Whether it’s a $1 box of tissues, or a $3,000 MacBook Pro, the thief doesn’t have X-Ray vision, so if they get slapped with a felony, it’s their own fault. They were willing to steal a random package, regardless of what the value was. The severity of the charge definitely fits this crime, because it could’ve been an expensive item.

Right! Obviously some of them are opening packages to see if it's something valuable. Somebody opened a huge box of cotton swabs, rubber gloves, sharps containers etc.. for my office, they left it because you can't pawn 2 thousand cotton balls... I guarantee nobody has ever found a new Mac and put it back because they didn't want to risk a felony.
Some walmarts do that intentionally. Since its the same scumbags that do most of the stealing (80/20 rule in effect), they now keep track of thefts and don't go to police until the value total is a felony.

Wealthy and corporations would not sit comfortably simply knowing that people yearning for justice can't afford the legal process. Don't get me wrong, due process is a fantastic and important element of law, because it is a basic element protecting people from having their lives ruined by false accusations and "witch hunts". But it creates certain absurd situations when you discuss technicalities. For example - technically a thief caught red-handed, in the process, recorded on cameras, and with ton of pictures taken and other hard evidence is STILL innocent, until court decides otherwise. To the people saying this is entrapment, entrapment means you are being coerced into committing a crime. For example, when a cop sells or plants illegal drugs onto someone, only to arrest that someone later. What they are doing here is not entrapment. The thieves aren't coerced or influenced into doing anything, it's just a package that is the property of someone else that is placed where the thief isn't supposed to be in in the first place. It's like trying to say that a bank robber was "entrapped" into robbing the bank because the bank has a lot of money inside of it. That's not how it works. Nothing will happen to you if you don't try to STEAL something that doesn't belong to you in the first place.

It's only a federal offense if it was delivered by the USPS. UPS, FedEx, etc. are private organizations thus it's just normal petty theft (unless the value of the items are over $950, then it's grand theft).

It might apply if an expensive item was packed in a box with a cheap item labelled on it, the thief could claim they wouldn't have stolen it if they had known it was worth so much. Unlabeled packages though are a different matter, the thief is obviously willing to take the risk.
When thieves steal a package pretty sure they are hoping for a higher priced item… so gimme a break about “baiting” and “trapping” them into a felony. It’s not like they are being tricked into stealing the package. They are choosing to steal a package of unknown value. So it’s at their own risk.

Seems like there are other options too. Lockbox on the porch (secured from inside) for example where the delivery person locks it after placing packages inside…etc. but no pity for these thieves from me.

Either have a string box type box you can open or the delivery company can, or do like they do in Europe in many places. If there is no one home, they deliver to a store in the area that they have an agreement with (gas station, grocery store, etc.) and the customer goes, picks it up, and has to present ID. PROBLEM really solved. I mean would you leave a was of bills on your doorstep and then complain if it gets stolen? With so many people ordering things, it’s a grab bag, and the same enticement as if they know there is a bag of cash laying there, just not how much is in the bag.
I am always at home, so my roommates have me get their packages. But the delivery drivers do not knock, ring the bell, or anything, even though they are instructed to on the parcel. Heck, most require a signature, which they don't try to get.
Deliveries in UK are usually tracked so you get a text as they drop it off. Not helpful if youre out working though.. Amazon will let you choose a regular day of the week too.

This is absolutely not entrapment. Entrapment requires an agent who coerces the person to commit a crime they would not normally commit. Since the thieves did what they did on their own volition, there was no entrapment.

To Henry, it sounds like an increase in the penalty for the crime would be justified but, being a postal employee I can tell you, only stealing U.S. Mail is a federal crime. Up until the delivery, the mail is in the custody of the federal government. Once it arrives at the location, it is a crime to remove it from that location if you are not the recipient or a resident of the location where it's dropped off.

Many Amazon deliveries are not mail, handled or delivered by the USPS. So far as I can tell, most in my area are delivered by contract employees directly to Amazon.

My great uncle did this years ago, left his car unlocked with a black mamba in a box (he was a snake collector and breeder in South Africa). Recovered the car a few kilometers down the road with the box open and no one inside.
There is one video on UA-cam where a home owner positioned a tiny explosion underneath fake packages to scare potential crooks because he was tired of people robbing his front porch.

FungusMossGnosis it is not a bumper crime because the thieves still recognized the item as a Mac item or the valuable item and decided to take it. If it was a real product, it would have been taken and rarely be recovered. This scenario is not similar to the scenario you are describing. They mention in the video thieves are becoming picker. They are not just going to steal a box full of diapers or staplers. They are going for larger items already. That has always been their goal
Here's the deal. It doesn't matter what the value of the item is inside the box. If you don't want to be arrested for either a misdemeanor or a felony, DON'T STEAL THE BOX. The reason the departments are looking for a felony arrest is because they know it will probably be reduced to a misdemeanor in the court system anyway. That way the can at least get a misdemeanor. If it were just a misdemeanor, the thief would probably plea down to get a sentence of little more than community service as a punishment. The reason officers are doing the bait program is to DETER people from being repeat offenders or doing it in the first place. If there are no consequences, it is not a deterrent.

I had a package of my antidepressant pills stolen from my front door-step. Dude - it won't even get you high! It'll just keep me from being miserable. I say prosecute these doorstep thieves to the fullest extent.
Be careful the thief doesn't overdose and their families try to sue you for it. Have seen that happen. You might eventually get the case dismissed, but it may cost you thousands in attorney fees.

My daughter had a bottle of meds stolen at the Washington D.C. airport by TSA agents. The meds might have made them a few bucks. But as to my daughter - had we not found out in time - she could have been out on the Atlantic Ocean without meds to keep her from getting desperately sick and perhaps die. It's not "stealing mail" if from UPS, FedEx, etc. If it is from the USPS, the postal inspectors are good, but they don't have the manpower or budget to deal with this issue as a continuing problem.
Mail theft is a real horror! What if send checks through the mail to pay rent, mortgage, phone bill, or other really important things. If it's never received that could be disastrous to the homeowner. These crooks could cause big problems.

If they have permission from the home owner that had packages stolen, I support it. For me someone trespassing on private property is enough probable cause by itself.
They are starting to open packages before taking off. A friend had stuff stolen they opened the packages and took the contents and left all the packaging behind.

I put fake packages outside after receiving a real one. I quickly take my stuff out and throw the box back out. Then I wait with the screen door closed. They always show up at least once a week and always within 15 min of receiving my real package.

If US is anything like UK, where many couriers are East European crooks that don`t speak a work of English, the thieves are already in action before any potential deliveries are made. Many of my deliveries go missing that way...or arrived smashed up.
@Deborah Shaw You must be able to pick your courier, but to order with amazon, is to not pick the courier. The shipper does that. Anyway, I get my worst when BOTH UPS and USPS are involved. Here's the routine and it used to not be this way always, but this is how UPS operates here. Fact one, I live on the outskirts of a major city, within a mile of two suburbs. Let's take the current example. The package arrived yesterday at a suburb location at 9AM. Today it will be delivered to the UPS hub in another suburb, which, incidentally, is a five minute drive from my house. They will then decide they're too uppity to deliver it, so they will send it to USPS in that same suburb. That USPS will then send it to my station. A lot of delay would be avoided, if UPS would just send it to my USPS in the first place, instead of sending it to a USPS where I don't even live (all within a ten minute drive of each other). To add salt in the wounds, if UPS ever delivers to my house, it's almost always after 8pm, because I'm one of the last stops on their routes, even though I'm five minutes away. I can never order anything with quicker delivery, since the delivery is so timewise miserable. What few times I have, I always get it a day or two late, and very late in the day at that.

Federal mail theft doesn't include porches and yards, those are just normal thefts, local laws. It's rediculous that people actually believe that thieves should get protections from the government by regulating the tracking devices and lowering the overall value of the item. Thieves are thieves and should be treated as such, no matter the cost of the item.
This situation seems 100% alright, the problem is some other situations where cops might use tracking devices. A cop might use these on unlikely suspect who is innocent and find out about some embarrassing things etc. And other such situations where the tracked person is far from guaranteed to be at fault.
Don't criticize defense attorneys for trying to keep things fair even for criminals. That's their job. Believe it or not, even though it seems like they're trying to help out criminals their actions actually ensure the system stays fair for the innocent. I'd rather a criminal get a lenient sentence than an innocent person get their life ruined for something they didn't do. In this case for example, imagine I steel one of these bait packages, and I manage to sell it off to you before getting caught. Now the police arrest you for steeling something despite the fact you had no idea the package was stolen. Would you really want to also deal with the charge also being a felony on top of everything else? Don't get me wrong, I'm all for these thieves getting what's coming to them. But I'd rather make sure things don't get out of hand before it starts affecting the innocent.
I think that it’s fair because a lot of the porch pirates are frequently stealing packages (because it’s quick and easy) and therefore when they do get caught chances are they had already committed another crime equal to stealing the one expensive bait item with a GPS tracker in it.

To the people saying this is entrapment, entrapment means you are being coerced into committing a crime. For example, when a cop sells or plants illegal drugs onto someone, only to arrest that someone later. What they are doing here is not entrapment. The thieves aren't coerced or influenced into doing anything, it's just a package that is the property of someone else that is placed where the thief isn't supposed to be in in the first place. It's like trying to say that a bank robber was "entrapped" into robbing the bank because the bank has a lot of money inside of it. That's not how it works. Nothing will happen to you if you don't try to STEAL something that doesn't belong to you in the first place.

It might apply if an expensive item was packed in a box with a cheap item labelled on it, the thief could claim they wouldn't have stolen it if they had known it was worth so much.
Unlabeled packages though are a different matter, the thief is obviously willing to take the risk.

Either have a string box type box you can open or the delivery company can, or do like they do in Europe in many places. If there is no one home, they deliver to a store in the area that they have an agreement with (gas station, grocery store, etc.) and the customer goes, picks it up, and has to present ID. PROBLEM really solved.

I am always at home, so my roommates have me get their packages. But the delivery drivers do not knock, ring the bell, or anything, even though they are instructed to on the parcel. Heck, most require a signature, which they don't try to get.
Deliveries in UK are usually tracked so you get a text as they drop it off. Not helpful if youre out working though.. Amazon will let you choose a regular day of the week too.

To Henry, it sounds like an increase in the penalty for the crime would be justified but, being a postal employee I can tell you, only stealing U.S. Mail is a federal crime. Up until the delivery, the mail is in the custody of the federal government. Once it arrives at the location, it is a crime to remove it from that location if you are not the recipient or a resident of the location where it's dropped off.

This is unrelated, do you work inside the post office or deliver mail? I have a friend who had a package delivered by a P.O. box. She didn't get the package until a month later, because it "lost" in my small town post office. It there a law against that?
Many Amazon deliveries are not mail, handled or delivered by the USPS.

Here's the deal. It doesn't matter what the value of the item is inside the box. If you don't want to be arrested for either a misdemeanor or a felony, DON'T STEAL THE BOX. The reason the departments are looking for a felony arrest is because they know it will probably be reduced to a misdemeanor in the court system anyway. That way the can at least get a misdemeanor. If it were just a misdemeanor, the thief would probably plea down to get a sentence of little more than community service as a punishment. The reason officers are doing the bait program is to DETER people from being repeat offenders or doing it in the first place. If there are no consequences, it is not a deterrent.

It's not "stealing mail" if from UPS, FedEx, etc. If it is from the USPS, the postal inspectors are good, but they don't have the manpower or budget to deal with this issue as a continuing problem.
Mail theft is a real horror! What if send checks through the mail to pay rent, mortgage, phone bill, or other really important things. If it's never received that could be disastrous to the homeowner. These crooks could cause big problems.
This is not USPS mail. It is private service.

I put fake packages outside after receiving a real one. I quickly take my stuff out and throw the box back out. Then I wait with the screen door closed. They always show up at least once a week and always within 15 min of receiving my real package.

If US is anything like UK, where many couriers are East European crooks that don`t speak a work of English, the thieves are already in action before any potential deliveries are made. Many of my deliveries go missing that way...or arrived smashed up.
@Deborah Shaw You must be able to pick your courier, but to order with amazon, is to not pick the courier. The shipper does that. Anyway, I get my worst when BOTH UPS and USPS are involved. Here's the routine and it used to not be this way always, but this is how UPS operates here.
Fact one, I live on the outskirts of a major city, within a mile of two suburbs. Let's take the current example. The package arrived yesterday at a suburb location at 9AM. Today it will be delivered to the UPS hub in another suburb, which, incidentally, is a five minute drive from my house. They will then decide they're too uppity to deliver it, so they will send it to USPS in that same suburb. That USPS will then send it to my station. A lot of delay would be avoided, if UPS would just send it to my USPS in the first place, instead of sending it to a USPS where I don't even live (all within a ten minute drive of each other). To add salt in the wounds, if UPS ever delivers to my house, it's almost always after 8pm, because I'm one of the last stops on their routes, even though I'm five minutes away. I can never order anything with quicker delivery, since the delivery is so timewise miserable. What few times I have, I always get it a day or two late, and very late in the day at that.

Federal mail theft doesn't include porches and yards, those are just normal thefts, local laws. And like the other person said, they aren't sent through the postal service so aren't covered under such rules.

This situation seems 100% alright, the problem is some other situations where cops might use tracking devices. A cop might use these on unlikely suspect who is innocent and find out about some embarrassing things etc. And other such situations where the tracked person is far from guaranteed to be at fault.
I think citizens should be more concerned with lawyers apparently trying to stop the police from preventing crime against ordinary citizens.

Don't criticize defense attorneys for trying to keep things fair even for criminals. That's their job. Believe it or not, even though it seems like they're trying to help out criminals their actions actually ensure the system stays fair for the innocent. I'd rather a criminal get a lenient sentence than an innocent person get their life ruined for something they didn't do.
In this case for example, imagine I steel one of these bait packages, and I manage to sell it off to you before getting caught. Now the police arrest you for steeling something despite the fact you had no idea the package was stolen. Would you really want to also deal with the charge also being a felony on top of everything else? Don't get me wrong, I'm all for these thieves getting what's coming to them. But I'd rather make sure things don't get out of hand before it starts affecting the innocent.

I think that it’s fair because a lot of the porch pirates are frequently stealing packages (because it’s quick and easy) and therefore when they do get caught chances are they had already committed another crime equal to stealing the one expensive bait item with a GPS tracker in it.
