      It’s by design since the more people who go to jail, the more people to do unpaid slave labor. Therefore, people who can’t afford a private lawyer get stuck with a public lawyer who doesn’t have enough time or energy to make a good case.

    Public defenders aren't shitty, they have the same qualifications as private lawyers, they just work for those who can't afford it

      I only think they have to much work going on, maybe some of them got worse deals or some better deals bc they handled often simmular cases. Or they are maybe new lawyers. But i dont think they are that bad of a deal. But if someone has the money and time to get a lawyer that they pay themself they can of course.
      In germany we usually get rhe stuff paid from the staate if we dont have enough money or a bit paid at least, if we fill a form before and they say yes. Lawyers are less expensives, but the process itself costs more then in the usa. If u have a wining case anyway the other person needs to pay ur fees and ur lawyer, if u need a lawyer. Also they need to pay all costs of you driving there for the process like if u couldnt work or ur gas.
      I like it that u can choose a normal lawyer, and so people get paid and dont get to many cases at once.

      The issue is not that they’re any worse, but that they’re extremely overworked. So while a private lawyer may be solely focusing on your case, a public defender may have three other trials that day.

      I was my public defender's first case ever. I was a stupid kid and didn't know any better so I pled guilty to one 15 year felony instead of 23 one year misdemeanors. She said to me "do you want to do 15 years or 23 years.?" so I pled guilty to the felony. She did NOT tell me all 23 counts would be run concurrently or that I could have it expunged from my record in ten years or if I violated my probation the most I could get was the remainder of the one year sentence. So no 41 years later I can't vote, never had a decent job and live in a 190 square foot illegal apartment with a 10 amp electric box that I pay $1200 a month for and by the time I'm done paying my bills with my minimum wage pay check I'm deeper in debt than I was last month. All because I let a rooky PD con me into what she was conned into by the prosecutor's office.

      To be fair it’s not really slander, it’s just the truth. Public defenders are great people who do good work, but are unfortunately underpaid and overworked because most perspective lawyers prefer to go for cushy private sector jobs which allow them to pick cases and pay more (with more benefits) and that’s without considering the perks of the fancy offices and whatnot.

    Private lawyers ALSO ONLY take cases they know they can win easily. Other ones they won't even try on if its not a guarantee. They cant risk their "perfect" record

    So I had a case in 2017, hired a private lawyer.
    He was dog crap, never communicated anything about my case nor returned my calls, made me take the first offer they gave me on a plea deal.
    Go with a public defender, they're gonna work harder for you because they are working to get into the DA office. Private lawyers just want your money.

      Yeah mine did too, was facing a battery for a crime I did not commit since I was attacked first by my roommate and the battery got dropped & I went on probation for a year for disorderly conduct and I finished that successfully all with a public defender

      I am a public defender so I'm biased. But there's nothing wrong with wanting to get paid for your work, I made a choice based off what I wanted out of my life. But going to law school just to be a professional defense attorney is still a valuable thing. Valuable things cost

      What people don't seem to understand is that usually some of the documents required to deal with certain cases tend to be paid, and boy they are expensive
      Now I'm not a lawyer myself, but that's what I've personally heard from them, that might also vary between countries although I honestly doubt the differeneces can be all that big

    I’m Peruvian here you have three options:

      @@suungjinuppl are often pressured into plea deals despite being innocent. It’s basically a choice between fighting your case and losig your job, your kids, you home, and maybe going to jail, anyhow, or getting a fine, plea, or even time served, and getting back to your life.

      One of the perks of having a private attorney is that he is more likely to DO HIS JOB…. More effectively anyway.
      Public lawyers are swamped. And most do the minimum, but every once in a while there’s a good one OR your case was just an easy case to win, and the public lawyer does well.

      One thing to remember about the perks. They aren't free. You get charged for those snacks and drinks. They actually wind up itemized on your bill.

    I think the underlining is a sad reality often overlooked. We live in a Society with laws so complex that we need somebody who studied law for years to defend our own actions. Yet at the same time we are fully expected to understand and follow these laws.

      thats called discovery, litterally time given to you as well as what the oppsing side has on you so you can study up on the stuff to defend yourself. all it takes is a little reading comprehension, been to court twice self denfend both got one plea deal and the other got dropped by state prosecutor after discovery (i had too much supporting evidence there was no way they where going to win)

      @@khayyamaurelius912 OK? So why can we not defend ourselfs in court if it's just "common sense" also I'm not quite sure if you realize how common False incarcerations actually happen. Not only that but It works both ways and the guilty go free all the time too.. And most times this all depends on how good of a lawyer you have which boils down to how good of a lawyer you can afford. You Can try to deny this and act like we have a flawless or even close to flawless justice system, but it's the furthest thing from the truth And many people have experienced that first hand.
      If The world was black and white and it only depended on common sense and logic Then there would never be a need for a lawyer and no reason you couldn't defend yourself in court.

    My public defender got 4 of my 6 felonies dropped and i plead to 2 level 6s and instead of doing 12 years in prison i got a 3.5 year sentence with 2.5 suspended to probation with the ability to petition an amendment to misdemeanors after the completion of my probation for cheaper expungement. most of them are unmotivated or have the states interest above yours and just want an easy check but there are the few that are genuinely trying to do great things
    I sat in jail for 6 months on 50% time for one of the level 6s and got maxed on the other suspended to probation its a DOC sentence but as long as i keep my head down and dont do anything stupid ill fly through my probation easy
    Another thing about public defenders is you HAVE to tell them what to do. If you don't engage with them and let them fly solo they will do some things inefficiently. I was always in contact via email and had a lot of visits with my PD.

    Public Defenders are the only advocacy some people have. Instead of shaming them with a dusty suit and saying how they won't care about your case: you should be using your platform to bring more attention and hopefully have counties give them a fraction of the budget they give the police force.

    Also, most private lawyers rarely see a trial compared to a PD. A PD knows the prosecutor well and can work a deal if that’s what you want/need. Or has the experience with the judge and jury pool with dozens if not hundreds of jury trials to try an excellent case.

      But that applies to only the US and states LawyerMike has his lawyer's permit or whatever it's called, you know the permit that says you are allowed to be a public or private lawyer in that particular state:D I bet Mike isn't certified in all 50 states. Usually lawyers in the US only do cases from one to a few states. There's probably not very many lawyers that can represent you everywhere in the US, as every state has it's own laws plus the federal laws.

    Public defenders are often actually far more effective than paid attorneys. They have “less time” to devote to your case but that only matters if the paid attorney devotes more time to your case. Do they? Or are they just billing you for it?
    Public defenders are often MORE effective in some scenarios. For example: in Wisconsin at the SC level, public defenses achieved a favorable outcome in 45% of cases. Private attorneys only achieved an 18% rate.
    Public defenses also know the prosecutor and judges far better, and often have a better relationship due to sheer volume.
    There’s no question that it’s better to have a private attorney if you’re OJ Simpson. But if you’re Joe Nobody with a court case that isn’t the top of the food chain and you’re not mega rich? A public defender might objectively be a better option - financially as well as efficacy.

      The statistics don’t tell the whole story because some people who are willing to pay for a good private lawyer may be implicated in serious crimes that they know they are guilty of. They want to do whatever possible to reduce the charges and get a lower sentence than what they deserve.

    Few things not mentioned:
    1. Private lawyers specialize in certain cases. Meaning some only do stuff like insurance cases.
    2. Those high fees go by case. For example: if you're suing a company and win, they pay the lawyer bill. Some contracts have the lawyers get nothing if they lose. Thats why the pick and choose their own cases.
    3. A private lawyer will do a lot more investigating than a free one. Meaning theyre willing to get warrant for records and video fortages to neighbors, get more witnesses, read through past records, and so much more. Like he said, a free lawyer doesnt have much time and can only go with what is presented currently as evidence at the court.

      Lets say you make the best objection possible. But it is 70-30 that it should be granted. Judicial discretion is massive, and the Judge will almost certainly overrule you. And appellant courts won't care.

      I recently served on a jury in a criminal case where the defendant represented himself. After the prosecutor rested I would have had a very hard time voting guilty. After the defendant testified on his behalf, and in particular the prosecutor's cross examination, it was a virtual slam dunk guilty verdict for me. We started deliberations about 45 minutes before lunch, and thought we might reach a guilty verdict before we got our free lunch.

    I’ve had both public defenders and highly paid private attorneys. In both cases they reset (delayed) my case repeatedly and then took a plea without my permission. And before anyone starts saying “they can’t do that”, yes they can as they are your representative. As long as the plea doesn’t require you going before a judge you can’t do much about it.

    Private Lawyers are running businesses. So their priority is making money. That's where their focus and attention is.
    Public defenders do that job because they want to help people and aren't concerned with making big money doing it.
    Always go with the public defender.

      Asked a public defender once why he didn’t have a private practice, since they make so much money. He said they have so much more overhead cost to include malpractice insurance and that it was so easy to ruin their careers that in the end you made more money and had a more secure job as a public defender.

    My father isnt a public defender, he has his own office and stuff but since he is a labor lawyer and he does the job to help workers, he doesnt take much money and he sometimes volunteers and he's a great lawyer.

      Yeah it’s sad public defenders try but not all of them are great. The Justice system is one time where the private sector should stay out of it. Or it will get corrupt. Few times were I actually agree the government should control something.

    public is fine... problem is they are overworked and that is what makes it hard... becuase they might no have time to speak with you to get the info they need. and this combined with working on let's say 6 other cases makes a diffrence. yes some could say that a private is better.... but i mean education is the same for both diffrence is the time they have for your case... so really i a public lawyer is more then fine (atleast with me, might be, because i dont do stuff that is sueable :D)

    My mom was brutally attacked by a man.My mom was innocent and the public defender was trying to convince my mom to take time in jail. Some public defenders are corrupted. They don’t care about the person they claim they are trying to help. My mom fired her and spoke for herself in court. She got to go home the same night and no leave with no stain on her record.

    When I was broke as hell, I got dragged into court and when I asked for a public defender, I was denied. I had to go into debt to get a lawyer. I won, but it took me years to recover financially.
