  • The family of a 13-year-old who was charged by Summerville police with assaulting an officer at a Walmart in Summerville will be holding a press conference Wednesday alongside their lawyer Marvin Pendarvis.
    Video taken of the juvenile's arrest began circulating on social media and stirring controversy, with many saying the officers used improper force in subduing the teen.

    The officers came in with a bad attitude and escalated immediately. It's common for kids to sell roses, candy, cookies, etc. around Charleston without a license. The cops are trained to de-escalate, but the cop puts his hands on the kid without telling him he was under arrest or being detained. The cops chose violence.

    At least the kid wasn't out selling drugs, the cops did handle it too aggressive. It looks to me that the cop was accidentally hit in the face by the kids elbow when he was thrown to the ground.

      @@royharper2003 The police got the same energy they cam with. If they had come up politely and not aggressively then maybe he would not have cursed at them. Secondly although it is private property all they could have done is ask him to move along. They did not, began asking for his ID and then grabbed him.

      @@njemilenantan2269 The police asked the people loitering, including this kid, to leave from their patol car while driving past them. This kid ignored them and that's why they had to approach him. All the kid had to do was move along when they told him to the first time.

      The police saw this young man, and because of the color of his skin, immediately treated him poorly. I have seen drunk unruly white boy cursing the police and they allowed his friends to promise to bring him home. White people looking through their rose colored glasses always want to comment on realities that unknown to them. When they stop convincing themselves that black people are the problem, looking at themselves in the mirror will be uncomfortable.

    The officers were called to the location due to a complaint about these two children. They were trespassing. They were asked to move along and refused. That is the entire reason for the altercation. You don’t get paid because you raise a child who has no respect for adults or law enforcement. You should be apologizing to the police for the way your son disrespected them instead of acting like a victim.

      It is not a good idea for adults to tell l a 13 year old then if they feel any "offense" in the way he is spoken to by any adult, that it is then OK for the 13 year old to be a foul mouthed, smart ass who gets to throw his fists around in response. I know this because I raised 4 children...and in my experience many 13 year olds don't like what they are told, or how they are treated by adults at regular intervals. Teaching them to control themselves and "and in the meantime follow the rules and be respectful" is the best thing a parent can do for the teens, their schools, and their communities.

    So he basically is saying that businesses must allow people to sell items in front of their stores because they are trying to make money but people don’t want to be approached by a bunch of people getting in their faces to make purchases. For many it’s uncomfortable. This wasn’t a race issue if Walmart called them. Honestly I feel like the family is trying to use this to file a lawsuit to get money.     troubledd by the behavior of this children who, because they had not yet been taught how to behave in public should not have been left unsupervised in public places where they were trespassing.

      As a single mother after my divorce l can tell you why this is an issue too and it's because these women BOTH black and white have no doggone clue how to effectly discipline their children. They either think their children are suppose to learn by osmosis and when they do something wrong beat the living tar out of them or let them do whatever they want when they are young and then throw their hands up and expect everyone else or the police to do something about their out of control behavior. It's not their job to be these kids parents and none of these women know how to be either. Instead of keeping their rearends home and making sure these kids are in the house they are out in the club shaking their azz making the next kid while the older ones are out in the streets doing who knows what and their excuse is you have to let them have some freedom. These kids are out in the streets at 12, 13, 14 carjacking, killing, shooting, stabbing, etc. If you want to raise good kids you give up your life to do so PERIOD.

    In my teenage years, in the case of non- violent infractions, cops walked up calmly and explained to young people what they were doing wrong, why it was wrong and explained the consequences for continuing to behave that way. They didn't demand ID from kids too young for a driver's license, either. If necessary, they spoke firmly to the parents about the child's behavior. THEN if the behavior continued, they issued a juvenile court summons. But then, I'm an old lady. It was before law enforcement was outfitted for war and trained to believe they were the be all and end all on the street that had no need for the slightest bit of patience.

    How many times does this lawyer refer to the 13 year old as a man???? That is the issue. He is child, teenager. Who instructed him to sell roses? Obviously he needed to work. The positive sign is that he was not selling drugs. Look deeper into his family life. The fact that he was adamant to continue selling makes me wonder, what was this money needed for so urgently that he did not walk away?

      I’m sure that yet another person on here will complain about the girl scouts because they absolutely refuse to accept that the girl scouts obtain prior permission. They don’t just show up and set up a table. They have a chaperone and don’t block the door.

    Watch the arrest video bodycams and one can quickly discern there are no concerns re: "allegations" ..
    I don't cut this kid any slack for his behavior and while it's understandable for the parents to come to his defense is .. its really *sad based on the facts.
    The background (as I understand from what was reported) was that there were reports of shoppers feeling they were hassled by "aggressive sales approaches" at the Walgreens entrance/exit. This was reported to Walgreens Mgmt whom then requested police involvement to get the youths moved off their premises. The police responded and gave them an initial warning.
    When the police returned 40 mins later it was obvious they ignored the 1st warning ..this escalated the situation.
    The disrespect from the 14 year old with: "I don't have to tell you my name" "I don't have to give you my ID" .. "..F**k You.."
    shown a total lack of understanding of his situation in correlation to how the law works.
    I blame the parents for not instilling this understanding and to know when to back down from the law.
    Had the kids immediately left after their 2nd warning, all would have been fine.
    Instead, the 14 year "stood his ground" was disrespectful and escalated the situation.
    The 14 yr olds defiance might have been ignored but considering the above background I don't believe that the correct way to handle that situation.
    The police demanded the kid back down or face consequences and the youth justgot more angered and was arrested.
    During the attempt to arrest the youth the 14 year punched and officer.
    I think that a court of law will consider the above info and the evidence (2) body cam footage and charge the youth with assault .
    Nobody wants their kids to get into trouble like this but supporting this kind of behavior is BS.
    *These relatives either don't have all the facts or they are biased against the law.

    When asked if he resisted this man said “well, he didn’t want to be arrested and felt he shouldn’t have been arrested”. He is 13. He isn’t a cop, a lawyer, or a judge. Deal with the arrest in a peaceful manner and the court will decide if the arrest was lawful. Come on now!

Walmart asked the police to have these 2 kids removed so that shoppers can get in and get out without having to be interrupted by someone selling flowers or anything else for that matters. When you Girl Scouts selling cookies in front of a store they get the stores permission. These 2 kids are not. When police asked them to move along one got in their face and even made a racial remark to an officer. It had nothing to do with race. That kid tried telling the police and Walmart what he can and can’t do in front of their store. It’s not his store and he isn’t a lawyer at 13 years old. Now family hires a lawyer and makes the kid out to be a victim which he wasn’t. What next? His attitude is the main issue here when he was told to leave. Not to mention he hit an officer

    I’m so glad that Summerville police released the video and that this family also showed themselves in a video. That way I get to see what a family who does not teach a 13 year old boy and soon to be a man what respect is, or that following the law is important and teaching him that hitting a woman in the face with a close fist is perfectly fine and calling her racial slurs is acceptable. I also get to see first hand in my own hometown how the race card is played and have to see a lawyer explain to me that I didn’t see what I saw in the video - thank you to him for clearing that up for me since he feels that folks are to ignorant to decipher what they see with their own eyes. I also get to see his mother and uncle and see what bad parenting by family members literally looks like - shame on his family and shame on the Summerville police department if they fire these officers for doing their job. Mom and Uncle - I expect you to step up and be honorable and pay for that woman’s medical bills where your son and nephew smacked her in the face, but I know you won’t because you’re only interested in playing the race card, not in doing the right thing.

    So the kid "did not want to be arrested" and that is why he fought back?? I raised 4 children, and find that rationale ludicrous.
    A huge part of raising children is getting them to accept and cooperate with many many things they do not "want" without
    "fighting back" That is called growing into a mature, functioning, and responsible citizen!
    If I had not done so with committed consistency my own children might still be throwing food on the floor while sitting in high chairs! Why have parents lost all common sense.? Mr. Pendarvis I hope you do have children and that they turn out well. But it is serious work to teach children to control their impulses and worst instincts and behave maturely. It is a dangerous world for all of us if parents do not do this. This mother looks so confused and forlorn and "victimized" Putting ALL the blame on the policeman is not doing anything for this boy and his mother..... But his using profanity does not give the kid permission to do the same and worse nor does it give him permission to resist and fight back. I believe it is irresponsible and dangerous to teach or allow kids to believe that compliance with a police officer is a choice rather than an obligation.
      Had this 13 year old not behaved so badly, (as the whole incident was recorded,) this officer's impatient and sarcastic initial interaction might have been the 3rd strike perhaps required to finally get him out of his job!

    As I understand it, under South Carolina law, selling roses could be considered peddling, and peddlers are required to get a $50 license. This is one of those lemonade-stand situations. I can understand why Walmart's wouldn't want a 13-year-old competing with them by selling roses in front of their store. I realize that the kid was hostile. But come on. Is it a good police policy to arrest 13-year-olds for selling roses? And did the adults escalate the situation more than they had to? Can you think of a better way they could have handled it? Are other kids allowed to sell things on the street? (In some places, stores like Walmart's hire off-duty cops to work as guards in their store. Does Walmart's do that here? If the cops are working for Walmart's as a second job, is that a financial incentive for them to handle Walmart's complaints more aggressively?)

    Have you watched the vid???
    It was clearly the kids fault. He argued abt needing a license. Kid was belligerent. Taser, kid NOT in handcuffs. Apparently he is above the Law!

    The store manager could have handle the situation and not call those pigs. Manager could have allowed them but direct them where they should stand away from the door but on the sidewalk from the door. They rather for the black child to be stealing.

    The problems with black youth on display here. The kid was cussing the police, failing to follow lawful instructions, striking a police officer, yet here they are claiming the kid was just minding his own business and was attacked for no reason. The police do make mistakes, but in my opinion not in this case.

    You sir are a failure to the children and parents of today. You are legitimizing the bad behavior of the child and lack of respect that the parents have instilled in him. Blame the lack of respect that I believe is spread thru music. And yes he did strike the police officer. He was guilty because they did not want him there. Other organization ask for permission is how it's done by the way.

    As I said before "some people men/women should NEVER BE COPS". Our government NEEDS TO "RETRAIN ALL POLICEMEN/POLICEWOMEN". This is a "NATIONAL PROBLEM" in every state, every city, every small & large town in the USA. Police Officers need to be trained not just how to chase a criminal, use a gun, but ALSO "how to deal with ALL TYPES OF PEOPLE, ALL AGES, ALL various RACES. Cops need to have "PEOPLE SKILLS", in how to "talk to people" including a child that is ONLY 13 years old. I was soo angry and disappointed at how aggressive the female Cop behaved and her verbal voice came across ugly. Frankly, it's almost as if she judged him by skin color. That is NOT professional at all. God help us in America 🇺🇸 🙏
