in her personal and got flipped head over heals. Just like if some one has. Car payment and you miss that one month and next thing you know it’s out of control and you can’t catch up and you lose your vehicle. Well unlike a normal person with an auto Loan, unless your good with your bank/finance company, it’s hard to work with them to get back on the right track. Well that can be for a loan(on avg) in the amounts of $60-$20k. That’s really just bluntly put chump change for big banks. Well if your a business owner with big banks. These big banks have anywhere from $200k to $1.5million. And that can be ok the lower end. Well with that big of a line of credit and I have seen company’s with as much as a 9% apr. well these big banks will work with the businesses a lot longer, and a lot more, and a lot harder then a normal person, with an auto loan or some other type of loan. Marcus' coffee cup seems to have an unlimited amount of fluid despite being empty for many of the glups....and he seems to have problems with his long term memory....
I sense this comment is sarcasm intended to be funny but for the people that may have misunderstood: Some people sip tea rather than gulp and they took breaks where he likely refilled. As for the memory, he's brilliantly deciding when to say "I don't recall" because recalling would likely cause him trouble in the case.
One thing that is unmistakable in this video: Marcus is 100% in charge of himself and of this deposition at all times in this interview. He knows exactly how much to say and how to say it. He's not being evasive, he's being direct, but he's only answering the minimum truth instead of speculating what he might have been doing or thinking... and that's exactly what he should be doing. He's not there to help this lawyer, he's there to best represent the interests of his company and himself.
Great video. As we all grow as businessmen or businesswomen it is very important to learn how to protect our properties, our business and our persona from predators or people who wants to make money out of our success. Keeping Self control when answering questions that can get you in trouble in the future it is very important so it 's having a good lawyer on our side even if we think we will not need a lawyer, situations like this can happen any time and any body. Even bringing a beverage and some candies is smart in order to control the anxiety caused for the stress of having such a long, tedious interrogation. Marcus Lemonis is teaching us all a lot through this recording. If we want to be serious in business better be prepared for the unexpected. This is Real Life happening. Thank you Katherine for sharing this amazing experience. MUJER-DE-EXITO!
If I were in that room and witnessed this deposition I would have retrieved that cup out of the trash, reversed engineered it, patented it and become a multi-millionaire.
After doing some reading, I think GiGi’s fundamental issue with Mark Bellissimo, owner of the Winter Equestrian Festival, is that MB, asked for detailed financial documents for her company under the guise of re-negotiating their business deal. Subsequently, he cut ties with her, and banned her. She lost access to place and rent her RVs to festival attendees. MB also brought in ML/CW as the new festival sponsor. Gigi thinks it was all a ruse to get inside information on her business and leverage it to put her out, also cutting off this revenue to her RV company, which created financial harm to that business, making it ripe for acquisition by a bigger company like ML’s CW. Whew! If true, sleezy, but without a document trail between MB and ML showing they conspired in this way, could be hard to prove. Not that GiGi isn’t correct, just hard to prove.
Plaintiff's lawyer: We established that people at the campground would be potential customers. Lemonis: I didn't establish that. You did. Plaintiff's lawyer: Yes I did. HAHAHAHA! Wow. This one line sabotaged the entire deposition.
1:32:00 This guy is making this lawyer work his ass off for an answer to one question and the lawyer finally gives up asking! Mr Lemonis had really good coaching. Awesome
@@SuperMarioFan72 as someone who works in a court reporting firm, I promise that's incorrect. However, PARTLY true -- most insignificant depositions aren't videotaped.
I am taking notes for the next time my girlfriend accuses me of going to a strip club. #1- "I don't know", #2- "I don't recall", #3- "Do you know where my coffee cup is?"
I thoroughly enjoyed seeing Marcus satisfy and cooperate with the deposition, while not exposing himself. This is the legal circus of today's world, make no mistake Marcus is a genius.
Marcus is smug and evasive. He comes across as a person with something to hide. Although I am not familiar enough with this case to for man opinion......yet. But my gut is telling me Marcus is guilty of something. lol.
He is not lying. Camping World is a public company and this is not a trial. He have to defend the investors and the company at this stage. Many of those questions, with a wrong answer, they could bring a serious damage to the company. So he is forced to don't disclosure information. He is actually acting as a perfect CEO. About the accusation. We don't know anything about it, and we can not judge. But thank you Katherine for this video because once again Marcus is teaching us something important. About the case, I hope justice will be done.
"I don't recall" isn't the same as pleading the fifth or refusing to answer a question, but it is a technical way to get around perjury. If he says "yes" or "no" and it later comes out that he lied, he could get in trouble, but it's pretty much impossible to prove someone lied about not recalling. Though, often, if you're not 100% certain on the specifics/details, it can be better to say you don't recall than to say something that later comes out to be untrue, even if you misremembered slightly. It's also important to remember this is just a disposition and not an actual trial, as well. A big part of this is that you don't bring your own notes/paperwork to a deposition. You only refer to any paperwork the person asking the questions might have. If you don't know the answer without paperwork of your own, you're just supposed to say you don't recall, you're not supposed to volunteer any information, including that there's other paperwork, just answer the question asked to the best of your ability.
Here's a good example of how an attorney advises clients on answering depositions: www.stark-stark.com/family/resources/your-deposition/ Legalities have made a lot of legal processes weird and not as straight-forward as one would think.
Don’t let the “I don’t recall” fool you, Marcus is sharp as a tack and a very good person! I love how he gives back to small struggling businesses. A lot of times he pours money into a struggling business just to save the family running it or the employees of that business. Even knowing he probably won’t see any return on his investment. I wish more CEO’s were like him.
no, he pours the money into them to bury them and debt and finish them out so they can be taken over entirely. 50 businesses now suing him for this tactic. Similar to what the mob used to do.
Your comment makes no sense. If he says "I don't recall" when he really does recall because he's "sharp as a tack" then that disqualifies him from being a "very good person". It makes him a liar in the eyes of the Court, and the UA-cam audience. Marcus's fanbase is strong in these comments, but look at him squirm identifying as an RV dealer! LOL!
People that are critical of Lemonis due to the frequency of the "I don't remember" response to the questions posed in the deposition need to remember that depositions are taken under oath and on penalty of perjury. If your recollection is not clear, then "I don't remember" is preferable to guessing based on a partial or confused memory.
He conveniently doesn’t recall anything much - which, with his smart azz attitude, rude ice chewing and attitude make him an unbelievable witness. A jury should never believe a word he says.
@jamesgabaldon1239 he's the ceo of a company, a huge company, the amount of things he experiences and interactions he has in a day are what you have in a month lol
This is freakin hilarious. This guy knows the flavors of cookies he's eaten four seasons ago...but get him in front of a lawyer and he can't tell you what he ate for breakfast. #genius.
Pete's Space true dude does not let the smallest detail slip his attention like the Clinton's smartest person in the room til under oath then he get fuzzy
I love those depostition!!! The answers are alway "I don't remember" and "I am not sure". I just imagine how the lawyers adivise them. :) Always eating, drinking, chewing guns, for making this "I don;t care" vibe! :)
A question to any of you lawyers reading these comments. What is to stop Marcus (or anyone giving a deposition) from saying "I don't know" or "I don't recall" to every question that he's asked by the opposing lawyer? Wouldn't this just be easier? Are there any drawbacks or consequences?
If you say "I don't recall" to something you may later rely on in court, that could present some issues. Remember, not all of these questions are admissions of any sort of guilt and some may benifit your side of things. The idea is to get all of this over with as quickly as possible while avoiding fines and staying out of jail.
At 32:50 Marcus actually said more than what was asked... “There’s a lot of them...” Looks like Marcus handles depositions better than anybody I have ever seen. Make the attorney work to get what they want... never add anything more than the bare minimum that is necessary to answer the question
At 41:30: Attorney: "Do you do due diligence on any deals you make?" Me: "Dude, Marcus does everything on a handshake only. Don't you watch his show?" Marcus: "No". (!)
Actually he's trying to pitch try to throw him off and trying to pigeonhole him into answering certain ways he's dancing around the central subject so that when he gets to the central subject he's hoping he has a discrepancy which throws out everything he said and sort of makes him guilty it's a strategy and it's not working
Its to create a base line like lie detector tests. See how he reacts to questions you know the answers to already. So if he acts different to 1 question then you suspect that answer is a lie.
This is a great study in how to handle a deposition. Maintain your composure, give short concise answers and only direct answers to the question asked, nothing more.....then stop talking. Be vague and evasive and definitive about nothing unless it's obvious or already on record. Lemonis says 'I don't recall' in a variety of creative ways. I'm not at all suggesting that Lemonis isn't being truthful, my point is that you want to make the other side work to make their own arguments, not hand them anything, and not make their goal to screw you any easier.
I think the interviewer missed an opportunity when Marcus said: "They're all different." How are they different? What can happen? Did something happen in this case? Oh, well.

Some people sip tea rather than gulp and they took breaks where he likely refilled.
As for the memory, he's brilliantly deciding when to say "I don't recall" because recalling would likely cause him trouble in the case.
It’s weird if he’s drinking out of a cup w nothing in it.
monco123 dementia and CEO not a good match.

Josh Conn agree. I've seen hundreds of depos, he's doing a killer job.
very true
More reasons to love Marcus!
The only thing he stumbled on was the length of his marriage 😂👍🏻
He’s shit scared.

This attorney asking the questions had no plan going into this. I'd be pissed if I hired him.
He did have a plan. I will ask a question and he will volunteer as much as he can. But his plan did not work.
Legend has it, Mr. Lemonis is still off nursing the same cup of 2 year old tea...

NUTING!, I KNOW NUTIIING!
Marcus Lemonis just gave a Harvard Law graduate class level lesson on “Being Deposed”. Genius
Anyone know the outcome of this case?
The background looks like if he's already in heaven!!!
No. It looks like 1992 high school picture day.
He bought heaven and saved it before it went out of business.
Plaintiff's lawyer: We established that people at the campground would be potential customers.
Lemonis: I didn't establish that. You did.
Plaintiff's lawyer: Yes I did.
HAHAHAHA! Wow. This one line sabotaged the entire deposition.

About the case, I hope justice will be done.
wait, does he actually know some of the answers, but says "I don't recall"? I'm not sure how this part of a case works and if that's allowed.
Here's a good example of how an attorney advises clients on answering depositions: www.stark-stark.com/family/resources/your-deposition/ Legalities have made a lot of legal processes weird and not as straight-forward as one would think.
for a genius and CEO type he sure has a terrible long term memory. I mean, really, really, really bad.
He went to my son’s high school and is an incredibly generous alumnus!
no, he pours the money into them to bury them and debt and finish them out so they can be taken over entirely. 50 businesses now suing him for this tactic. Similar to what the mob used to do.
I highly doubt that’s true
Marcus said thank you and your check is in the mail.
🎯🎯🎯
His recollection is very clear. He doesn't want to answer. That's all.
He conveniently doesn’t recall anything much - which, with his smart azz attitude, rude ice chewing and attitude make him an unbelievable witness. A jury should never believe a word he says.

“There’s a lot of them...”

@@pizzamasterf5 Lol yeah I'm so fucking sure that how long he's been married to his wife is a pertinent fact to the case

Oh, well.
