general rule of thumb is you need to be placed in reasonable immediate fear of your life and generally you need to use proportional force for the sake of preserving your life this is the limit of what you entitled to. even though this may not be a requirement its certainly something that is taken into account as well as your ability to retreat these are all mitigating factors regardless of where you are. you also intentionally cant put yourself in avoidable danger to provoke self defense this is a common misconception if you do this you will absolutely be charged with a crime and thats what this is he involved himself in an avoidable conflict and participate in the belligerence he displayed intent before the need of self defense arose its a really bad look this did look premeditated but the real issue here is the aggravated and negligent nature of it. even if you could justify the first shot (good luck btw) those follow up shots greatly enhance the criminal culpability and really really damages your criminal defense. also people are entitled to speech it wouldnt be reasonable to assume a person is litterally going to kill you if they said something to this effect alone also this enters a he said she said... not a good idea you need more then that also operating a firearm under the influence is a crime
I moved to Texas a year ago and we have a stand your ground law here and although we own weapons, I don’t think I could ever do something so foolish! The reasons we own them are for hunting and hopefully never a home invasion!! this would not be one of those times where you could use it!
Alcohol establishments, Texas has a 51% rule. If a business makes 51% or more of their income from alcohol sales, they can post a 51% sign at their entrance prohibiting carrying a firearm in the establishment.
If someone punches you unprovoked and you get shot it’s 100% justified in many states. Tones of case law. Sure California and NY the DA’s will attempt to prosecute but how no one is talking about it’s a state by state thing.
