North Charleston police officer pulls over cyclist for riding in center of lane

    The evening of Thursday, March 15, 2018, I was commuting home from work, riding my bicycle eastbound on West Montague Ave near Silmar Electronics. I was riding in the right lane. West Montague is a 5-lane road in this area: two travel lanes in each direction, plus a center turn lane/median. It was sunny, and visibility was clear.
    I was riding along the centerline of the right lane in a straight and steady line. My bike had a blinking red LED taillight, rear red reflector, and a bright white LED headlight. I was wearing a high-visibility reflective vest, helmet, and safety glasses, along with a rearview mirror attached to my glasses.
    At ~7:20pm (9:15 in this video), a North Charleston police officer approached from behind in the left lane and spoke over his loudspeaker. I could not make out the first part of what he said, but the second part was "Please move to the right." I watched the police officer continue driving closely behind a minivan in the left lane, and was unsure whether the comment was directed at the minivan or at me (I assumed the minivan). Thus, I continued riding in the center of the lane as before.
    The officer was driving a marked City of North Charleston police car (car number 269) with SC license plate MG52176.
    About a half mile down the road, near the parking lot for 3129 W Montague Ave, the officer stopped his car, walked out into the road, and waved me to the side to talk with me. His last name was O'Connell (presumably Justin O'Connell, per the City's online employee directory **EDIT: John O'Connell**). I complied with the officer's orders and pulled off to the side.
    We had the following conversation (starting at 10:38 in this video)
    -Officer: "Over here please. Thank you. How are you?"
    -Me: "I'm doing well."
    -Officer: "I'm not trying to interrupt your ride. I'm asking you to move to the far right as required by law for a reason, okay. I don't want a car to run you over. That's all. People out here, got the glare in their headlights, got the glare in their windshield, I don't want you to get hit, we got a lot of people that get hit by cars, okay.
    -Me: "Your name is O'Connell?"
    -Officer: "Yes. Okay. Also, the laws apply to you at red lights as well, sir. You know that, right?"
    -Me: "Yes sir, I follow all the laws."
    -Officer: "Okay."
    -Me: "The laws say to stay as far right-"
    -Officer: "Did you just go... yeah, far right, as far right as you can."
    -Me: "-as practicable."
    -Officer: "Yes."
    -Me: "It's not safe to be on the far right because it invites unsafe passing."
    -Officer: "I got you man, I'm just trying to look out for you, okay? I know how people drive around here. I'm not trying to interrupt your bike ride, I'm sorry to stop you. But it also looked like you went through the red light back there. You didn't?"
    -Me: "No I did not, I have it on camera."
    -Officer: "Okay, that's fine - if you didn't, you didn't. I was just saying it looked like it was close. So I just wanted to stop you and ask you again, just to please keep as far right as you can, okay? I'm sure you're not trying to do anything-"
    -Me: "As far right as practicable is the center of the lane, sir."
    -Officer: "I got you, brother. I got you. But you - I don't want you to get hit, okay? That's my big worry. Have a good ride."
    -Me: "Thank you, you too."
    Notes:
    1.) Riding in the center of the lane complies with state law (which says a bicyclist must stay "as far right as practicable," acknowledging that safety concerns make hugging the curb impracticable in some situations), and allows people in other vehicles to see me from a distance and realize they need to change lanes to pass. From bike commuting through this area for five years, I know that the lanes are too narrow for a car to pass a bicycle safely in the same lane.
    2.) It may be difficult to see in the UA-cam video due to UA-cam's postprocessing that reduces video quality, but the red light the officer was referring to didn't change from yellow to red until I had crossed the white stop bar and was legally in the intersection. I did not run the red light, although I can see how it would have looked questionable to him from a distance.
    3.) The video stops at 12:00 because that is when my GoPro automatically ended this segment and started a new video file. The rest of my ride home was uneventful.

    It is a common misconception that it is safer for a cyclist to ride to the right of the lane.
    History has proven that WRONG, cyclists riding to the right more often get wedged out or bumped out of their lane.
    Like ANY vehicle, even SLOW vehicles, taking possession of the lane is safest
    It would be handy for police to learn the LAW and this.
    (I hope that's not overloading the police...)

      Good question. The honest answer is twofold: I wanted to include the entire clip for context (to show that I was generally following all traffic laws), and at the time my GoPro software was not cooperating so I was not able to trim the video before uploading. I tried to mitigate the inconvenience by including timestamps in the description to let folks skip to the interesting parts.
      My primary goal for this channel is documentation, not entertainment.

    It doesn't matter how far right he pulls over, there's is not room for a bike and a car in the same lane. If a car wants to pass a bike, it has to enter a different lane to successfully and safely pass a bike. There was no point is stopping the bike, unless he wants to pull over every motorist on the road and tell them to be careful too.

      Dude the roads in the USA and Canada are wide as fuck, if you can't safely pass a cyclist using your own lane you shouldn't be driving a car. Some roads are not as wide but in general where this guy was riding his bike I could squeeze a fucking transport truck by him. Unfortunately there are too many people like you that can't drive.

      @@miroslav_jovic The lanes in the USA really do seem pretty wide. In Germany where I live they look to be narrower. What the original comment says definitely applies to narrower roads/lanes, it surely does where I live.

      In S.C. entrapment is totally legal, being a commonwealth they have a different law set. "You're in the South now." I heard that a lot when I moved to Charleston. I'm surprised that he didn't get ID checked and ran for warrants just because he had contact with an officer. Chucktown cops are straight up badass.

    I have been on both sides of this one. Cops (and other people) are constantly screaming at you and telling you what they perceive as to where you should and can't ride. I am sure that you, as I did, know the laws and try to stay safe.
    Cops are always "helpful" giving directives but when your bike gets stolen from a public place by a bolt-cutter wielding criminal, they treat it like it was a kid's $150 Huffy and not the $3200 road machine it is.

      Stay out of the middle of the road, move over and potentially stop if a car is behind you. You as a cyclist are little more than a nuisance on the road, unless there is a dedicated bike lane.

Don't play stupid games, don't win stupid prizes. Beyond that dumbZ, riding a bike on the sidewalk is against the law.

      @@cheesedoesgaming6088 sidewalks arent designed for bikes. they are actually more dangerous because people cant see you as well when pulling in or out of entrances and they also only have a 20 mph speed limit. road bikes especially when ridden by someone in shape can actually exceed that limit. if you dont know how to drive and follow the rules of the road that are also granted to bikes as well then you shouldnt be in a car in the first place.

      Except he ran the light! Yellow means you need to make every attempt to stop if given enough time. No way he was going "too fast" to make a safe stop. Another cyclist who thinks the rules don't apply to them.

    No,you are more likely to bet run over or caught in a drainage grate or hit a curb etc . when you ride to the extreme right , cars will generally pass too close whereas if you are legally in the middle of the lane the cars are forced to pass in a left lane if available or wait to pass in the oncoming lane which also gives you more room between you and the car .

    yeah, he passed the light on red, but i would do the same if there wasn't cars waiting there, it is completely useless waiting for nothing, the road was empty, there was no need to pull this guy and molest him for such a small detail.

      It was amber as he entered the junction. It was not practical to stop in time. This is the same as the law for cars when it comes to amber lights.

    Nice enough cop, but no requirement to be as far right as possible. His lane positioning on a multilane road was perfect. He's MUCH less likely to get hit in the middle of a lane rather than riding close to a curb and in the debris area from the rest of traffic. He was moving quite briskly... apparently in a lot better shape than I am at the moment and not doing anything wrong. The only one that technically was doing anything wrong was the cop.. "Pedestrian in the roadway". That is an infraction right there. Could possibly also toss in the cop impeding as he was physically stopping the progress of the cyclist who wasn't in the way of anyone. There is a psychological effect called "unintentional blindness" where drivers don't "see" cyclists BECAUSE they are way to the right, wearing hi vis gear, running tail lamps, riding in a straight line... the brain of a driver is scanning for 'threats', brain scans the cyclist and determines "not a threat" and STOPS SEEING them. Cyclist in the middle of the lane or significantly out away from the curb, "What the hell is that crazy cyclist doing in the middle of the lane!?!?!", conciously "SEES" the cyclist, safely routes around them and goes on their merry way, probably telling all their friends at work about the nutcase on the bicycle they saw on their commute... not even realizing that their might have been 10 other cyclists or more that they never even "saw" because of that phenomena. The term for cycling law is "as far to the right as is practicable." NOT POSSIBLE... and it isn't up to a cop to determine, it's up to the cyclist.

    I thought I knew where you were around the 3 minute mark, but when you came under 525 and I saw the orange roof on that Harley dealer I knew exactly where you were. Big surprise here is he didn't try to force you to show ID, I was absolutely expecting it. Enjoy the ride!

    •When traveling at or near the same speed as other traffic
    •When preparing for a left turn
    •Where a lane is too narrow to share safely with another vehicle
    •To avoid any condition that makes it unsafe to continue along the right-hand curb or edge
    Many surface hazards - such as potholes, puddles, debris, and broken glass - are more common near the edge of the roadway. Keeping to the right can often hide a bicyclist from a turning motorist at the critical time and place.
    Driving in the middle of the lane actually protects cyclists against the most common motorist-caused crashes: sideswipes, right hooks, left crosses, and drive-outs. A bicycle driver’s top safety priority is to ensure he or she can be seen by motorists with whom they might potentially be in conflict, and bicycling in the middle of a lane is one of the most effective ways to do that. Most overtaking crashes involve a motorist who attempts to squeeze past (illegally) in a lane that is too narrow to share.

      Lanes here only allow for a car, not a car and a bicycle side by side safely within the same lane. So when a driver want to pass the cyclist, that driver have to change lanes and pass in the other lane when overtaking.

    I don’t follow his logic. If cars can’t see you it would be deadly to drive to the right given the width of the lane. Driving in the middle of the lane improves your visibility.

    I am always amazed at the way motorists view bicyclists. If we look at the roadway where the officer stopped the rider, it was a low traffic density roadway at the hour the cyclist was riding. It doesn't appear, based on the vehicles that passed the cyclist, that any vehicle would have had to wait behind the cyclist for more than a few seconds. They may have had to lift off the gas and move their steering wheel a degree or two to the left. Yet motorists will lose their mind over this. NC law requires bicyclists to ride as far right as practicable. The word practicable was used in the law instead of possible for a reason. It allows the cyclist to use their judgment, based on the whole of the circumstances, to decide where in the lane to ride. The officer an motorists in NC should read this part of the motorist guide. Especially the last 10 words.
    North Carolina Driver Handbook (NCDOT/DMV ):
    Bicycle riding is an important means of transportation, particularly
    for traveling to and from work and school. Because bicycles are
    vehicles, bicyclists must obey the same traffic laws as other drivers.
    Bicyclists usually ride on the right side of the lane, but are entitled
    to the use of a full lane.

      Dude I see cyclists riding in middle of the road NEXT to a cycle path FREQUENTLY.
      It's so infuriating and inconsiderate.
      Saying "you can go around me if you wanted to" on areas that have a double solid line that's illegal to cross without going to the side of the road is ridiculously selfish, inconsiderate and idiotic.
      I have no issues with cyclists on the side of the road at all. But the dead set middle? No. Just no.
      No one wants to run anyone over.

      @@tywinters9462 No, our bicycles do not pay taxes, but as riders we do. Local roads are built and maintained using various ad valorem taxes. Gas taxes haven't covered the cost of state and federal roads for a long time. General fund taxes are used as well, and we pay those.       Sorry for the uneventful beginning portion. I would have deleted it, but my GoPro was acting up so I had to just upload the entire file intact. I do think it was helpful for context to show that I was indeed following all traffic laws (even before I realized it was a video that would later be uploaded to UA-cam).
      I've added a note to the description telling folks where the interesting parts begin. To be fair, it was already mentioned farther down in the description, for anyone who actually read it.

    Not enough traffic, and going at a fast pace are two reasons that support your choice to ride where you did. The risk is all upon the cyclist. Hopefully he does this to drivers that ride within 3ft of any cyclist.

    Nice cop, the lane thing is just a safer suggestion, but yeah did run the red light I’m sure he saw it in his video afterwards but chip let that slide.
    Actually watching it again , from where the light is standing and the point your camera shows it’s red you’re already passed the intersection, so you’re in the right on that one, seems like that light pole should’ve been place before the intersection

      The lane thing ISN'T a safer suggestion as the cyclist pointed out a couple of times to the cop. It encourages unsafe passing within the lane which is impossible in lanes that narrow but some drivers think they can pull it off. Some actually do but it's still unsafe.

      He's not breaking the law, but the cop was by stopping him. It was an illegal stop. Cyclists are not required to ride on the right edge of the road where the lane is less than 14 ft. We can use the whole lane. You'll have to accept this or go around angry all the time.

      To be fair, I clearly stated in the description where the "interesting" parts started. The purpose of the video wasn't entertainment, it was to document what happened during my ride that day. Sorry if it wasn't exciting enough for you.
      As boring and uneventful as the first 9 minutes were, they do show that I was consistently following all traffic laws, even before the unexpected encounter with the police officer.
      Honestly, I would have uploaded a shorter snippet, but my GoPro was acting up, so I decided to just upload the entire 12 minute unedited video file for simplicity.

    Dorchester road. I live a stones throw from the Harley shop. Man you are traveling pretty fast. I'm just starting to ride a bike around this area and looking forward to learning what the rules of the road are for bikes. I was riding on Dorchester Road the other day and stayed on the sidewalk . I'm not all that confident with the drivers on Dorchester Road to ride in the lane yet . Although cops did pass me , I'm sure that riding on the sidewalk is illegal? Thank you for your upload

      Hey neighbor! I agree that Dorchester Road is nerve-wracking and riding on the sidewalk (at least on the overpasses) is sometimes the safest bet.
      Technically in North Charleston riding on the sidewalk is NOT illegal (as far as I can tell - I haven't been able to find a City ordinance prohibiting it like in downtown Charleston).

    As a car driver I have, in recent years, seen cyclists with those tiny, goofy even, flashing lights at the front and rear of their bikes. From a distance, I wondered what it was. "OH! It's a BIKE!" I have to comment. I was picking up on a bike being ahead of me 2+ blocks away! In my humble opinion, they work GREAT and are relatively cheap... even the dollar store sells them!! I don't want to say they should be mandatory (We have enough laws as it is.) but they sure are effective! Much better than reflectors and glow in the dark vests. Those lights stand out even in bright sunshine!

      They are called day light running lights. Its just often a setting on lights. Low, Medium, High, Daylight, Night flash (sometimes come with it). Rears often have low, medium, high solid lights then solid low flash, high intensity, then strobe. Dollar stores sell blinkies which are more or less these settings for a dollar :)

    as a bike rider you have as much right to the road as a car. the only thing being is the center of the road is where most of the oil drip off the cars. i'm always looking for slip hazerds.

    Ok. I am riding an unstable vehicle with no ability to accelerate or stop quickly from anything but a fast runner’s speed, it has no turn signals nor brake lights, I pay no road tax and I can hardly speak because I am so out of breath. I also like to refer to people by their ethnicity as I guess it to be. What a self entitled fool!

    There is no cycling lane, unsafe directive. Lane changers has a faster change identifying a cyclist in the right lane . A better safety preventive law not enforced is the move over or no passing cyclist in the same lane law on the roadway.

    50/50 bike should have stopped for yellow light. The light just turned red as you crossed the line. Cop should know that cyclist are likely to get side swipe by cars cutting close. There were more then one lane of travel and he was keeping to right lane.

    Do not say you are riding in middle of lane because you are riding like traffic but you did just blow through the red light. The video confirms you blew the red light and then just lied to the officer. You are right to ride in middle of lane … you are wrong to blow the red light. He should have given you a ticket for that

    This is my pet peave: cops and members of the public who don't know the laws or bike safety lecturing cyclists about where and when they should ride. In a lane that narrow and with another lane to the left, he was riding precisely as he should have. Even if there was no other lane, he was riding correctly. That lane is too narrow for a car and a bike to share. Riding on the right edge of the road would be the least safe option here. It only invites people to try and squeeze in between you and another car.
    I get it. People see cyclists riding poorly all the time and have an attitude against cyclists. But you were in the right. I'd have done the same no matter who disapproves.
    His point about the sun glare would have been valid had the sun not been coming from behind. If I can help it, I never ride into the setting sun.

    Well yes cyclists belong to the right. But....not always. It depends on several things. How busy is the road, how narrow condition, type of traffic, type of rider, even the weather like sun or rain. The point is it is up to the cyclist what to do. And not the cop.
    Now if they just make that sidewalk a bit smoother and turn it into a proper cycle path, then the problem is solved. Because the real danger is having to change lanes the whole time. If you want cyclists to keep to the right, then they ill need their own separate crossing. On the junction is where it matters. Trust me, I can jump all red light in the entire USA and I will be safer then to wait for green. I can stop for cars coming from the left or right. The dangerous cars are next and behind me! Those are the cars I am worried about. And the funny thing is so was the cop. If he really wants you to be safe, he should tell you to ignore the stupid traffic lights and look for a gap in traffic.

    From Motorist to Law enforcement its illegal for them Harass us cyclist or tell cyclist where they can and can not ride. State Must have signs posted saying cyclist is not permitted on the road. If law enforcement flags you as a cyclist down and you cant ride on the road they must provide evidence where it says state law and possible city/county law.
    Sidewalk is for Pedestrian not cyclist. I recommend getting in contact with your State Bike lawyer for information but also city ordinance

      You don't know that for a fact. The cop's point was that, even though the cyclist may be in the right, he didn't have much trust in the motorist. If you ride in the middle of the lane, some motorists get impatient, if they can't get by you. I prefer to ride in the bike lane. I would try to avoid streets with no bike lanes.

      You're right that the light was red at 10:21 when I finished crossing the intersection, but it was yellow when I first entered the intersection, therefore I was in the intersection legally. Police officer was incorrect but I can't blame him since he was looking west and had the sun in his eyes, plus he was a few hundred yards away.

      Can you please point me to the part of the law that supports your statement? By my reading of South Carolina state law, a steady yellow light simply means that a red light is coming - it does NOT require someone to "stop if it is safe to do so." (www.scstatehouse.gov/code/t56c005.php - see SECTION 56-5-970, Traffic-control signal legend). If it's mentioned somewhere else that I'm overlooking, I'm open to correction.

    Get a bright flashing rear light that can be seen in the daytime! Stay safe, seems smart to ride in the middle on a big two-lane road like this. Better to have people pass you in a separate Lane then try to have people whizzing by and force you to the edge of the lane
    Anyway I would make sure you're really visible. Get a bright flashing light for the back that people can see.

      I never know quite how to respond when someone's reality stands in stark contrast to my own. I have never known a single person who obeys all laws all the time. My observation is that every driver picks and chooses which laws they want to follow. Do you know anyone who never slow rolls a stop, never slow rolls a right on red, always signals every lane change and turn and never goes so much as one MPH over the limit? I don't. We all break the law when we think we can do it harmlessly.
