    I get aid and assistance but no help till 5 years ago. I was married to my Navy Veteran since 1976 and took care of him for over 10 years with cancer and copd and 6 surgeries requiring me to resign from Chief Medical Technologist in hospital to care for him at home 24/7. My family worried that it was to hard for me but we did it together for over 10 years and by then I was to old to get my job back after my husband passed in 2000. Is there any way I could get pay for keeping him at home and caring for him day and night. Now I am 90 years old and unable to work. Do you know if there is any stipend available for this old caregiver. I have no one to care for me and our savings went for Richards open heart surgeries etc.
    Respectfully,
    Marian Loney

    I'm 100% permanently and totally disabled over 10 years. When we married my wife kept her maiden name. Will this complicate applying for DIC or other benefits when I die?

    • @woodslawyers
      @woodslawyers  Рік тому

      Having a maiden name should not affect eligibility for DIC benefits. To receive DIC benefits, a spouse must have lived with the veteran without a break until the veteran’s death. If the couple was separated, the law says the widow can still collect payments if not at “fault” for the separation.
      A surviving spouse must also meet one of the following conditions:
      Married the veteran within 15 years of their discharge from the period of military service during which the qualifying illness or injury started or got worse, or
      Married to the veteran for at least 1 year, or
      Had a child with the veteran

    If my husband died from ALS and I file a claim years later because I was told I could get nothing will I be turned down for any reason. we were stationed at 2 bases and were married for some time and I never married again. He died at a vet hospital but his family did not let me know. Can I be turned down since this is a military disease for the most part?

    I am 100%T&P (ischemic heart disease..Vietnam vet). My question is re my wife and potential DIC upon my death. My current rating is as of 12/2017. DIC seems to involve income data and my income per 1040 is very low. However my assets are around the limit if you count life insurance. If my assets come in just a little below the cut-off would DIC pay in full or is it reduced as assets approaches the limit? thank you

      Great question. There are no income limits for DIC benefits. DIC compensation is paid as a tax-free monthly benefit and is not based on income. The VA will not consider income or assets when determining a widow's eligibility for DIC benefits.

      I'm sorry to hear about your loss. There are three primary ways for a spouse or partner to qualify for DIC. A survivor must prove one of the following when applying for the benefit:
      1. They married the veteran within 15 years of their discharge from the period of military service during which the qualifying illness or injury started or got worse, or
      2. They were married to the veteran for at least 1 year, or
      3. They had a child with the veteran.

      If you are referring to Dependency and Indemnity Compensation (DIC) benefits, then yes, you would have to apply for that. Here is more information on that topic: www.woodslawyers.com/dic-benefits-for-widows/. If you are referring to something else, could you please clarify what benefits you are asking about?

      If a service-connected health condition is the cause of or a contributing factor to your husband's death, you should be eligible for survivor benefits.
