- In a tweet, President Trump called on Vice President Pence to have "extreme courage" in certifying election results. In an official statement, the Trump campaign said Pence has the authority to decertify the election results or send results back to states for change and certification.

@@Robert-fs6ge The VP could not legally send electoral votes back to the state legislators. Period full stop. If there was any "altered" election laws that were found to be unconstitutional, then the 60 lawsuits from the Trump campaign would have overturned the results of those cities, counties or state. Those lawsuits were dismissed on merit and the electors were representing the will of the people. Imagine if in any election that a party can just "claim" the other side cheated so we are just going to overturn it.
We live in a Democracy (at least at the moment). You either stand for it, or you don't. It's that simple. If you don't, then you believe that one person has the ability to throw out millions of votes. We are a nation of laws. There is not law that states that is even close to a possibility. Let's move forward as a country instead of rehashing an election that has been decided.

The Vo doesn’t get to pick and choose which states EC votes matter and which ones don’t. What this segment from Fox doesn’t say, is Pence was bound by the 12th amendment. Which wasn’t ratified until 1804. After the election of 1800 and while Jefferson was president. Pence was also a candidate in the election. He cannot and should not have the power to push an election in his own favor.Republicans did try to get pence to accept illegal false electors. Any last. In challenge to a states EC votes must come from Congress not the VP. 6 states were challenges on Jan 6th. Only 2 getting the required senator and house member to be formally challenged by vote. Those 2 were PA and AZ. Both votes in both chambers for both states failed miserably. The VP cannot unilaterally throw out certified EC votes. It’s not his job.
Every American party should want this to be a fair election, no matter the outcome. Because it affects ALL OUR RIGHTS !

If the VP had this power then every re-election year no president would lose. Pence is actually on the ballot. To think he would actually be able to control the outcome of an election he’s actually in absurd. The electors law of 1887 and the 12th amendment clearly state what the VPs role is. Pence cannot certify or decertify anything. It’s not his job.

@@danielplayz4421 although dealing electors are a thing. You make many assumptions. To them and their process. so many things have to go right for dualing electors to be a thing. First the electors of any state have to be split between the governor and the state senate. Then it goes to both houses of congress in DC to decide what to do with them. If congress still can’t decide then that’s where it becomes murky. You are in unprecedented territory there. The Supreme Court would have to get involved. But nothing clearly states that the VP can throw out electors for and election he is actually in. Lots and lots of processes have to play out and then comes the court cases.
I cannot find any swing state that split their electors between governor and legislature. In dec Safe harbor came and went without issue then the electoral college across the nation voted and certified by dec 14th. No state senate or governor allocated differently.
If that had been the case I would suspect that gore would have thrown out Florida in 2000. When the election hung on the balance of one state and a few hundred votes.
Don’t bring up shadow electors. They aren’t legal.
In summation.
Dual electors weren’t an in issue in this election. And if they were the VP still doesn’t have the power to just Throw them out.
