- The plaintiff was hired to groom the defendant's two dogs. However, when the plaintiff went to cash in the defendant's check, he found out the account no longer exists, so the plaintiff is suing. The defendant argues the plaintiff clipped her dog's ear, so she feels she doesn't owe him anything.

She also lied about them coming back out to put drops in the dogs' ears. The plaintiff said they don't do that because they're not vets.
He's absolutely correct. Black in the ears could be a fungal infection, a bacterial infection, or ear mites. How would a groomer know? And why open themselves up to that kind of liability of practicing medicine without a license? Especially for a customer who tries to scam them with a fake check? A vet is needed to diagnose that so it can be properly treated.

I'll tell you exactly what I'd do in his situation, she knew she was issuing worthless checks. Here in Louisiana it's a felony in most cases, I'd have given the check to the district attorneys office, especially on a closed account. A tenant did this to me once and then got an attitude about it, I gave the check to the DA and they went to her job and arrested her, they wouldn't drop charges until she repaid or set up a payment plan and the check was doubled.
Some dogs get the black gunk.
That said a week later you can't blame the groomer.

This case is a complete mess! The defendants are all over the place. A returned check and a closed account; the husband lied or tried to sound convincing as soon as he stood up. A week later, the son (who isn't present to testify under oath) notices a cut on the dog. The defendants can't even prove that the plaintiff had anything to do with the cut. Moreover, if they sent the first $50.00 through the Cash App, wouldn't they have a record to continue sending the remaining balance to the same recipient? How could they send more money to the wrong recipient if they had the correct address the first time? They're just a chaotic mess, and their outfits look like an optical illusion gone horribly wrong!
