  • In this video we will discuss the Prospective Marriage Visa (Subclass 300).
    This visa is perfect for:
    • Applicants who are outside Australia
    • Applicants who intend to Marry an Australian citizen or permanent resident
    • Applicants who cannot meet the de facto or spousal requirement. (If you can meet the de facto or spousal requirement, you would just apply for a standard partner visa)

    Once granted the prospective marriage visa, you would have 9 months to enter Australia and marry. Once you are married you can move over onto the standard partner visa (Subclass 820/801).
    CORRECTION: Unfortunately, a prospective marriage visa holder isn’t eligible for Medicare unless they are married to an Australian citizen, Australia PR or an eligible New Zealand citizen AND you have applied for the partner visa.
    Please note, you would need to be outside of Australia when you apply for this visa and when the decision is made on the application.
    COMMON DOCUMENTATION PROVIDED:
    In order to apply for this visa you will not need to meet the de facto requirement, but you will need to show that you are in a loving and genuine relationship and intend to marry in the future. Common documentation provided includes:
    • Past Travel Tickets
    • Hotel Bookings
    • Photos
    • Correspondence
    • Statutory Declarations from friends and family
    • Notice of intention to marry
    • Any other relevant documents - joint bank account, transfer of funds to each other, evidence of joint residence etc…
    PROCESSING TIME:
    The standard processing time for a prospective marriage visa is approximately 16 - 18 months, however, we have had some applications processed in as little as 6 months, others have taken close to 2 years. If you would like to obtain a visa as quickly as possible, I would recommend providing a decision ready application.
    VISA FEES (SUBCLASS 300 FEES):
    • $AU7,715 if applied from inside Australia

    PATHWAY TO PERMANENT RESIDENCY:
    Once the prospective marriage visa is granted, you would have 9 months to:
    1. Enter Australia
    2. Marry
    3. Apply for the partner visa
    When you apply for a partner visa after holding a prospective marriage visa, it is a lot cheaper ($1,285) compared to the standard onshore partner visa (Subclass 820/801).

    I met my loved one when I was living in Australia. After we met I had to move sponsorship visa . Suddenly my visa was cancelled and had to move back to Europe . Now we are in contact again and hopefully we will hecablecto see each other again soon.to make a decision bcz we desire to have a child together. I am 45 soon..😊thank you firvthe hope

    can you do a visitor visa while applying the prospect marriage visa? to allow faster entry. Im seeing a lot of people saying they're waiting 18 months. I don't want to get trapped

      Yes you can. But you would need to be offshore when you apply for the visa and when it is granted.

    So my fiancé is Australian and I’m german. We are considering to apply for the prospective marriage visa. The problem is, that he would need to sponsor me right? But currently he’s still in Germany with me. How is he supposed to sponsor me when he has no job in Australia yet because he’s not even there atm?

      He can bring you to Australia on a tourist visa, then submit it there. Sponsorship for the tourist visa only requires $5000 in the bank for a three month visa. Once you apply in Australia you will switch to a bridging visa while you wait. If you apply outside of Australia, then you'll need to wait and won't be able to come in unless you have another tourist/ visitor visa.

    How do we know when a decision is made? ex: I am traveling back and forth with TV while waiting for PMV. I usually stay in Aus for 3 months. What if a decision is made when I was inside?

      It won't be. You would receive an email stating immigration is ready to make a decision and that you must be outside Aus when a decision is made

    I'm Australian and my partner is American. So far our relationship has been online only due to Covid restricting oversees travel. We already want to go ahead with the prospective marriage visa as soon as I visit her in late November this year. I know a visitor visa is ok to use while the 300 is processing, but what about a Working Holiday visa? Can my partner get one of those to use while waiting for the 300 to process, or is only a visitor visa allowed cause you can't work on one?

    Hello,
    My prospective marriage visa got granted in March but my partner hasn’t had an opportunity to come to Australia since the grant date. We have tried to purchase plane tickets twice but they got cancelled. The entry date is about to end, do you have any information for this ? Thanks

      Immigration may grant exemptions in this case. It would make sense. I would recommend contacting immigration regarding this

    G'day! I'm spanish and my boyfriends is Aussi, he has to move back to Australia and we want to start a family there. We live together but are not married. He has to leave in 2 months, would it be advisable for me to go there on a tourist visa (subclass 651 is the one that was granted to me when I visited last summer) and getting married there? I mean, instead of getting married here in a rush in Spain and applying to an offshore partner visa. Thanks mate!

    Hi Sir, I am from India. My boyfriend and I were about to get married in Oct (registered marriage) in Jan 21 as per religion but due to Covid, we aren't able to do it on time. But we are planning to do registered marriage asap and for that one has to travel which is restricted by Aus Govt. We can also apply straight away for partner visa but we need to meet. It's been 6months being away.. can you pls suggest which Visa I should apply prospective or partner to be able stay with him as husband n wife? Please guide us!

    I understand that the $7.7k has to be paid when submitting the form. My question: if form is rejected, Is there any refund?

      You will not receive a refund from immi if your visa is refused.

      dont confuse the process.There is nothing as a change of visa. You either apply for one visa or dont at all. Just apply for one and wait .

      Also you are not supposed to be engaged when applying for this visa.Engagement definitely is a red flag to apply.

      I called immigration and in 5 minutes they told me they are still processing Prospective Marriage Visas and that upon approval we will still need to seek an exemption to travel. You'd think in organisation such as yours that spends the time to make a full length video during COVID would have the answer to something so basic. Not very professional.

      @@Greg-n no one has ever dealt with COVID 19 and it has placed a lot of strain on not only administrative operations but on our daily lives.I understand your frustration an anger but it is important to note that COVID is real and it is killing.Australia is doing its best to keep its population healthy and that is why these travel exemptions come into place as a tool to control travel.Good luck

    The immigration website shows this application 90% processing time 32 months
    Now I’m waiting 31 months
    Can I expect my visa grant in June

      You don't get a bridging visa for this visa, as you need to apply from offshore.

      Well, there's no such thing but what he meant was that you've provided all the documents in advance so they could hypothetically make a decision right away without needing to contact you again for additional documents
      therefore , your visa is "ready" for a "decision" , a 'Decision Ready' Visa :)

    My Mrs is here in Australia, We have been dating since Feb 2019 and in a serious relationship since September last year and she has been living with me since February this year (6 months) Her visitor visa runs out on November 17th. We are currently engaged and are looking at visa options to apply for before she has to leave Australia.
    My question is, would it be possible to register our relationship in South Australia to waive the 12 month Defecto rule and go straight for a partner visa or would it be better/easier or even possible because shes already here to apply for a subclass 300 and apply for a partner visa at a later date? What would you recommend? Any info would be much appreciated. Thanks

      Hi, I am not sure that immigration accept relationships registered in SA. I would recommend organising a consultation with a migration agent to go through your options

      If I were you I would be patient and apply for the prospective marriage visa. Dont rush anything and I understand time is of the essence but doing the right thing provides the best outcomes. Dont try to beat the law when it is clear regarding the requirements and conditions.Good luck

    I was applied prospective m visa 300 14 months before they ask question two times January 2020 and March 2020 and I answered two times well but still untill March 2020 I have not any answer
    I know sublcass 309 already answer why prospective still stop any information bro
