What if you are only intending to use a trademark as a way to mark materials that you worked on, ie videos and photos, graphic designing printed materials, etc.?
You don't need to be making an income, but you need to be actively marketing the product/service and offering it for sale. That is usually enough to pass as using it "in commerce." Thanks for the great question!

You can apply and start the process beforehand but you have to be actually using the trademark in commerce before it can be registered. With extensions, you can get up to roughly 3 years to show that you've started using the trademark/selling your product.

I recently purchased a business name as well as registration. When I searched the name it showed that there were no other names registered and that no one else had legal rights to it. I recently discovered a small business in the same industry as me, they're a competitor, and they refuse to stop using the name. We are taking it to court because they had let their registration end and had not renewed it. Therefore it showed up as free to use and had no issues legally. They have slandered my name and my business name on social media and publicly. Can they do this and can they continue to use my registered business name?

It will entirely depend on the details of each trademark. If both trademarks are in the same or similar classes of goods/services, you probably will not be able to get a trademark even with different spelling. But if the classes are completely unrelated, you may be able to get it (even with the same spelling).

If you're using the same name and logo for two different types of businesses, it would be ideal to get a trademark in both types of classes. No, adding a descriptive element such as "company" or "merchandise" typically won't be enough to differentiate your name from another one.

How many things can you trademark at once? And does the name counts if i want to trademark 2 logos and 1 name
As I understand, I need to apply for two separate trademarks for both of my business name and log, so question is , can I combine those two trademarks AKA can I use both of the trademarks(name+logo) in commerce for same product ??? For example, brand APPLE has logo and its name which have been in commerce for serving electronics .
I recently purchased a business name as well as registration. When I searched the name it showed that there were no other names registered and that no one else had legal rights to it. I recently discovered a small business in the same industry as me, they're a competitor, and they refuse to stop using the name. We are taking it to court because they had let their registration end and had not renewed it. Therefore it showed up as free to use and had no issues legally. They have slandered my name and my business name on social media and publicly. Can they do this and can they continue to use my registered business name?
Yet my business name has been registered on a trade mark but the logo is not going to be the same as what mine would be, so would that make any issues for me or do I have to change the business name?

Question: when trademarking a company, can you also trade mark the name used? ex: "Wicked Joe Designs" is the company's name, "Wicked Joe" is the name of "John Doe' " who is using "Wicked Joe" to do business. That way John Doe can introduce himself as "Wicked Joe."
Hello- I intend to start a sole proprietorship. Can trademarking a name in this case be used as a substitute to registering a business name? (or are these two separate procedures, and do I have to do both?). I want to bypass registering a business name due to all the details I have to submit (address, estimated yearly revenue, etc). I have a product that I am about the start producing and selling on Amazon and finally came up with a name for it that will be engraved onto it, the problem is its a short name and there are multiple other companies using this name for all kinds of other various products and services. Does this mean I can't use this name anymore? No one is using the name in any similar market as my product but what risks do i run by using it anyways?

Thanks for making this video Aiden! It was very helpful! Quick question, can you register a name or trademark that sounds similar to another business name or trademark but it spelled differently? For example, "The Wooden Spoon" vs "The Wooden Spune".
It will entirely depend on the details of each trademark. If both trademarks are in the same or similar classes of goods/services, you probably will not be able to get a trademark even with different spelling. But if the classes are completely unrelated, you may be able to get it (even with the same spelling).

So, in that case is better to create a corporation and then apply for the trademark? This is trying to create a youtube channel and I just have a name for it but nothing else, no company and no trademark registered. Nope. Registering an LLC does nothing for your logo or other trademarks.

From what I've been told, copyright backtracks to the date of application [barring complications] during the application process. I understand that one trademark can be filed under two different classes.. Would I have to do two different classes if I was going apparel as well as consulting or could I just do one or the other and still use my name and logo for it all?
If you're using the same name and logo for two different types of businesses, it would be ideal to get a trademark in both types of classes. Curious, when does a slogan (words) not qualify as being trademark, but instead must be copyright? I ask because I always thought if it was words (alone) it must be copyright - not trademarked.

If a trademark shows as dead or abandoned, the USPTO will not take it into consideration when they're doing their own evaluation. But that doesn't necessarily mean you can trademark it--there's a reason the application was abandoned, and it's often because the applicant could not overcome a likelihood of confusion refusal. How can I protect myself I have a business in my area that is using my business name...I have an LLC with the state as well as federal EIN.
