- With his anticipated album "Donda" dropping today, a song from the album sounded much too familiar for day one fans of gospel artist Bri Babineaux. For many, we were introduced to Bri singing praises to God in a living room. From there her career in music exploded and the singer never looked back.
The singer was singing "Make Me Over" by artist Tonex. Her vocals from the viral video have now been used on "Lord I Need You" from Donda without her knowledge. The singer found out via fans of the sampling.

This is not the first time a secular artist has done this to a gospel artist. Katy Perry dark horse copied Flame a Christian artist song. He won in a law suite. That part when she sings, “Lord I need you to wrap your arms around me” has always been my favorite. You can feel the Holy Spirit.

The ad- lib Kanye used isn’t copyrighted. Which technically means that even though we all know it’s her as-lib, she can’t actually do anything about it as far as lawsuits are concerned. If it was a copyrighted part of her brand, then maybe her lawyers would have a better leg to stand on.

Her voice was sampled, yes. She was singing a song on social media, yes. Her label release the same song 'Make me Over' without permission or clearance. Kanye cleared the sample and the original song interpolation by Bri from the original artist and songwriter, Tonex. Bri is owed nothing but a courtesy call but not a check. Its not her song to begin with, no matter what run she adds to it. Kanye did the right thing and the legal thing, he just didnt do what the 'saints' wanted him to do . . .

not exactly, if the adlib was not in the original work and only the work by Bri and this work has been out for several years and Tonéx has not claimed artistic privileges' Bri can be paid because Tonéx has allowed infringement on his copyright (this is why intellectual property lawyers are so vicious from hour one of finding an infringement); so technically to use Tonéx song AND the adlib two checks would need to be cut by Kanye's label unless they have pre-standing agreements which are rare ...I am pretty sure a good lawyer can win this easily for Bri. However, here's the thing the entire Kanye song is based on Bri's adlib the make me over song by Tonéx sounds nothing like Bri's Adlib...I've listened to 6 different recordings on you tube and Tonéx has nothing.
The issue for me here, which is not clear to me, is if Kanye got around the two check problem by having Tonéx sing Bri's adlib...if he did then that would be a harder case and in fact by paying Tonéx for use of his copyright.. Bri may have to file a much complex case against Tonéx as primary plaintiff enjoining Kanye. When you listen to Kanye's song its clearly a male voice singing her adlib in an original arrangement directly sourced from Bri...it bears not resemblance to Make me over again. I think a record label lawyer smartly thought this is simple, we can get around copyright on an adlib by simply recording your own adlib if it is using common words....the problem here is that the adlib runs on Kanyes record are extensive from a time perspective (22 seconds to be exact) and practically the same down to the word and in almost the same direct context to the work Bri posted so she has a case. Also Kanye's work bears little to no resemblance to Tonéx's original work either way so if Bri ever bothered to do what she needed to do with her intellectual property (which I doubt) she has a winner. I've seen people sue for less even on work that is not their original copyright but I really believe Bri's original sin here may be she did not register or copyright her Ad Lib but its never too late if Tonéx never contacted her for 6 years.

However never forget as an artist that you always have a copyright at the creation of the original work...the issue is registering that original work. All the US supreme court has said as of 2019 is that you can't file infringement lawsuits unless you register your copyright. Before the ruling lower courts ruled for years that you can bring an infringement lawsuit once you filed the papers to register the copyright but now you have to wait for the paperwork to be processed before you can sue. The key for me is still whether Tonex ever sent Bri a cease and desist to claim her work...the sample grabbed by Kanye is not in Tonex's version of the song or any of his live performances I've seen. Bri clearly IMHO has a derivative work copyright If she did not register her copyright its her loss but she still can.

It was a heartfelt adlib that you can feel in your heart. It moved Kanye and he used it on the Donda album. That's what the greats do. He's a music producer. She'll get her credit and check. I've stated this before. I work with people close to Ye.1 thing he's about is giving credit where it's due. Because of the things he went through as a producer coming up. I've seen him give out credits to random people in the studio for nothing. They may say something; a word or sound and he may just throw it in the song. He'll have his people get there info. .I've even seen engineers get credit for adding one hi hat. Trust social media looks for the story. It is my understanding that he used her voice. Just slowed it down. Which is why many thought, initially, that it was a man Kanye hired to perform it for the album or live show. Upon further research, someone did post a screenshot of the album credits and her name was there. Her main issue tho is that she wished she could have been a part of it...and found out through his camp and not from fans via a listening party. lol

Just came across this, but Kanye don't owe her anything, by technical terms she did a remix aka the ad libs but she did not get permission from the original artist to even do a cover so once it got posted on UA-cam that song actually could have been taken down for copyright infringement by the original artist so more than likely Kanye got permission from the original artist he didn't need to ask Bri for anything. From a moral standpoint he could have asked but from a business standpoint he didn't have to say anything
