  • In May of 2021, South Carolina police opened fire on a man sitting in his truck talking to his mother after being called to the scene for a wellness check. The man, Trevor Mullinax, survived, and has filed a lawsuit alleging the officers defaulted to “using deadly force.” WCNC’s Kayland Hagwood reports.

    As a former law enforcement officer, this is disgusting. First and foremost, 50 shots, and only nine landed, comes to show you there’s a serious training problem. Not to mention the elephant in the room that they just open fire with another person in such close proximity. Those officers should be arrested, booked, charged and convicted for attempted murder, plain and simple. This has to stop. I can’t stand when I see my team do things like this because it doesn’t help our situation in any way shape or form

      Well David since you claim to be a former LEO did you actually watch and listen to the whole video? Did you pick up on the part where he was wanted on burglary and malicious injury charges? Do you know anything about his prior contacts with LE? Did you pick up on the part where he produced a shotgun? I know NBC minimalized it, but it's there. How about the fact that the officers all engaged simultaneously when they all perceived a threat at the same time? No I think you just bought into this edited and slanted NBC report that is designed to paint the officers in a bad light. Notice how the story is absent any video preceding the shoot. And since this is a CIVIL lawsuit, the officers were already cleared CRIMINALLY of wrong doing...but you should know the difference being former a LEO. There is a lot more to this incident that NBC is not telling us. Sad that you bought into it, but hey...that's show biz.

    • @davidprince2858
      @davidprince2858 Рік тому +117

      @@benitosalazar3749 Well, tbh if you understand about law enforcement, especially in todays world, it’s all about de-escalation. It’s not up to an officer to sit there and shoot him especially when there was no real threat at that very moment they shot. Secondly, aren’t you doing the same thing you claim I’m doing when you didn’t even realize that I didn’t put my judgment solely on this video, I READ THE ACTUAL REPORT from this incident. So yes I stick to what I said before. I’ve been in many positions, including an active shooter, where I had to use restraint because if at that very moment you fired your gun, was there a actual threat, not a perceived one. Didn’t matter if he had a shotgun, did he point it in the direction of officers? Did he shoot the shotgun, did he point it at the female on the scene near to the vehicle? Was it necessary to put 50 rounds or even 40 in that vehicle? Since you seem like you know a lot, do you even know what Contagious shooting is? Yeah so if you have even been in the police training, or just use pretty much common sense, you would understand that Contagious shooting is when one officer shoots and the others on the scene just start shooting… in this instance this was extremely unnecessary. There’s a reason why training is important because there is always a way to be better than before and this is the perfect example. Not only that, if you need to reload your firearm after shooting at a stationary person then, there is a serious problem with your aim, which means you shouldn’t be in the field. Not only that, only 9 shots hit him out of all those shots…Officers like this are liabilities to the department. It’s simple. I like you support law enforcement or maybe you are a law enforcement officer, you should know better than to defend this. Police work is hard, we don’t need to make it harder by having officers like this. We can’t make excuses for this behavior.
      Oh and I edited it because I think faster than I type and sometimes I have to correct what I wrote. Nothing wrong with it

    • @benitosalazar3749
      @benitosalazar3749 Рік тому +20

      @@davidprince2858 Could you be ex-LAPD? If so your perspective makes sense. Put the suspect's safety ahead of that of the officers and citizens. Seems the people with all the facts, who investigated the OIS determined there was no criminal wrong doing, disagree with you.
      As for 50 rounds...how much training or experience do you have shooting through a windshield? Handgun rounds lose much of their energy and are partially deflected when striking a windshield. We had two shoots where the rounds lost so much energy they barely injured the suspect. Likely why this guy is still alive after 9 hits.
      As such we trained to shoot multiple handgun rounds through a windshield for effect - in both directions. Did you consider how he might have got shot in the "back of the head?" Perhaps because he was moving around as the rounds landed, making him appear to be an active threat in the officers' minds. The upper torso/head region is a smaller target than center mass...especially if it is moving. More so if metal and laminated glass are deflecting your rounds.
      As for the video, and since you "read" the report, how long were they there before the shoot? Clearly this biased news report does not want it's viewers to know. Did they tell mom to clear away and did she refuse? When you say a shotgun didn't matter you almost had me laughing. It does matter, especially when the crook is wanted and in a suicidal/homicidal mindset. Did he point it at them? I couldn't see in the video and neither could you. Did he point it towards his mom? What did the report say? Where does it say police have to wait until someone points a shotgun directly at them to use force? Nowhere. The standard is did they have reason to believe there was danger. Wanted criminal, suicidal/homicidal and with shotgun = leans to a big YES. Clearly the investigators who reviewed the case also thought so.
      I lost a partner and friend to an armed and "suicidal" suspect. Don't tell me for one second people in that mindset are anything but dangerous. To think otherwise is foolishness that will get more cops killed.

    • @davidprince2858
      @davidprince2858 Рік тому +72

      @@benitosalazar3749 Ok, so I really don’t do this at all. I can’t believe I’m even going this far. One, nope not LAPD, but I will tell you I was with a major city police department. Secondly, at first, the training that they taught us about putting safety and citizens over a crook or a criminal was BS but when you dive deep in the training in the understanding of why there is such a thing, you would understand that it prevents simple things like this from happening. Thirdly, I think it’s a bit funny how you guys train to shoot through windshields when FBI experts and even military personnel’s would tell you that shooting through a windshield is one of the dumbest things you can do. And the reasoning behind it is everything that you mentioned. I think strategy, and a lot of more training would’ve had a different outcome in the situation. I think that if the officers at the scene, since there were multiple officers, would’ve been in a better position, then pointing the gun at a windshield, they would’ve eliminated the threat (if he was one at that moment) more easily. Regardless of what he was wanted for, AT THE MOMENT, what was the circumstance of the shooting. That’s how all officer involved shootings are investigated. As for the officers being cleared, South Carolina is a state that has a very high number of officers involved shootings that many other experts, outside of South Carolina what deem as inappropriate or excessive force. this has been exemplified many times before, even by seasoned FBI agents and use of force analytics. If you go look at the video in the report, it was no less than a minute after the officers got off their vehicle, and pretty much started shooting after they said, “Hands” several times. There was no real plan from the very beginning, and you can tell this was the case by the officers actions. Every law-enforcement officer could tell you by a video whether a plan was in motion or if they just sprung out and started shooting pretty much like this. And before you say that, I think I’m an expert or what have you. I would say that during my training in the Academy, plus my extra training that I received for being in a certain division of my department, I would say that this is terrible all around. Let’s say that the officers actually saw the shotgun like they said in the report, then why to officers, who were on the scene were smack dab in front of the black pick up truck that the suspect was in with a supposed “shotgun”, as a (Officer) immediately would have took cover behind my squad car and starting giving directions. These officers immediately exited their vehicle, stood in front of the vehicle, and began shooting, no explanation, could suffice the reasoning for what transpired at that moment. Even swap members if they are going to be in countering somebody with a shotgun, they do not pull up and immediately go to the front of the vehicle and start shooting. There’s a plan in place there’s cover being taken in their strategies being. I’ve been shot at before and never shot back and was able to take the suspect in custody. And yes the suspect was in a vehicle.
      So again, I’m really not going to keep on with the back and forth. I really am just going to leave it as that. I respect your opinion and if this is ok with you, then so be it. Thank you for your service brother and stay safe

    This happened to my friends brother in Modesto, CA. The brother who had supposedly bought a gun told his sister vague threats over the phone. But the brother has known mental issues so the family called the police to help them. Modesto officer Joseph Lamantia quickly arrived at the scene, yelled "show me your hands" as he has his weapon out. The brother, Trevor, immediately placed both his hands up and got on his knees, but the officer still fired 4 rounds. As Trevor lied on the floor in agony the officer still had the audacity to continue saying, "show me your hands".
    Trevor pleaded for help as he laid on the ground heavily bleeding out but the officer himself provided no medical help within those moments.
    Yes, getting a call about a man makings threats while in possession of a firearm is as serious as it gets but Trevor had no prior record, he was good hearted man who just graduated from San Jose State University months before and wanted to be a referee for pop warner football. Not to mention, Trevor did not have a weapon on him or anything in his hands.
    Ofc Joseph Lamantia only got paid leave at first but he finally was later fired after through some intense and persistent protesting by the family. Joseph Lamantia has killed 4 people total, none of which should have been warranted when you review them, and he failed the psychological exam 14 times!
    There needs to be a new law that states if any cadet fails whatever exam multiple times they should be barred from the occupation. Just like how it would be for the military.

If you're from a law enforcement family, you should know that he was a threat to everyone involved. If you're from a law enforcement family, you'd understand how ridiculous you seem with a statement like, "They should all be fired, jailed, and that department needs to pay millions to that family for attempted murder charges." What attempted murder charges? You mean when the guy surrounded by cops pulled out a lethal weapon and was therefore shot? I know the job is dangerous and deadly, but police, who are public servants, shouldn't be that trigger-happy so frequently. We don't deserve this, as citizens.
    The police don't often just use shoot-first ask-later, but as we saw here, they add and often initiate aggressive tension, as this group of officers did with guns out and then emptying clips on someone who's own relatives called as a well-being call.
    Police life is hazardous, and nobody questions that much. But that doesn't mean that this kind of action is rational or necessary.
    Especially in a nation where, hey, if you gun-rights folks (many cops, included) want a sea of guns everywhere legally, you have to deal with the reality that not even gun-holding person of interest merits being shot by police.
    Sometimes (much too often, sadly), you're going to get people in su*cidal situations. Makes no sense to answer a su*cide call if you're just going to end up almost killing them yourself.
    Police need to learn how to deescalate these and similar situations without aggressive intimidation. They often make situations worse with added aggression and carrying this attitude like they're not human, too.
    Give a person a badge and the power just goes to their head.
