I had to look that up here in CA. kinda thought that this nanny state has a "cooling off" period of about 3 days.
from CA DMV- there is no automatic "cooling off" period in CA.
the dealer may offer and the buyer then may buy a "cancellation option." the usual charge is from $75 to 1% of the value of the vehicle.
the return must take place (dealer can agree to more) within two business days. so I guess yes, that can be almost 3 days of use total, even more over weekends and holidays.
upon a return the dealer may charge a restocking fee of between $175 and a maximum of $500 depending on the value.

Great solution to the issue. I sold my 1st gallon of paint in the late 80s & retired a few years ago. I have many stories of people wanting to return their paint even though there are signs in the shop & on the receipt saying once a color is mixed it's not returnable. I put the customers into 2 categories, the nice person & the jerk. The jerks claimed we made a mistake by making the wrong color. Easy check & 99% of the time the color was correct. Some left or bought another color, but many were still jerks. My solution was sorry, but I can't help you.
The nice person admitted their mistake & that opened up more opportunities, retinting to change the color, selling them another gallon at a discount & even swapping the gallon out for another free of charge.
Own your mistakes & good things happen.

I have been in business for over 40 years. You have two roads you can travel...1) all sales are final, or 2) take back the sold item subject to inspection and a handling charge of at least 25% for the trouble.

  • @muskokamike127
    @muskokamike127 3 місяці тому +5

Me: sorry you bought it you own it. Not my responsibility to deal with your family issues.
You could always sell it yourself for what you paid for it.
In effect, he's not returning his car, he's trying to sell you (adam) the same car you sold him. BUT it already has a broken key in the lock and as you said, who knows what else he did to it?
Me: bring it around and let me take a look at it. Then go over it with a fine toothed comb like a car dealer looking to buy a car then offer him $11K. WHAT? why so little? I'm in the business of buying and selling cars. Now I have to go through the trouble of re-selling this vehicle and the reputation of it being sold twice in a week.

I would remind him he had the opportunity to have another mechanic inspect the car prior to purchase. I would tell him the price may actually allow him to make a profit given his connections you sent to him and at work. - Now, this is why I buy my used cars from one used car dealer. He offers a bumper to bumper warranty (unlimited mileage) for 90 days on every used car he sells and an engine and power train internal engine parts warranty for the first year with a $500 deductible and unlimited mileage on both transmission and engine. I live in Minnesota.

Bought a used car from a reputable dealership. Not a small buy here pay here, etc. the car BROKE DOWN 5 minutes down the road. The dealership was “closed” afterwards, but I called the sellsman, and he said he will tow it back and get it into the service department. So HOPEFULLY they care enough about their reputation to help me. They did NOT give a loaner as of now, hopefully they do, because now I HAVE NO WAY TO GET TO WORK. Happened yesterday. So out of work today. Let’s see how this goes…

Long story, I'll try to condense. Had a 69 Camaro back in 78-79, usuall hot rod stuff dressed like a Z/28. Had a baby and had to sell. Advertised car locally, did not miss represent as a true Z/28. Guy calls comes to look at with his older brother. Now I had swapped rear from 81-82 Trans Am with disc brakes, brother saw rear discs and he didn't say anything but I think he thought it was a real original rear disc (very far option). His brother buys the car and two days later he calls up and wants me to buy car back. Tells me it's too fast for him. I told him don't step on gas too hard and fastness won't be problem. I decline and he's pissed at me. Oh well.

This sounds like a buyers remorse. He can resell the car and get his money back or even make a few dollars. I had a customer who bought a new tow truck from me for $115,000. The next day he calls me and says the insurance company made a mistake in his quote and it went up another $10,000 and now he wants to return the truck. Our dealerships policy is the same as yours, no buyers remorse clause and no returns. There was not an issue with the dealership or the vehicle itself so unfortunately, it falls on the buyer to rectify this issue.

Having been in the trade myself, vintage cars and parts are sold where is, as is. If it's a daily driver, it's been state inspected. There is no inspection on classics. Business wise it's insane to offer any type of warranty on older cars. However it is on a case by case basis, at my option. Title signed over? YOU own it! I may feel your pain, however it is NOT my pain. If I know it was solid when I sold it? It's on you, mistake, bad luck, whatever. I'll try to assist, if you're a good customer, but even experienced people can do dumb things. Bottom line, it's yours now, anything I do is optional, at my discretion.

I'll take the car back and give him the difference. And if there's any other cost that were incurred from this like transferring the title back and stuff like that that would be on top of the 1400. Or he keeps the car and you would actually help him get a buyer. Like if somebody trying to get a hold of you for the car not knowing it was sold you would direct them to him. Or if you know anybody that was looking for something like that you would direct them. You wouldn't necessarily go out your way and spend much time. It would be just something if you heard somebody was looking for it and you would post it on your accounts form and stuff and obviously he gets no money back

I'd have to look it up but I believe you had 5 days where you would be able to return it but you would lose anywhere and tear and stuff like that on the car or any damage that was done to it and I'm not sure if that was strictly on new cars if it was on new and used, but I know it was at least on new cars. Hey guys,
So what did you think of me saying to take the car back to your place and try to sell it for a certain percentage? That way you got your $14,000 and now could make another $1,400 from 10% fee. Just thinking out loud and no one would be upset and it took care of any issue as it would still be that guys car.

My solution would be to pay for the new key and any cost he has to get the broken key out, within reason. Them tell him to lose your number!!

I don’t know how you finished it. But I would tell the guy that sorry that he can’t take it back. But, could try selling it for you and take a percentage of the money you sold it for. A win/win situation.

There's a reason why we sign agreements. If I were that guy, I would not blame you for not refunding.

What car new or used car dealership will allow anyone to return a car? None of them, no matter what personal dilemma one may find themselves in, that's on him, so Adam did the right thing not accepting a return, it's not Walmart...
