There are too many cases o the later and many cases of just deciding to allow a pregnancy to occur if it happens. While the daughter is a minor in my opinion her judgement still needs to be looked at as to how she was approaching sex beyond perhaps the 1st experience.

That was all before someone under age 18 could legally buy condoms (and if you were an adult you purchased them directly from the pharmacist as they were a behind the counter item in the pharmacy). Contraceptive gels and IUDs did not exist. I'm not sure if it was legal for a Dr to prescribe birth control pills to someone under 18. I never heard of any girls below age 18 that were on birth control pills. My long dead mother told me that she was sexually active starting about age 15-16 in the mid 1940's and well aware of then available birth control methods (illegally available condoms that were not nearly as effective as modern ones and "the Rhythm method"). So please don't try to tell me that a 15 year old today with incredibly more and better information at their fingertips with far more readily available and better /more options of birth control methods can not understand these issues. In my day we had to obtain very expensive condoms illegally (there were adults who sold them at at least 100% markup and 200% markup was more common) or depending on the Rhythm method. As far as I am aware most teenagers working to avoid pregnancy in my day used both methods and just used the condoms for about a 9 day period when pregnancy was likely as long as there were steady periods. Of course, there were both boys and girls who decided just to risk it on many occasions - and not just the 1st time when they started. There were also those who believed that they would just accept what happened (or even a few that they had faith in god to determine the best outcome) and made no attempt to use birth control together. I am sure nothing has really changed about the questions or options on what to do (just that there are a lot more of redily available forms of birth control and a number of them do not require you to "pause" activity to use. Not to mention in my day blow jobs did not exist and are now a common birth control method. None of my questions are new - and based on my mothers discussion of her teenage sexual activity and my personal experience that teenagers since at least the mid 1940's were well aware of these questions and made choices on how to proceed. I am not aware of any State in the USA that allows someone under the age of 16 to consent to sex with an obviously older partner, even if the parents agree with it (age of consent with older adults range from 16-18 in the USA depending on the State). Consensual sex under the State Age of Consent with age appropriate partners (same or similar age) is permitted in some States, and just not prosecuted in others. So a 13 year old can usually have consensual sex often with with a 12-14 year old legally in many States. A few States allow a 2 year difference where the Age of Consent is above age 16 (example a 17 year old and 19 year old). Since she was 15 he and he was well into his 20's - there is clearly a violation of the Age of Consent Laws in any State of the USA. That is why he is in jail.
I also looked up marriage age: While there might be a few States where a 28 aged person could marry a 15 year old - you would really have to look for it. The general age for marriage in the USA is 18. Some States allow a younger age with parental permission or a court agreement. However, only 6 State would allow a 15 year old to marry as most States have minimum marriage ages for the exception. In addition many States have laws related to the maximum age of the marriage partner for a minor. This typically is in the low 20's and a 28 year old could not marry a minor in what appears to be a large number of States. So while there may be a few States where a 15 year old could possibly marry a 28 year old. Those are the exceptions and not the norm. Given that there is a clear and substantial age difference violation of the Age of Consent laws... with either of the Parent objecting (and the mother clearly does in this case) I don't see any chance of a Court agreeing to a marriage.
