I am an attorney admitted to practice twenty years ago. Racially restrictive covenants were found to be unConstitutional and therefore unenforceable six decades ago, regardless of the state. Listen closely enough to this story and it’s clear the covenant can’t be enforced but this segment is edited and broadcast as though the covenant still keeps black people from acquiring housing in the area. Very inaccurate description of the realities here and arguably nothing more than propaganda. And that is coming from a black attorney.
Project 2025 that has been proposed for the Republican plan can change that. States that are conservative would be able to keep those laws in effect since many courts that are conservative. Want to keep the power to the states. Even the Supreme Court, which is majority conservative, many rulings have given. to transfer power back to the states, which is happened with redistricting and voting rights. This is to keep us aware.

If racial discrimination for housing is illegal by federal law, how can those covenants still be adhered to? It seems like the federal law would automatically void those covenants!

If you ever wonder why there are concentrated areas where Black people live in Minneapolis, it’s because those areas are non-covenant areas. It is, which is why those parts of the deeds weren’t and haven’t been enforceable anyways. There are tens of thousands of these forgotten laws and regulations everywhere in the world, but no one worries about them because they have no teeth and are de facto non-existent. For some reason, this story decided to completely ignore that fact and portray it like they are still being enforced when it’s obvious to anyone with half a brain that they aren’t. It’s incredibly performative to pretend they were and for the government to act the same as well-they’d rather do a ceremonial cleansing than actually do anything that is actually worthwhile.

After my previous comment I read through the comments and watched the video again. A lot of people in the comments seem to have shared in my confusion and took a misleading message from the story. NBC either did a bad job making the details clear or intentionally made it biased to lead people into an exaggerated impression. Its kind of disheartening that a reputable new organization can create a news story that so many people are able to misinterpret so badly.

If racial discrimination for housing is illegal by federal law, how can those covenants still be adhered to? It seems like the federal law would automatically void those covenants!
they still exist because of how subtle the words are written. People wonder why Black people live in certain areas, it’s strictly because of these covenants. If you ever wonder why there are concentrated areas where Black people live in Minneapolis, it’s because those areas are non-covenant areas. What’s really frustrating is, due to gentrification, it’s challenging to buy homes in your own “assigned” area.

TF?! I thought this was ILLEGAL a long time ago under redlining laws.
It is, which is why those parts of the deeds weren’t and haven’t been enforceable anyways. There are tens of thousands of these forgotten laws and regulations everywhere in the world, but no one worries about them because they have no teeth and are de facto non-existent. For some reason, this story decided to completely ignore that fact and portray it like they are still being enforced when it’s obvious to anyone with half a brain that they aren’t. It’s incredibly performative to pretend they were and for the government to act the same as well-they’d rather do a ceremonial cleansing than actually do anything that is actually worthwhile.

After my previous comment I read through the comments and watched the video again. A lot of people in the comments seem to have shared in my confusion and took a misleading message from the story. NBC either did a bad job making the details clear or intentionally made it biased to lead people into an exaggerated impression. Its kind of disheartening that a reputable new organization can create a news story that so many people are able to misinterpret so badly.
