Sheeran: 'It's devastating to be accused of stealing someone else's song'

- After a New York jury found that singer Ed Sheeran did not copy Marvin Gaye’s “Let’s Get It On,” Sheeran spoke out saying that he is devastated to be accused of stealing someone else’s song. He added, “I’m just a guy with a guitar who loves writing music for people to enjoy. I am not and will never allow myself to be a piggy bank for anyone to shake.”

@@StevesSlideandJazz So did I. I actually listened to them both (neither one of them is what I could call a great song) and posted my analysis. Some people seem to be agreeing with him simply because they like him. He was found not guilty of stealing, but that doesn't change the fact that he used the exact same chord progression and timing throughout most of the song. Music theory allows us to scientifically measure music. Sheeran repeats the same two-bar chord progression and timing throughout 70 percent of his song as Marvin Gaye did throughout 80 percent of his song. This is demonstrable. 64 of 90 bars use the exact same progression and timing of the chords as 80 of 100 bars of the Marvin Gaye song.

The "Marvin Gaye Estate" already won a $5m judgement from Robin Thicke for the same reason. This won't be the last time we hear from them.

@@hoos3014 To be fair, it wasn't the Marvin Gaye Estate this time, but the song co-writer's estate (Ed Townsend).
I'm a musician all my life, worked in music broadcasting too. There have been and still are standards set forth as too how many notes in a row, within 8 to 12 bars of music, one song can mimic or copy another. It makes no sense to me that this went to court.
Have you listened to how identical the verses are? It's the same chord progression.. the same key.. the same tempo.. the same phrasing.. isn't that enough to constitute a cheap and easy rip off?
@@pdubzpyro It should have been throw out after a pre-trial evidentiary hearing I think was his point. People (with standing) have the right to sue and go before a judge, but these types of cases should never make it past the pre-trial phase. I can't imagine the cost of 8 years of legal fees.
@@poison7512 as far as I have learned, chord progression, key, tempo & phasing are not copyrightable. Melody and lyrics are copyrightable. Fairly certain these laws have not recently changed.
@@poison7512 The songs are not in the same key. And the similarity is only in the base line. So stop judging if you do not know of what you are speaking about.
@@poison7512 in addition to what others have said, Sheeran’s song also has an additional chorus that’s completely different from anything in Gaye’s song. Not a fan of Sheeran personally, but this case was on par with a painter being sued for painting the same landscape as someone else, and I’m glad he won.

As a musician, writer, entertainer and recording artist from the 70s I’m pretty familiar with the extremely popular music of Marvin Gaye. I had no idea who Ed Sheeran was/is so I listened to his song and could not connect it to anything I knew of Mr Gaye, nor of anything by anyone from that era. This was a frivolous lawsuit obviously brought by desperate gold diggers. In my opinion the plaintiffs should be required to pay all his costs and financial losses from this suit.

There is definitely parts of the song that are very very similar to Lets Get it On. It doesn't mean he copied it, but I'm sure he was heavily influenced by Lets Get it On. And why not? Both songs are great.
But if you don't think they are similar, there are a few youTube people who break the songs down and do really good comparisons. Rick Beato is probably the best. You should look at his comparison. There are parts of the song that are very very similar. But it doesn't mean that Sheeran stole it.

While I definitely hear similarities between the 2 songs, I’m glad Sheeran won this case. I mean, you can only make so many songs before it might sound similar to another. There’s only so much that can be done to make things sound 100% original.

It has nothing to do with how many notes there are in music theory; it has to do with chord progressions and the timing of those chords. It was the exact same two-bar chord progression and timing of the chords that was used throughout 80% of Marvin Gaye's song, which was also used throughout more than 70% of Sheeran's song. If you actually listen to the songs, it's obvious.
So happy Ed Sheeran won his case. Thinking Out Loud sounds nothing like Let's Get It On!! I am shocked that cousin Ben took on this buffoonery case! Every song holds a note from another song. Just like Earth, Wind & Fire says in their song; Sounds (music)) they never dissipate. They only recreate to another place in time!! Bravo Ed!!

Watched an analysis of this in which they had to adjust the tempo/time signature, change the key and alter the order of some chords/notes to produce a 'match'. Vague similarities do not count. Compare this with the Beach Boys' Surfin' USA and Chuck Berry's Sweet Little Sixteen or the intro to Fun, Fun, Fun, and Berry's Johnny B. Goode. You don't have to change a thing musically, just the words ... that's plagiarism
I mean come on, it sounds very similar right. I don't think he did anything wrong though, there's only so many notes. He's right no one owns the color blue. Art has always used ideas from other artistst it shows who inspired you. People just want to sue for money.

I’m glad Ed won his case. The guys suing him were obviously full of BS and just wanted to get free money out of him. This case should have been dismissed from the beginning.
I'm a big Marvin Gaye fan & i leave the room when a Sheeran track is being played, but this was the correct decision. Anyway it's not like Marvin cares. For me Marvin's best album is the hilariously titled "Here My Dear". A judge ruled that he should hand over all royalties for his next album to his ex wife in a divorce settlement. Hence the title.
Marvin died in 1984. His dad shot him. So he's not around to care.
I think part of the conclusion should’ve been them having to publicly apologize on National television 😂

I'm a NYC teacher and I often do my work in coffee shops around the Brooklyn area where this song is played - I immediately thought of Marvin Gaye when I heard Ed Sheeran's song. I remember it like yesterday because I said it to myself, "He copied Marvin Gaye."

No because they have to be cleared first. By the time you hear the song the samples should already be cleared. This case was different because they accused Ed of copying not sampling without permission.
