- The Transportation Department fined Southwest Airlines $140 million for what it said were multiple violations of the law during its meltdown around last Christmas and New Year, while also ordering the airline to establish a $90 million fund to compensate passengers affected by future delays.

@@anondabombthey both broke the law. Sometimes punishments get more harsh over time- if you can’t do the time don’t do the crime.
@@anondabombpunishments are meant to dissuade bad behaviour. If you knew the act was bad and did it anyway expecting the same fate then it serves them to be punished harder. They probably had factored the cost of the fine in their budget in the event of an issue. Now in the future it becomes less of an incentive for others to even consider a similar strategy.
Good, about time fines were a deterrent instead of an inconvenience. Fines need to be bigger than a small annoyance to an accountant. The fines need to significantly outweigh the costs of system upgrades and maintenance. It needs to be seen as an actual business penalty.
im NOT a brokerage manager but my mouth seething to use the 90 million dollar fund as an "invested insurance fund" so that
1) if the fund is NOT used to pay out claims then it can be used to grow
1a) and should those funds grow they could be REABSORBED towards revenue.
and if the fund goes under 90mil, then... well... as long as uncle sam doesnt mind a mild dip under 90 mil, and allow the "market" to recoup the loss within a fiscal year.
get a financial planner to cook the books so that every year, theres a net loss but techniically the growths are merely redirected back into the CEOs pockets.
essentially 85 mil is the december balance and 95 mil is the november and january balance and the surplus goes to the ceo, and the net loss gets reported to the DOT overseers.
just think, if 90 mill is mandatory to be held, 1% of that balance in stock growth is VEERRRRRY NICE to skim off the top.

They should include the option to cancel bonuses for upper management; imagine how fast things get turned around then.
i love the idea of that, but the problem is lawyers and financial experts, right? they will find a way to skirt any law limiting management pay.
and if they spend 40 million dollars trying to do it, they will happily pass the expense on to the consumer. the problem, as i see it, isn't that compensation is out of control for upper management, it's that modern capitalism limits how effective laws can be, without a fundamental change to the structure of corporate law. on a national or even international level, corporate incentives under capitalism need to be realigned.
i mean, it'll never happen, but i just can't see any other way to incentivize large companies to work towards the public good. (i mean, not force them to, but make it in their own interest to)

southwest is actually the only major US airline to never enter bankruptcy - yes the US tax payers have bailed out others, but not southwest

@@Nosikasbankruptcy has nothing to do with getting bailed or not. Bankruptcy is a legal process where a business is either liquidated or has a respite from collection of debts for a restructuring. Tax money, other than for the courts, is not involved in bankruptcy at all.

The amount of the fine should reflect the country's economic impact from Southwest's decisions. It is a great idea to make fines bite into the ENORMOUS levels of profits that corporations experience. I assume this fine should be more.

Right!? I agree someone should, but not long after that Southwest debacle the FAA had a critical safety system go down that grounded EVERY SINGLE FLIGHT to, from, and inside the US for the better part of a day. That system had absolutely no redundancies or failovers. If it's a critical system, it should be redundant.

Currently in use GDS systems date back to the mid 1970s, it's significantly older than 30 years.

They (as well as Delta) also don't use the wheel and spoke system so their computer system takes a lot more work to be optimized
I have an old dot matrix okidata printer, running on windows 11. I still use it. Blows peoples minds when I swap out for a color ribbon and print out some full color pictures. These things are reliable as frig. No idea how may crappy inkjets and lazer printers I have thrown away over the years but my old Oki is till ticking. Bzzzrrzuurrrzz

I remember in the December of 2022 when that happened, both of my sisters were devastated after their southwest airlines plane got canceled.
Hopefully the money can also go to trains and ships to revitalize them.

As a southwest employee I can attest our computers and tech are behind, with the exception of our pushbacks those are brand new.

I think that fines should always be means tested something like a delay compensation payout to each traveler and then something like a 200% if the one way fair market price
Also have delay and cancellation fines and compensation stack. So if it takes 6.25 hours after original flight time to cancel then that's the 6 hour delay compensation on top of the cancellation one

I remember! I was in Dallas. All the flights were delayed by hours! One flight attendant told us the computers were down, so the pilots were having to do all the calculations by hand! They got sent back to the 1940s!
One time a southwest system crashed mid-use when I left for Florida, after it rebooted, I found out it used windows 2000…

Make fines for companies a % of annual profit, stacking with each offense, companies will start following the rules miraculously.

Fines need to be extreme or else it just becomes a tax and not a fine. IF its so low it just becomes an "Expense" for the company, its not effective. It needs to be a "BURDEN"

Do trains suffer less delays due to snow and freezing rain than planes do?
Not as much but if you need to get from NY to LA the flight could be delayed by 5 days and still be quicker than a train i think at the height of US passagner trains the trip was 5 days by rail and 12 by air
Closures for weather or unsafe condistions are one thing. That doesn't seem to be what happened here with Southwest.
