All you said is correct . The claimant needs to be up to par on all stages of this game . He or she has to advocate for themselves in the sense to be ready for depos , qme’s , and doctors reviews . Claimant has to be clear and honest in all the stages .

Have an antalgic gait since knee injury let W.C. Dr know walking with bent knee is hurting hip back in 2018 now back hurts hips hurt other knee hurts .Now radiculopathy in both legs and hands epidural didn't work in lower back facet injections caused testicles pain then had injections in testicles nerves, walking with cane has caused shoulder pain now shoulder needs surgery 😢 what a nightmare, why couldn't they take me off work 2019 after failed arthroscopic.

It’s not so much that there’s a rating that justifies the voucher. What happens is that when an injured worker gets examined by their work comp doctor, the doctor gives them work restrictions. “Can’t lift more than X pounds, can’t stand longer than X minutes,” things like that. Then it’s up to the employer if they can accommodate those restrictions. If the restrictions are permanent and the employer can’t accommodate them, then the employee can be entitled to the voucher.

I’m in this stage now. Been on SSDI now for about three years. Injuries, age, occupation and length of time employed doing it was the deciding factor for the judge who only has a 45% approval rate for SSDI. Been fighting the company for five years. Collected zero workers comp from company even though all injuries have been documented over the twenty plus years I’ve been with the company. Luckily I had personal LTD insurance.
Sent me home when I told them I needed to go to the doctors back in 2017. Was terminated in 2020 “due to personal injuries”. Called to see what was up and found out they submitted retirement papers for me without my knowledge. My lawyer says we’re nearing the end.
I feel tens times worse today than I did five years ago. My last QME was a year and a half or two,years ago. QME before him died from Covid before finishing report. Who knows whose report was better?
Not even sure why I’m watch these videos because no amount of money can fix me. 59 on the outside, 89 on the inside.

Thank you for the information workers compensation Insurances." is a nasty game that we need a lawyer. the problem is money money is hart to find someone honest when the insurance try to save money and offering to other to help them. I do not who to trust in this system. Doctors talk , ask to the insurance waiting, is like your life stop for years know your stack with them. Lawyer pressure for settlement the case that's the way he will be pay. The surgeon he will do his job you knowing the risk deal with results by yourself. Everyone one is looking for their house. I am ignorant I am like sheep in this system what to do. You look a nice lawyer keep doing this videos. When is to late to look for another lawyer?

We are sorry to hear you are having such a bad experience! It is all too common. Often times, it's just the system. It's bureaucratic at best. Lots of red tape preventing people from getting the care and benefits they deserve and when they need it the most. We don't know that the system will ever change, but we advocate for reform all the time, but unfortunately, it seems the other side has more of a say than we do. That being said, we love to spread the word, and make sure people (our clients or not) are equipped with the knowledge to navigate the system as informed as they can be. You can always change lawyers. All you have to do is complete substitution of attorney and dismissal of attorney forms and have those filed with the court. This is something the new lawyer will do on your behalf. So no work on your end. Additionally, the cost does not increase when you switch attorneys, the old one and the new one just end up fighting over what share of the fee each respective lawyer should get. It's usually based on the time/amount of work done.

question, if you got accepted with ssa, will it help increase the value/ impairment of your workers comp case. and explain if ssa gave you disability, but workers comp doesn't consider you 100 percent disabled? i assume ssa is more strict on what is considered to be disabled.

I have several injuries to my shoulder iam a nurse both shoulder are injured I had 3 surgeries on my Rt shoulder ,I have torey Lt shoulder , compensating for the right they have settled and paid me for the left shoulder but I haven't permanent injury with the right shoulder and disfigurement also they're telling me I reach them maximum medical and they paid me for that but I have not got paid for the right shoulder at all what do I do

This is a very complex question. We would need to know a lot more to give a meaningful response. We would recommend contacting a lawyer to review the case to determine if there is anything that can be done.

I injured my shoulder and knee in a work accident . I had surgery's on my shoulder and knee within the last couple of years . I'm still having major issues with rang of motion and pain in both shoulder and knee. When I went for a IME recently he examined my shoulder
And neck . I told this doctor there's nothing wrong with my neck why are you examineing it .
He told me it's coming from the wcb.
Did my rights get violated , what are your thoughts.

Pain in the shoulders also comes from c6-c7 vertical spine.
Talking from experience.
You need another MRI to you spine.

Shoulder problems can lead to neck problems, and neck problems lead to shoulder problems. Any comprehensive exam of your shoulder should include your neck. I think it's great that the doctor wanted to take an interest in your neck. Why would you feel violated?
But to take a step back with a broader view, your rights as a patient includes your right to refuse any treatment or evaluation of any part of your body. If you don't feel comfortable with anything your doctor wants to do, then you have the right to say no.
