Ooooh mmmyyu Goddess!!!😮This is theee most powerful video I’ve watched and thee most valuable info I’ve heard on this subject matter. You just set my mind at ease and made my decision making so much easier so I can finally move forward knowing I’m doing the right thing. It makes so much sense. We can always redo our logo design but what’s important is your business name being protected. GOT IT!!! Thank you sooo much for this info. Many blissings to you and yours. 🙏🏾👸🏻
Another good example of a logo taking as much dominance as the actual company name would be Apple. They use that bitten Apple icon on all their products without ever using the actual name. Also thanks for the informative video, very helpful!! 😊
Always enjoy your videos! Content is always on point! Your energy and personality is amazing! Thanks for what you do and all the information you provide us listeners! you are amazing!!
I went to a multimedia college and the advice we got in portfolio was Trademark the name and copyright the logo. Like you said the trademark protects, regardless of the styling in color choices so when you do change the colors etc. then just get a new copyright. Is that due to expenses like you mentioned or because the Trademark protects more broadly that you only need to copyright your design choices? Love your energy and delivery of your content! ✌️
Let’s say Nike gets one or the other. Should they get the name, or the logo that is literally their company. My biz is based on the design. Can I do my design with a small text name underneath? Like a two in one😊
Thanks for the information. So we are Trademarking our Name. Apart from that, We have a Logo that is a design that contains common words that represent what our brand or Life style represents. Do the words in the design need to be trade marked too? Or will that be included with the design?
Hello! How about if someone is in the same exact class code for the trade mark? Hypothetical Example: Their name is “Funny Laugh Button“ could someone come out with “The Original Funny Laugh Button” the same product but a didn’t color button with a different logo on it? Is the law the product getting confused or the name Thanks in advance!
It was very helpful for me. Can you explain to me that, I have registered my trade name a week ago. Can I now add my logo in that same trade name and trademark?,
I have started creating stuff and selling them, could you do a video on give us an idea around choosing a name for maybe a small business and where can we check if that name is taken or how to register it please? I feel a bit lost to this new thing
Im kind of worried. I created a logo through AI generator for my business, and on the platform I created it on its public to other users. My business is new and I haven’t yet registered my logo or name. I’m afraid someone might steal it.
Thanks for the video. I am getting confused about TM registration. I read on the USPTO webpage that the usage of a phrase or name creates trade mark rights. So once I start using something, it is technically mine. However, it is not enforceable since it is not registered. Do I interpret that correctly?
I don't know if it's true but did Coca-Cola trademark the the registered are symbol in their logo and can people who choose to incorporate the r symbol in the logo can you do that
so if I want to trade mark s name but some one using the name in a different way but have not use the name in 28 years. but I also want to trade mark a logo with the name on the logo can I trade mark the name with logo in it
If you put your trademarked business name in the logo then legally no one can use that, but they can use your logo with a different name. That’s if they have the artistry to make your logo, which is not very easy, depending on the logo. Now if you decide to trademark your name and not the logo, you still have chances to change the logo whenever you feel necessary.
Honestly I still have a question. There is no option during registration through USPTO TEASE Application to choose logo or business name trademark. so how I can choose?
Can I use the TM at the end of my business name before applying to register my company name? Once it is approved, I’m looking to replace TM and add the R sign at the end.
@@GarytongueBetz-vl1fu hey! I’m going through the process now and yes, I can in fact add a TM to my company name since it is in the process of being approved. This is done temporarily so that it deters others and warns them that you have an application pending
@@allupinyobiz yep! However important advice! If you sell on Amazon while your registration is pending approval, and then gets denied, Amazon will take you down so you choose what is best for you and your business!!
No, I’m going through the process now and my attorney recommended I register my company name instead. You see, logos can change over time whereas your business name, it may not
@@miguelrosales6667 Business names can change too. Happens all the time. She literally says in the video that Business names.may change but are far less likely than the logo, but it still can happen.
She also answers your question more directly at 5:08. She said only the logo is protected and your company name is exposed and out there for all to see and.not.protected, due to not getting the NAME TM.
Hi. I like the way you explain. Is it possible some how send you an email? Just don’t want to share all information here. Need your opinion about what should I do in my case….
You said we refer to businesses by their name and not the logo, but this isnt always entirely true. McDonald's being a prime example. Yes, people still call it McDonald's, but it is VERY WIDELY referred to as The "Golden Arches", so point to me! Checkmate! 👑
Thank you...I'm designing my own logo, and it has my business name on it, so I want my logo protected. Because it is my own design.

My name is in the logo.

Yup it sure is!
Thank you. If you trademark the company name…how do do you specify what products this company name is creating using that company name?

Me too I start a business am I have a name that I know for sure no one is using am afraid to put it out there without protection
do you have a video on how to do both?
Great video! Question? What if your brand sounds alike but it spells different from another company brand?
For Example: THE QUEEN SUGAR -vs- KWEEN SUGAR

Probably, whatever you put in to be trademarked "is" your choice, as evidenced by the fact that you put it in as what is to be trademarked.
is this the same as the uk?
If my business is Jones Brothers pest control would you trade make that?
Who care?
The Jonas Bros. Suck and they have NOT trademarked or copyrighted their name, so Rock On!
Can I use the TM at the end of my business name before applying to register my company name? Once it is approved, I’m looking to replace TM and add the R sign at the end.
No, if a trademark hasn't been approved you obviously cannot use TM. That is what TM is short for.
@@GarytongueBetz-vl1fu hey! I’m going through the process now and yes, I can in fact add a TM to my company name since it is in the process of being approved. This is done temporarily so that it deters others and warns them that you have an application pending
This is wrong.
Yes you can TM when it’s not registered. Then R when it is. 🙂
