@Ashoori Law. Fantastic video mate. I'm in the field myself and was looking for a video to use to explain the process to our office interns. Nice work.
If one acquires a pre existing business with say 30 employees, does that mean that I need to take headcount up to 40 after 2yrs? Or could one shut down 'department A' in a restructuring and move 10 staff across to a newly created 'department B'
Hi Leke, typically the 10 jobs must be "new jobs" meaning that you must add 10 additional jobs to the total jobs in existence at the time you purchase the business. However, if the business is considered a "troubled business" which basically means that its been losing money for a period of time, you may be able count the jobs that you are saving toward your requirement to create 10 jobs.
Hey Ashoori, My husband and I are in the US for relocation since June 2018 (I'm L1B, he's L2B). I am currently in the process of applying for a greencard, however, was told that this will be a long process that will take at least 1.5 years. I have real estate in Israel worth approximately 800,000$. Do you think by using these funds and investing them in a US business, I will be able to receive a conditional greencard faster than through my L1B? Thanks in advance, Omer
1.5 years is nothing for the greencard application process. EB5 will itself take that long or probably much longer than that. Please let me know where are you in your process of green card. Thanks best wishes
Hello. Thank you for posting this video. I have a question. Can you slowly grow a business in the US (while living outside the country) until it reaches the investment amount and then move and apply?
Hi everyone. Do I qualify for any USA visa if I’m a health care assistant worker in the UK? If I do which visa would it be under? It’s really confusing. I’m not 100% sure but I think HCA in the USA are called nurses aid.
One question based on the wording in this video, After the two years of conditional permanent residence have expired, and you've been granted an unconditional permanent residence visa, are you eligible to withdraw/cash out your initial investment? For example, say you purchased a business that employed 10 full time workers for the two years, then gained your unconditional visa, could you then sell the business to try to recoup your initial capital investment?
Yes, once you receive your unconditional green card, you may withdraw your investment funds. I'd be happy to discuss with you in greater detail. Please feel free to call me at 818.741.1117 or you can schedule a free consultation here: www.ashoorilaw.com/schedule/
This is a great video. I’m a DJ, label owner and entrepreneur and my wife works for an international (NZ) company. We are Canadians and would love to move to the United States. Would you recommend taking a different approach than a EB-5 visa given our particular circumstances or should we sell everything we own in Canada and try to open a business in the states? Thank you for all the info 🙏🏼🙏🏼

After the investment of 800K, if I am outside America, how long will it take for the American Consulate in my country to grant me the basic VISA that will enable me to migrate to America in order to continue the EB-5 process?

Great to hear from you M.kundu! The amount you have to invest to qualify for an EB5 visa will depend on whether the restaurant is located in a targeted employment area (TEA) or not. If the restaurant is located in a targeted employment area, the investment amount is $900,000. If the restaurant is outside of a targeted employment area, the minimum investment amount is $1,800,000. No. You HAVE to invest in country in order to obtain citizenship. Even after applying for eb5 there is 20% Chance for rejection of green card . One thing you didn’t mention is what is the required amount to invest in? I’ve seen places say $500k-$1,000,000 and other places say $900k-$1,800,000.
The minimum investment used to be 500K but it is now 900K since Nov. 2019. I don't know why he forgot to mention that. It's very important.
