Its an absolute disgrace that the law allows tenants to abuse a landlords property like this. They should be named and shamed and their pictures put on social media to warn other landlords to steer clear.

You should have contacted the RSPCA when you first found the dog crap in the property. There should be a national data base for landlords on teneants from hell.
Not good and incredible how some people live. Great video and real insight into what can happen in BTL. The saving grace for you Dan, is that you will sort it and no doubt the place will look back to its spick and span look when you have finished it. The learning curve for me on this is, what if you are NOT a full-time property investor and you have to deal with this sort of problem outside of your area and your property is miles away! Now that would be a total nightmare and really stressful.
Hey Steve, Good to hear from you, you are not wrong, it was stressful enough with it being close by let alone at a distance. I think the big learning here for me was to be far more involved in tenant referencing and not to trust a letting or referencing agent to be as thorough as they should be.

@@new2property surely it’s criminal damage when it’s willful? No reasonable family lives like this and over 9 months it has to be considered neglect of the property. Failing to prevent damage or inflict damage, even if by omission of action is no excuse. My blood boils when I see this. It’s unacceptable.

We've seen one or two in our time in East Lancashire so we try & keep a handle on it the best way we can by visiting our tenants very regularly. Not easy though as previous commenters have said if the landlord doesn't live in the area. Btw saw your video on Facebook Property Investor boards so we thought we'd say Hi!

Hi Dan, once again very interesting video. I have one question. In this episode, you said that the tenants were not supposed to have dogs in the property. Was that in the tenancy agreement? If so, wouldn’t that of speeded up the eviction because they were in breach of their tenancy agreement?

So the tenants left before the possession date, so you did not have to request a Warrant of Possession (N325) which would have used bailiffs to evict them. You are lucky as I hear the waiting time for bailiffs is several months as bailiffs can only probably evict 1 or 2 properties a day as the physical process of evicting tenants can be very time consuming and slow.

Hi Stuart, I`m really sorry to hear that you are in the same boat. If the tenants remain in the property post notice you will then need to apply to the court unfortunately, there is a whole heap of information and paperwork that you`ll need to get in order before submitting your application, it sounds like its time to find a professional to work with, the court will through the case out for the smallest of things so best to get it right. One thing I dont understand is, if the judge evicts the tenants, do you automatically get a money order against them? Hey @@stuartworby2910 The judge will issue a possession and money order, however, this doesn't actually action anything other than a letter to the tenants. You will then have to wait 14 days or for the date that they have been told to evict by, if they then don`t go you`ll need to instruct the bailiff`s to have them removed, this comes at an additional cost and isn't cheap. Once they are out you will then need to apply for an attachment of earnings, I`m currently working through this now. Before you start the process let me know as I have some advice to help you speed things up. I a recording my journey of trying to get the money back but it`s a long and slow process so I`m not sure when I`ll be done. I have considered commercial and will possibly go down this route in the future at some stage. Thanks for watching

Hey @@stuartworby2910 I meant that the attachment of earnings process is a real pain, they have come back to me 3 times now asking for the form to be edited and everytime I get put to the back of the queue meanings they take 10 days to reply. I meant that I can tell you where I have gone wrong with completing the form when you get to it which will hopefully save you the wait time of them coming back to you.
What landlords need is a register of all bad tenants who fail to pay their rent, abuse the property and disappear. This register will include all their ailiases and fictional referees.
Is it possible to have tenants sign a lease agreement that removes some of the ridiculous rights they have if they don't pay? Is this legal to do? Any tenant that intends on playing fair should have nothing to fear by signing it should they??

Chris my Tenant have not let me in my property since last 14 months for inspection and she keeps damaging property and reporting to Council and they issued.me Notice to repair property, despite me telling them,she is damaging it on deliberately to put barrier in my way for serving her Notice.Council don't care, what I m telling them,regarding damages.Council tells me to fix it without doing inspection of these damages.I think this is disgrace. Hopefully you have pictures at time of check in. Despute the notice with Council and provide photos to evidence condition the property was given in, stating tenant has caused malicious damage. Start eviction proceedings s21 (while still available). Get letters from contractors saying they were unable to get access which can also be sent to Council
