Thank you for taking the time to make and post these videos. My dad is 90% SCD, Vietnam (Agent Orange), all sorts of health problems since I can remember and what we now know was severe PTSD. We've been lucky, the two VA hospitals near us have been great, at least compared to some things I've heard in other places. Even with that, there's so much confusion, so much red tape, things that logically would seem cut and dry aren't. Had it not been for my brother getting the claim started and both of us staying on top of it, making sure every i was dotted and t crossed, my dad would've gotten frustrated and given up years ago. I understand there's a backlog, and there have to be procedures in place. If we had to do it over, the first thing we'd have done was hire an attorney. He's now 100%, with additional health issues. It's a mixture of feeling grateful and mad as hell all at once, all the time. But this is where we are and I believe with all my heart that there's higher purpose in choosing to do what's right vs what's easy. Even if it takes generations to realize, it matters.
@@monicajohnson6061 Hi Monica, are you asking about qualifying for the VA's caregiver programs? It depends on a number of things. If you think you might then it's certainly worth applying for. I'm not an expert by any means, I can only share my opinion and personal experience but I'm glad to do that. There are a few different caregiver programs and very little of it is made clear. There's an Aid & Attendance program which is an hourly rate and is paid to the Veteran who in turn pays the caregiver. I'm not sure if it covers a full 40 hours per week. There's an unpaid caregiver program that's easy to join. Although it's not compensated, if you're actively caring for a Veteran then I think it's definately worth joining for the support that's available from other caregivers. They'll also train you to be a Caregiver mentor if that interests you. It's a very supportive group regardless of what program or level you're classified as. If you search the VA's website, you'll most likely find the one that's what many people tend to believe is the only program. It's the one with a monthly stipend and can include CHAMPVA insurance. Even that program has more than one level. That program was once limited to post 9/11 caregivers but opened up in the last few years to include any era. When that happened, it appeared they were suddenly bombarded with applications and unable to take the time needed to process them, and instead approved ones that didn't qualify. Now they're going back over them with magnifying glass and I've seen a few get cut that clearly shouldn't have been. The downside is the same as what I've seen with VA benefits, it's either overdone or under what it should be. Of course politics plays into it which removes the human element. Then theres the blame game and no one wanting to take responsibility for what caused us to need military caregivers in the first place. I'd start with your local VA Caregiver Coordinator. Each VA facility should have one on staff. They can give you details of which program you'd most likely qualify for and explain why, so that you don't waste time applying for the wrong one. They'll help you if you'll be patient and understanding with them. It can be frustrating but I've yet to meet one that hasn't been overloaded with work and doing the best they can. It's sad to see what was once considered one of the most noble jobs that existed, to serve your country, lose that nobility. But I see struggles, those that seem to have been left behind, far more often than I see honor. I think it's fair to say that as hard as a soldier fights, they should plan to fight that battle twice. *And a VA-approved attorney with an unjaded, idealist heart who hopes to help others above all else is always a good idea. They aren't free, but they're worth what they charge.
That's the truth what I don't understand if the va says it's presumptive why do u have to go see a nurse practioner to decide if u get benefits after you prove anything you want the president sighnsbthese acts and goes home and he thinks that's it I have decided img going full throttle to get what I deserve
My husband is 100% permanently disabled he came home never to be reviewed again. I applied for the caregiver benefits and I was told I did not qualify. If I don’t qualify, no one does. It just isn’t right. Thank you for the great information.

Clarification: at 7:20 we state that DEA Benefits can be used for 35 weeks-- In fact, it is 36 MONTHS, which we clear up later in the video. Sorry for the error!
Still 36 months... Available Benefits and Eligibility You may receive up to 45 months of education benefits, if you began using the program before August 1, 2018. If you began your program on August 1, 2018 or after, you have 36 months to use your benefits. This is more information then anyone has given me in the entire time of my husbands disability the VA is not very helpful here in Ga. And because he cant speak or walk anymore I just do the best I can to keep things afloat. Pray for us please and may God always bless you business I wish I could hire you to help us.
I connected with a VFW and they gave me a name and number of a gentleman that helps veterans get their benefits. He didn't charge anything and got my husband approved for 100% totally disabled. VA don't tell you that. What an awesome guy!
the VA isnt helpful anywhere, I personally think anyone at 50% or greater should be given a medicare type card, with 0 ded 0 co pay and told to get whatever help works best them be it the VA or a family practice
I'm 100% P&T. Just wanted to add that ChampVA allows your spouse to see whatever doctor they want really, but does have deductibles for a few things and doesn't cover dental (why?). Your spouse can however go to a VA center and get much of their care completely free there, except dental. For example, my wife gets her meds using the meds by mail program from the Detroit regional center. ChampVA covers in other countries, and as far as we've experienced so far, seems to be easier to deal with than the Foreign Medical Program. Just FYI.
The VA granted a pension of $1449 one week before he became paralyzed. Lasted only 5 months he died five months later. They sent me one check after his death. And when I informed them of his death. They sent me three different type of forms to apply for the things you guys talked in the video. I was married for 18 years. Lived with him for almost 20 years. He had appointments to the Examinations for the future claims. He never was able to attend the appointments as he was hospitalized. After his death I found out he sent months before a claim for dependency. The VA paid for Aid Attendance Home Service 4 times per week. I spent hundreds of dollars in Uber to travel to the hospital. I rent a hoyer lift because the doctor here refused to gave us one. Etc etc. This is the first time I've tell my history online. I feel like rant. May not be the right place. But! Who cares. The Veterans Administration has caused so much Trauma and Pain.
Did you know the veterans is death do to a Neurosurgeon neglect. And a recently graduate who fractured my husband vertebrates. A screw broke , got lose. He went there to get fix. Not! To end up Cripple, Foot Drop, Fell 10 times in a year. One of those falls broke h iui s arm. Bruises all over because the foot drop condition. A condition he did not had when he went there to get fix. Hit head more than once. Cane, walker, wheelchair, hoyer lift. Final stage.... Paralyzed until his Death. He died with a holes in his body related to bed sores from other hospital neglected his wound care treatment. All related to that operation. He will be alive today . If he had never went to had the operation. VA Doctors Negligence. He was not the only one. Many veterans end up paralyzed from neck down because of Veterans Administration Doctors error. Is not fair. The Hell! We went through. He was the victim of Medical Malpractice. Period.
@@alialive4769 I’m sorry for your loss. I can’t imagine how frustrating and maddening this all must be for you. I hope everything works out well, and I definitely would recommend that you speak with a lawyer ASAP.
can someone please explain to me why i got denied twice by the caregiver program when my husband is 100% disabled and we have all the proof of his disabilities and i pretty much do all the things a caretaker does and i also deal with the ups and downs and the emotions that come along with it. i have now had to write a 3rd letter for my appeal explaining to them why i am entitled to this it should not be like this to have to beg for help when this program is to help our veterans and caretakers im in the process of my 3rd appeal and im still waiting on a decision
The denial letter should specifically state what they need to support your claim. I would go to Disabled American Veterans and ask them to review the denial and advise you on immediate next steps to expedite your caregiver application. I tip my hat to you for supporting our 100% disabled veteran. Iknow its not easy . Many blessings to you. SALUTE!!
EldA Robinson, there are a few programs that fall under Aid and Attendance. For this information take a look at our blog. cck-law.com/blog/aid-and-attendance-benefits/
Need this answered! My husband died this year, (2021), a Vet, and 100% Total Disabled. Our Adopted Daughter was awarded DEA, back in 2012. Will she still get to use this benifit, till 26 yrs old. Plus, I got Champa, and Medicare. Will I still be able to keep Champa? Really need answers fast!!!
Please explain why the Caregiver Program is only available to those veterans who served AFTER Sept. 11, 2011? I served in the Army on active duty for 17 years of honorable service from 1977 to 1994. I have TBI, PTSD, sustained hearing loss where I have to wear hearing aids for life due to mandatory M-16 annual qualification skills, & I had breast cancer where I have had a mastectomy (surgical removal of both breasts) to save my life. I am rated 100% disabled by the VA. Will my spouse qualify for this benefit? Thank you.
thank you for all your hard work and videos on You Tube. i am already rated 100%. as you may already know, the Army or maybe other branches of Service; do not refer or direct Veterans (speaking for myself and others of my generation) to services or legal counsel. I went for many years (40) with no referrals. maybe a composite easy to use app. made by/for your firm. would help.
IS the ChampVA medical insurance can be used by the spouse as the main medical insurance? or is champva just a supplementary benefit that acts as a secondary insurance?
I am hearing that a spouse can be in a VA state memory care facility while the veteran is in the same home in skilled nursing. If the veteran has 100% SC disability then the veteran stays in VA home at no cost, while the spouse stays for 70% of her income. Is this correct? Can the veteran be in assisted living (at 55% total gross income) while spouse is in same state home in memory care for 70% of her income?
I went to college when my husband received his permanent disability vet benefits, but was never granted any education benefits from VA. Now that he is deceased, his disability went down from permanent to 10%. I could really use education money. I have 5 courses to finish for my degree, but no money to pay for it. Can I still get this DEA money?
My husband was a hundred percent! From agent orange. Small cell lung cancer lungs lymph node and bones He only lived nine months after finding out. They really don't have much for the wife. I think they need to be took care of.
Does DIC apply to a Vet's spouse if the date of marriage was 2019 and his disability was also aggravated in 2019 and he died in 2020 with a 90% disability?
At your 7:20 ish mark, the male said that spouses receive 35 WEEKS of chapter 35, when in actuality, they receive 36 MONTHS of benefits. So, not only is your number wrong, but so is your length.
What if the wife is on Champ and had another insurance before getting on Champ, what do I do with the Champ claim that comes in. It says something about sending it in. I don't understand.
My husband passed away last November we were together for 40 years being a gay couple only married since 2015. He was 100% disabled from agent orange he was a retired major Vietnam veteran I am receiving a spouses pension he died of complications from agent orange am I supposed to receive extra monetary benefits from the pact act ? Thank you for doing what you are for us 🇺🇸
This is a long shot my husband was 100% with PTSD AND TBI FOR 5 YEARS I apply for caregiver and was denied all three times. Now he is 100%P&T can I apply again I was told I can't because I did three times already.
My wife gets free education in Alabama but she already has her masters degree that the va wouldn’t pay for. I wish the va would just pay off her student loans because if she went back to school it would cost them more lol. They need to have that option for souses that already have an education. I find it stupid that they won’t pay for her masters. They told her only bachelors or below. Not sure why that would matter
Lani Lias Aid and Attendance is when you need the assistance of another for basic daily tasks...like showering, medication, going to the bathroom...any number of daily kind of tasks that you cannot do yourself.
SMC is Special Monthly Compensation. It is additional money given to veterans that qualify. It is extra above what a veteran would recieve besides their VA disability payments. For more info, look up SMC on the VA official website.
If I am rated at 90% and was turned down for 100% because they said that I was employable. My doctor from the VA wrote a letter stating that I was not employable. I have appealed the decision and it has been over 90 days, how long does the VA have to make a decision
@Chisholm Chisholm & Kilpatrick LTD Do you have enough information on the expanded VA’s Program of Comprehensive Assistance for Family Caregivers (PCAFC) yet to do a new video. So if a veteran is 100% would they still be able to file now instead of waiting the 2 years for all others after 1975.
Do you have any advice about applying for SSDI? Why would Social Security not review a veterans medical record and then come to the conclusion that you are going to receive SSDI? If a veteran is found fully disabled unemployable because of a service connected physical injury, the VA then says you are truly disabled apply for SSDI. But how can SSDI then deny the veteran? Social Security used the wording stating "We believe you are able to have gainful employment and by our standards are NOT Disabled.". The VA uses many medical personnel to review medical documents before making a decision. But Social Security didn't use a medical professional. So how can Social Security make a correct decision? Why do you think Social Security would go against the decision that their Government cousin has made? Also how can someone truthfully say that a structurally damaged individual with many other medical issues can have gainful employment? The veteran in question has nerve damage throughout. Cant stay in a single position for long periods of time, has cramps that can come out of nowhere, severe pain and then numbness and tingling aswell. So with the structural damage to a person's body paired with everything else I've listed and some i have not listed... what place of employment is going to work around that? What place of employment is going to allow a veteran to randomly not come in because of how the severity of it all differs day to day? Only places that would work around that would be places where the veteran be talked about is in a high position in the company. Board members, ceo... etc. Advice would be greatly appreciated.
A question in general about CHAMPVA and VA , The husband died about seven years ago and VA , this lady has been having problems With the VA friend of mine her husband passed away they were together for 15 years but they were only married for 8 years but the VA says that cuz they weren't together for 10 yearsso the VA says that she's not doesn't get anything she's not on the VA at all but the CHAMPVA is still pain in her medicines taking care of her medicine how is the VA being wrong to her if she's still getting the the medical stuff
I am at 80% paid at 100% unemployable, currently fighting social security, they stopped my benifits as they said my condition improved. VA letter says im unemployable, SSI letter say im unemployable. Confused.
Unless you're permanent and totally (pt) disabled then you will have to visit doctor regularly throughout the year. If you do not then they will lower your rating because you are saying that you are getting or are better. #seedoctoroften

My wife was 100/10% p&t disabled. She was awarded that in 1998-99, and we married in 1999. She died in 2005. She clearly died of her service connected disability. Just wondering what out there for me.
I reached out was told to send paper work. And was told they could not help with my case. No reason was given. So I just figured it had to do with my income.
Yes wanted to ask : as caregiver for my disable va husband . I am also disabled, they have discusses putting him in nursing home, if that happens is there any benefits available for me.

My individual disabilities total 240% but my combined rating is 100% plus I get a SMC. I have multiple blood cancers and gene mutations (Camp LeJeune contaminated drinking water). These blood cancers are not curable absent a stem cell transplant. I will be on chemo for the balance of my life or until my blood cancers mutate to full blown Leukemia at which time I will have go undergo a stem cell transplant if I'm a candidate at the time. My wife drives me to my doctor appointments and travels with me to Sloan Cancer Center. So is my wife entitled to care giver benefits? She currently has CHAMPVA insurance.

Kurt Woods yes you could be, but it’s difficult - the closer to 55 years old you are the more likely. It is possible to be 100% with VA and still be denied Social Security, in my experience you need several psychiatric hospitalizations if you have no physical ailments. Good luck. My husband is 100 P&T and barely got his SS, he was turning 55, they denied three years of back benefits, it was a brutal process. The VA was far easier.
Yes you are! Veterans can collect VA disability & SSDI at the same time! I had to obtain a lawyer to get my SSDI. It took 2 years. I files twice on my own & I was denied by Social Security. I got fed up, hired an attorney, & she won my case the 1st time around! So grateful to her!!!

How do you qualify as a caregiver? My husband is a disabled vet but is still able to work and all that, he has some mental issues that he needs help with. Could I qualify as a care giver?
@Sarah Leroy, thanks for reaching out. In order to be eligible as a caregiver, one must be providing at-home care to a veteran who has a serious service-connected injury such as a traumatic brain injury. The veteran is in need of care because of the inability to perform one or more activities of daily living. cck-law.com/blog/who-is-eligible-for-vas-comprehensive-assistance-for-family-caregivers-program/
Hello! To apply for VA survivors benefits (i.e., DIC, Survivors Pension, and Accrued Benefits), the surviving dependent should download and fill out VA Form 21P-534EZ. Once the form is complete, it can be submitted online, via mail, or in person at a VA Regional Office. It is also important to note that VA survivors’ benefits are not taxable. VA Survivors Pension, accrued benefits, and DIC are all tax-free benefits that do not need to be included on a tax return. Thanks for watching and have a great day!
I am a disabled vet and I have a service animal. I was taken via ambulance to a local hospital due to a fall. Once at the hospital, my service dog was denied entrance for 3 reasons. 1. He didn't have a vest...2. The security officer demanded to see his vet shot records...3. I needed to provide state proof he is a service dog. Problem:. 1. He had his vest. I hadn't put it on him, it was in my purse. ADA doesn't require a vest. 2. Demanding to see shot records, my service animal had his current shot tags on his collar 3. Demanding state proof of his "service animal " status. There is not no such of "proof" ..state registration does not exists in Colorado Next: security officer stated I could go out online and purchase "registration " for $70. So, false paperwork is ok? I was denied my animal and my civil rights to have him with me

Can a care partner qualified for the DEA benefits

Available Benefits and Eligibility
You may receive up to 45 months of education benefits, if you began using the program before August 1, 2018. If you began your program on August 1, 2018 or after, you have 36 months to use your benefits. Effective Oct. 1, 2013, some DEA beneficiaries may be eligible for up to 81 months of GI Bill benefits if they use the Survivors and Dependents Educational Assistance program in conjunction with an entitlement from other VA education programs.

After : years my lawyers got me from 30 to 90 percent. Six months later 100 . Thanks for the info . But truth be told I wish I could work .
Just FYI.
@@chawanneburns8413 not sure I understand your question. Sorry. Can you clarify a bit?
@@chawanneburns8413 right, that's what grants do... but for what?
Well did you seriously think you get more than is allowed by law?

At your 7:20 ish mark, the male said that spouses receive 35 WEEKS of chapter 35, when in actuality, they receive 36 MONTHS of benefits. So, not only is your number wrong, but so is your length.

I am a veteran on p and t disability. My spouse is on champ va. What happens to her champ va if I die.
How does the Caregiver stuff compare to SMC Aid and Attendance for example?
What is SMC AID?
Lani Lias Aid and Attendance is when you need the assistance of another for basic daily tasks...like showering, medication, going to the bathroom...any number of daily kind of tasks that you cannot do yourself.
But to qualify for SMC your injury must be service connected! However the standard caregiver program does not have to be service connected illnesses.

Hello, my husband was in the navy for 4 years and army for 3. He was 100 percent disability. He was in the military in 1974 . Can I receive anything?
@Chisholm Chisholm & Kilpatrick LTD Do you have enough information on the expanded VA’s Program of Comprehensive Assistance for Family Caregivers (PCAFC) yet to do a new video. So if a veteran is 100% would they still be able to file now instead of waiting the 2 years for all others after 1975.
Thank you for the suggestion. We will consider it for a potential new video in the near future.

They expect her there 8-5 M-F so we (myself, the 2 kids, and herself) cant afford her to not have a full time job right now. So getting her degree and ever getting this much better job is basically being stonewalled. Any help would be great. Thank You.
Are there any additional monies that a 100% T&P Veterans may be able to file for? Thank you so much for your UA-cam channel!
@@chawanneburns8413 I have been 100% T&P for probably 15 years now.
@@chawanneburns8413 Thank you so much for the details; I will reach out on Monday.
@@chawanneburns8413 I've attempted to call the number you gave and to no avail. There's a prompt too at the beginning and again after ringing. Suggestions?
@@chawanneburns8413 I sent a text to someone from somewhere. It came down to receiving a loan after $300 for the “form.” hmmm! Interest rates, depending on credit score, would range between 2.27 and 3.50%. Not sure what to make of this.
@@chawanneburns8413 How are you connected to the SBA? I'm having issues dealing with a person through text messaging. Thoughts?
If a veteran is 100% disabled with permanent and total. Is the spouse only eligible for DEA benefits or Chapter 35. Can the child of the veteran use it as well?
Also, a veteran being deceased seems to spoken of often. Does the veteran have to be deceased in order for Spouse or Child to use these benefits when it comes to the Chapter 35?

What form to fill for a veterans wife with no social security number. Living abroad.
I was going to get my wife to be my caretaker but she's been making comments how she will use that position to control me and get power over me. Time for a divorce.
Veterans in Crisis treated as Criminals only furthers the CRISIS!!!!!!
I am reaching out to you as a veteran with major concerns with the government's systemic failures and Judge Cynthia Beemans complete Incompetence. I had a severe crisis back in June 8th 2020, Uneducated Curry County of Oregon treated me as a criminal and caused undue emotional and physical trauma due there severe lack in education. I am truly disheartened and at a loss for words. I am specifically reaching out to you because I believe you are one of the few with an intelligence level that may understand. I have assembled all my data as clearly as I could on a website. Please review Thank you. Www.usvaw.org
@@WilloClan Stay off the drugs man. This is about VA benefits.

Is this more paperwork to claim?
As a surviving spouse can I use Firm 21P-534EZ?
I want to know if it to late to get life insurance. I m 100% disable I been out since 1986
Does anyone know if the raise is only for base or spouse and A&A. Right now I am getting $4331.91.
2. Demanding to see shot records, my service animal had his current shot tags on his collar
3. Demanding state proof of his "service animal " status. There is not no such of "proof" ..state registration does not exists in Colorado
Next: security officer stated I could go out online and purchase "registration " for $70. So, false paperwork is ok? I was denied my animal and my civil rights to have him with me
It's okay to leave pets at home. It's a place for sick people not pets. If this helps any.
