A Supreme Court bench overruled a 2004 judgment and allowed states to create quotas within SC/ST quotas on the condition that data supports it. One caste Meena has captured entire ST quota. Same in SC, for Jatavs. And then they show poverty statistics of other castes. These castes don't marry within each other as well.
Even if you don't exclude castes, rich individuals must be excluded.

@@rajx7120 in every merit Brahmin are more so it doesn’t mean you start classifying in upper caste as well it will be injustice to brahmin. Classification should be based on appropriate data of social and economic status of these caste.
@@TourDVibesBrahmin are not getting quota benefits We are talking of quota beneficiary. And brahmin are not the only caste in general category. Thakur, Baniya, Rajput, Khatri are also upper caste. All of them are equally found in unreserved merit list. Many times OBC creamy layer like Jats and Yadav are also there in unreserved merit list. And all of them are now marrying each other also.

The same boundaries, if drawn by the Govt as law, would have been politically suicidal. Certain decisions are best taken by the Govt. NEET is another example
ST (Meena), SC (Jaatav), and OBC (Yadav) should now be considered as part of the general category since they occupy more than 50% of the quota. The government should be considerate towards the lowest sections of the ST, SC, and OBC categories.
Then % of reservation need be reduced as per the SC,ST section excluded.

Mr. Chandrababu Naidu made this sub categorisation in 2000. Mr. Babu understood injustice happening to certain categories in Sc's, and made sub categorisation in Sc's. Now supreme court uphold this sub categorisation. Great judgement.

SC Reservation was introduced for representation of socially oppressed classes of Hindu society for 1000s of years, that is why a Christian or Muslim convert of such caste is barred from SC caste reservation.... ST reservation was introduced for representation of people based not only for social causes but also indigenous rights as they are the original inhabitants of these lands before other people migrated and dominated this subcontinent.. a tribe conversion to Abrahamic religion does not disqualify him from ST status..
Economic factor is not at all the criteria for such reservation.. For economic upliftment though helpful due to these quotas is mainly done from Government poverty elevation programs and not from reservation and quotas for such classes..
These reservations are meant solely for representatives purposes of such people and the right of such people to compete within themselves, mind it, they are still competing amongst themselves for their allotted seat, be it poor or rich SC and ST community ..
I think the decision to introduce sub classification within these group should be in consultation and involvement of these people.. Judiciary has already caused a major law and order problem from such parliamentary subjects such as in Manipur where the violence and warlike marginalization of two groups is still happening..The ruling Government has to bear the consequences of these ill conceived decisions.. BJP lost in Manipur from both warring factions constituency and is still not being able to face save itself.. Government should stop the Judiciary from interference in parliamentary affairs where thousands of life and law and order problems may arise just that few highly privileged Judges with no ground knowledge of reality interprets the constitution in a vague and illconceived manners..
If these differences and knowledge of constitutional provision is not understandable, then people have to start reading the constitution once more.. Jai Hind.
On a personal note, it would be good if there is a decree from the government to ban all caste and forbid the uses of caste surname like in the western nations since we are adopting and doing everything western..

The quotas are wrong. It does not create better society. Only meritocracy will create better society and create more benefit to the society. All jobs and admissions has to be by meritocracy.
Indian Reservation system seems to motivate the reserved to remain reserved and not to uplift themselves from their poor socio-economic situation.

After this judgement, one thing is certain: "interesting times lie ahead."
Good judgment… should be made applicable to politicians contesting from reserved constituencies.. Those who availed reservation for 2 times, should not be allowed to contest from a reserved constituency for the third time.. Chance should be given to a fresh candidate.
Why 2 chance make it one chance which yields pension.
First of all, the SC and ST reservation is to fight the issue of UNTOUCHABILITY. If you are an SC, u will always be an SC! Even big officers or successful people face this. Secondly, even if there is creamy layer added in SC/ST, suppose a govt employed peon is cut out of that slab, where will he go? How will he get any benefit? Could he or his family ever be a priest(brahmin) in a temple? NO!! He will always be labelled an SC. He will face the same lifestyle like a person from the unreserved category while still facing untouchability issues which are prevalent almost anywhere and everywhere in the country!!!! Think this through! It is quite a sensitive issue. Thirdly, the percentage of successful SC/STs arent that much to create such laws for them. Fourthly, did any of the SC/STs ask for this? Demand for this? Why is it happening now after elections? Lastly, think of the polarisation and rift this will cause in between the sub-castes!! OBCs and SC/STs have to a face a very different day to day scenario!! Untouchability, racial slurs and what not are still being experienced by SC/STs at higher levels in the society. Seems like the first step to Cut and curb out the SC/ST reservation.

A poor man or lets say a govt employed peon from SC will not come under EWS because of the income limit hence he will have to pay the full fees every which where meaning he lives like an open category UR student under the tag of SC and will always be treated like an SC! Also, how are the developed SCs "taking" away the privileges from the poor SCs? Are they stopping them from taking the reservation? NO! Thats not even possible! It is just competition and believe me, there still are YEARS for the SC/STs to develop and the question about living without the tag of caste...thats a very far fetched dream. Again, due to this rift, the seats would remain empty and would go to the UR eventually cutting out the percentage of SC/ST reservation which seems to be the real agenda here.
When a system like this is misused by well-off people from the SC ST group, some interesting things happen: 1. A new group is created within the SC ST community itself. These are people who are rich but still qualify for reservation. 2. Remember, reservation doesn't get rid of the cutoff idea. So, you still need to pass the minimum requirement, but within your own category. 3.The rich SC ST individuals (there are millions of them now) have much better resources compared to the SC STs who are actually poor. 4. Because these wealthier SC ST individuals have more access to resources, they usually perform better than the poorer SC STs in competitive exams. 5. In simple words, the poorer SC STs in this country continue to face problems not because they face challenges from the General category or the elites, but from their own richer fellow SC STs who are misusing the system.
It's time they should start working and become meritorious instead of just depending on reservations because they are not anymore living in 90s

Wake up India.Take a cue from Bangladesh political scenario when a ruling government has been toppled for reviving a previously scrapped quota. Unless India scraps reservation completely the rich vs poor divide among minorities will keep on increasing.The rich affluent families among minorities have made reservation a multi faceted diaper for their children,grand children and nephews/ nieces where due to permanent quota system their upcoming generation will automatically get admissions in Government colleges and would automatically be recruited in government jobs coupled with receiving monetary benefits (which are sucked up from tax payers money).Whereas the poor people who are stuck in villages continues to fall victim to untouchability.
Next logical step is to create creamy layer in the SC-ST category soon.
Creamy layer criteria for SC & STs must be removed in admissions to all educational institutions. Otherwise, hundreds and thousands of college seats will remain unfilled.

Only those who pass out from Government Medical Colleges have the capability to clear the PSC Exams. Especially the meritorious students.
Meritorious students score 600+ in NEET.
They score 70% and above in semesters and crack PSC and then get appointed as doctors.
Basically you have no idea how doctors get jobs. If NRIs are talented they will crack the PSC exam and get the job or else they will remain jobless. Just passing from a Medical college doesn't make you a doctor.

Reservation has led to another type of disability in the society. Most people don’t go to SC/ST/OBC doctor or surgeon these days. Reservation has killed meritocracy and is playing with our lives.

All India now needs a reservation based on economic status. Thars the only solution for uplifting the poor and downtrodden for a better future. For 75 years, we tried caste based reservations, and it's very evident that nothing much changed for most. If we need to change that our thought process needs to change there by changing the political narrative. Till that happens, we will keep on discussing quotas and nothing else.

Excellent news. A new era of reservation politics/appeasement/policy making will be unleashed. Now everyone would need to declare their castes and their castes would be questioned upon how much backward they are. More backward castes will get more seats. Focus will shift from sc/st/obc/gen seat shares vs shares within the sc/st faction. After all why should these castes should not be further bifurcated?
Castes who were having access to resources enjoyed the reservation for a while now. We've lost crucial years in bringing equalised development for a lot of castes, these castes who are unaware that theres even reservation for then.

Very disappointing coverage on the Olympics. No surprise the Indian contingent’s performance mirrors it. If sports event as big as Olympics continues to be afterthought for media outlets then we have no hope.
Instead of treating whole caste group as "more backward caste" among the Scheduled Castes, and giving the whole group a priority over other SCs, we should consider introducing an economic criteria to filter out the poorest among all the castes. There might be poorest of people in every caste which gets reservation under SCs. Even if we sub classify the SCs as "more backward caste group", "less backward caste group", even among the more backward caste group of SC, only the resourceful individuals will gain benefit of reservation.
Real upliftment is giving priority to all the weak and poor individuals among the SCs and introducing an economic filter. Poverty is the real weakness in today's age. Lets give the poorest "individuals" a chance across the wide spectrum of "caste groups".

When general or upper class get reservation is ok but when sc st get reservation ohh my good country is not growing.
How will a person belonging to village and rural areas will compete with son of IAS living in Urban area and reading in top class school ? I think people in our country are bais to themselves this Creamy layer will take out the upper class of sc/st and they are fearing to compete with general category, otherwise we don't like subclassification because rich sc/st will come into general seats
I don't understand why OBC gets reservation. The OBC caste are mostly the agricultural and artistian caste. They have land and traditional occupational skill which not related to pollution and taboo associated with it. The Yadav, Kurmi, Jat and Gurjar caste are well off caste like Brahmins. The OBC reservation was completely political. It never needed. If India want to get rid of the reservation and caste then government must start with the OBCs, first get rid off the OBC reservation and in next 10 to 20 years get rid off the SCs then with the STs. Reservation should be based on the economic criteria not on the basis of caste. We should only have 15 to 20% reservation for the poor and lower middle class people
The SC judgement says "backwardness" is presumed. That's fine, at the moment it is like that. But Shekhar goes to such a length to discard the creamy layer part of the judges' opinion. It conveys his views on the matter. SG doesn't need to be in pain explaining that and his bias is clearly evident when he says ," creamy layer business" in the episode.
Also, if economic empowerment can never help shed the social backwardness tag, then why give reservation in the first place to cure the issue. The fact is giving representation in education and jobs do improve ones social standing , at least one should be objective enough to accept it.
The judges, by the creamy layer part of the judgement mean to say that. One should at least acknowledge it.

Heterogeneity does exist in Sc sT, but not in the way SC has interpreted it. Sometimes few families of say XYZ caste reap advantages of reservation and are economically well off. But many more families especially those living in rural areas, belonging to the same XYZ caste are downtrodden, unbeknownst of any affirmative assistance by the state. Categorising XYZ caste and ‘more backward’ or ‘less backward’ is not going to help those people …

However, that is the problem when you ask for reservation at a a community level. If the idea is that the community gets representation, then certain communities have already had high representation even if some of their members are still struggling. This is as true for the unreserved communities, who are told that you have enough representation even as many live in rural areas and live meagre lives with no support from the government.

An opportunity is lost. The court instead of sub classification could hv used economic criteria,within the SCST quota to give the preferabce in reservation. The poorest of the poor gets first and so on. The creamy layer concept will be a nogo. It has not worked even in OBCs where there are many income headings that are not considered. This slso could hv taken the political exploitation by parties.
