- The Supreme Court heard arguments Tuesday in Fischer v. U.S, a case considering the extent of a federal obstruction law that is being used to prosecute defendants who attacked the U.S. Capitol on Jan. 6, 2021. Prosecutors are also using the law against former President Donald Trump.

The Supreme Court should not be about liberals or conservative it should be about we the people

Why can't voters file lawsuits against politicians ignoring the needs of the citizens?
It's quite simple. Quit trying to blend two different laws together to create a guilty. Read the blatant English of the language that is the problem with our judicial system from top to bottom from a prosecution's viewpoint and the defenses viewpoint is there to always trying to read into these laws, not just what the text says
The text says “otherwise disrupt a proceeding”. So if you want to appeal to actual text the meaning is clear.

I listened to over an hour and the court seems very skeptical of the government’s arguments. As they should be. Very funny to hear the government differentiate past “mostly peaceful protest” vs what people are doing hard time for.

Agree.... Example: Did the defendant tamper with the evidence, threaten witnesses, OR otherwise disrupt the investigation? In my reading, the otherwise is a catch all of the first. Did you have sex with her or otherwise break your vows? It could be sex but other things would count too, either way, they are break the vows.

@@unbreakable7633 Otherwise means "in another way"....if A,B,C or in another way do X means that any of these can get you in trouble including A,B,C or anything else not listed that causes X. Like the Justice Sotomayor said. Sotomayor used the analogy of a sign posted in a theater that says you will be removed if you photograph or record the actors, or otherwise disrupt the performance. She argued that “if you start yelling, I think no one would question you could be kicked out under this policy, even though yelling has nothing to do with photographing or recording.”
@@unbreakable7633 The Jan6 people could have been destroying state electoral certificates or in another way (otherwise) doing other things to try to stop the official proceeding (such as: hang the VP, zip tie people up, forcing members to evacuate, etc, etc). For about 1/3 of these people their intent was clear and they should be held to more jail time. The other 2/3 of people there is no evidence of intent.

The Jan 6 defendants, held now for more than 3 years without bail or a speedy trial, have been the victims of one of the most egregious instances of tyranny in the history of the US, deprived of their criminal procedural rights under the 4th, 5th, 6th, and 8th Amendments. Their treatment would justify a real insurrection. Thomas Paine was right: defend the rights of your enemy, for if you don't you set a precedent that will deprive you of those very same rights. Prove all that in a real court of law, not the kangaroo courts we have now. You have tyranny in your heart.

If they meant otherwise spoil evidence they would have written that. They were clearly focused on the obstruction of a proceeding. It also doesn’t mean that if you block a bridge and that has the impact of impeding a proceeding that would be so far removed from the intent such that it would be irrelevant. But if you do stage a sit in this could apply and reasonably so. Also if the justices as so focussed on text then they should take the broad interpretation just as they have with the 2nd amendment. They are so inconsistent with their appeal to text.

I read the Supreme Court ruling on 1st Amendment even in protected and unprotected freedom of speech. Yes political is more protected but also has higher standard to not break its rights.

How would the Supreme Court Justices respond if the Supreme Court were to be overrun by armed protesters while the court is in session? I hope the Supreme Court gets this right for the betterment of the Republic; lets not give the green light for groups to take over government buildings when issues don't go their way. I hope my post makes sense. This was a insurrection where people were hurt and killed while in performance of their duties; lets not water this down. Allow the process to work and let people have their day in court and let a jury of their peers be the ones who vote on whether a person is found guilty or not guilty.
