The fence is to prevent kids from wandering in to the pool when no one‘s around and drowning.

Thanks . The fence is required . But the latch is set higher than the 54 in requirement.

Most likely there's a rule saying children are not allowed in the pool unattended. If there's an adult in there with them like there should be the higher latch prevents children from leaving when they shouldn't be, the fact that short adults or adults in wheelchairs can't reach them is still a problem yes. The children don't need to reach them.
