    The Brokers are in the wrong..... The Brokers change the terms on a load mid trip and charge stupid fees and penalties for everything.......They are only getting what they deserve...... Brokers should be paying on conventional loads what is equal to 1 1/2 time the fuel price in the most expensive area of the trip, ie.... if the fuel cost is $3.49 a gallon, then they should be paying $4.73 A MILE and no junk fees or ridiculous penalties for their stupid rules as justification.

      We definitely understand that, but it's hard to judge that over the DAT and LoadLink platforms. Perhaps if a face-to-face community were established and we were speaking to you in person we'd be more inclined to trust you with a load depending on that first impression, but I think far too many people overlook that we are seeing words on a screen and determining who to give a load to based on that and simply put, it isn't very reassuring that you can take care of a load if you haven't been in the business very long

      @@NorthAmerican-Trucking-News That's fair. It's why I do my best to speak with people over the phone rather than sending emails. Unfortunately, that's not always the easiest to do either. I just look at it as paying my dues while working towards that 1 year mark. Get the FMCSA audit done and get the new carrier stench off my MC.

      75% of freight or more is moved by either small trucking companies or O/O or Independents….
      The entire Continent of N.American is moved by those mentioned above.

      We aren't, in fact, we believe that owner operators are among the most successful in this industry, provided that they employ proper procedures. It's that we, personally, avoid working with new carriers with not many units

Virtually all of the driver channel comment sections are filled with long term drivers that have been watching unethical broker behaviors for years . He might as well make a video commanding the waves in the ocean to stop hitting the beaches . It would be more effective than trying to gaslight the drivers

    So let me get this right. You spend a bunch of time supposedly trying to give advice and help smaller trucking companies/ owner operators, but then turn around and say you won't give a smeller/ owner operators and newer company the time of day? Or am i reading into this wrong?

      If that is to be true, it's not the best approach, but we've heard from other sources that the brokers haven't paid the carriers prior to this and that's what has brought up this retaliation. We aren't sure which is the truth in this case

      @@NorthAmerican-Trucking-News Honestly, I think we all can understand your take on the matter ,but you have to understand this isn't Canada ,we don't play "I'll fuck you over " and we still be friends ." We also understand that small events like this ,have much larger consequences ,in other areas, but let me assure you that American's, won't do ,or go the route of what Canadian, truckers put up with for long . And almost bet ,that this won't be the last of these types of actions .I'm not making any threats but I don't have to be an uptight politician, to know that your only going to kick a dog ,so many times ,before he bites you ,because you kicked it.

    I purchased my first truck 60 years ago and I still own trucks. I think under no circumstances does a carrier have the right to hold a load hostage even if a broker short paid a load. Even though I started with one truck when I was a 20 year old kid, I am leery of start ups. Most of them fail and some of them do stupid things while they are failing. During the time I have owned trucks I was also on the board of directors and on the loan committee of a bank for many years. Although our bank never experienced it, I remember cases when debtors would build build a descent credit record and then when they thought they had borrowed to the max, they would disappear leaving their creditors holding the bag. I wonder if this isn't that kind of scam. Once they have collected their ransoms they will disappear into thin air. This is just mere speculation, but my guess would be that the carrier solicited cheap freight to get the loads and as planned took the loads hostage. I also hire carriers and I stay away from the cheapest as well as the new start ups. When a person gets to be 80 years old they have seen too many things go bad to take a risk on a new carrier hauling cheap.

      Well, circa mid 80s the procedure was to get loaded one more time for that broker or company that didn’t wanna pay! Then if you didn’t leave the state where you loaded there was nothing they could do except PAY! File Chapter 11? Didn’t matter. Go ahead……ask me how I know this!!!

      It's hard to tell, we've heard a lot of speculations and people saying they know what happened and simply put there are a LOT of takes on this ransom situation. I'm afraid until an official release comes from those involved, or a thorough investigation by the authorities is conducted, we just might never know

    I get exactly what your saying and respect your opinion. He's just giving an honest answer from a smart brokers perspective. I just think what these carriers did is hilarious as brokers in my opinion are greedy middle men who should and could be replaced by A.I. far quicker than any driver.

    Honestly, I can't figure out ,after all that's happened in trucking that ,it hasn't happened sooner and more often . I'm not publicly advocating for this ,but wonder with all the complaints about brokers ,WELL ?

    my understanding is these brokers owe the company money. so they decided hurt them financially just like they have been hurt by them now paying for services already performed.

      A broker wanted to charge me $100 because my driver wasnt answering the phone, even though i was responding and broker was awol during the weekend, we delivered on time, thats the kind of bullshit we are fed up with

      You've glossed over the deciding factor and that is time. Growing quickly and getting 50 trucks in 2-3 years won't guarantee that we'll work with you, because you'd still be a relatively new carrier. Having 50 trucks after being in business for several years AND maintaining high safety scores will assure us of 3 things: our load is in good hands, our load is being taken by a reputable source, and there are options available in case of emergencies, like being able to have the load delivered by a nearby driver

    30 years in this business never understood why you purchase a piece of equipment, insurance, authority and then be unable to name your price to do the work trucking is not the only business that does this Doctors are dealing with this as well with insurance companies do essentially the same thing they perform a service and insurance companies tell them what they'll pay. I do 1 thing and I do it very well you'll pay my price or or take your chances elsewhere I don't care. I DO NOT NEGOTIATE. I DO NOT MAKE EXCUSES. I've done pretty well for myself as an owner for 14 years. Stealing a load is WRONG holding hostage is the same thing.

      Trust me, it doesn't make sense to anyone involved. Unfortunately, with most service based businesses, it's a barter experience. Because one person is going to find someone else to do it cheaper. Whereas products are naturally accepted as they are. It's truly strange

    So here is a situation now, we booked a load from broker it took 9hr to load, day and half waiting at border as shipper didn't send custom invoice on time and than 4 hrs to offload broker said he requested for detention its been 3 weeks now and still waiting. Would it make my process faster if i hold that load until we resolve detention issue or should i wait more weeks to get detention and then bill just to wait 60 more days to get paid, I'm sure if i hold the. Load it was all my fault right ?

    I have been a shipper, an asset based company and now at a brokerage. For me what it comes down to is being a good business person so that the business is not just a one time transaction. Think long term and how does everyone benefit from not only one load but for many more to come. Treating people fairly is critical. That is what has allowed us to be in business for 20 years. There is no reason a load should ever be held hostage or that a broker should charge back fees that were not clearly communicated on a ratecon or in the contract.

    This sounds like it'll be a Class A cluster. Last I had read up on the topic, a carrier could legally hold a load until they got payment on the load in process but not against any other unpaid bills. It's been a decade since, so maybe that's changed.
    From what I've heard, the carriers were also requesting the back-payments and having any brokers that wanted the loads delivered sign a contract not to report or file on them. If so, I suspect that contract is about as effective as a lace doyle in a thunderstorm.

      If they are requesting back payment then that's an entirely different situation, but if they are requesting ransom, i.e, they are demanding more pay than what was initially agreed on, then we can't in good faith support that choice

      @@NorthAmerican-Trucking-News The Freightwaves article strongly suggest that they are going after back-payments, and the carrier conglomerate targeted brokers that had dinged them on the price due to "performance". Also, there was further notation that Agility had just recently updated their MC listing and primary contact, and the article indicated that a few of the affiliated companies did as well.
      If the carriers are refusing to deliver without the extra contract, I'm wondering if one of the brokers will get the bright idea of paying them and refusing to sign. If the companies in question don't deliver the freight after accepting payment, they'll be open to a wonderful world of legal options.

    I have a suggestion ET Transport has terminals both in Canada and the USA. There are many other UA-cam channels that report on the dire state of the trucking industry in the USA right now. I wonder if the Canadian trucking industry is in a similar or different situation than the USA market? Maybe you could make an episode to discuss the difference between the two markets or confirm that it is one big integrated market and that everyone is suffering the same right now. Thanks.

    I follow you I have my own truck just wondering your thoughts about working with brokers as I have had a couple that I wont work with because they didn't pay for the move the load was moved on time pick up on time delivery but after receiving bols nothing number no longer worked what are your thoughts on tricky brokers

    The major question that hasn't been answered is WHY is this carrier and affiliates holding loads hostage? Is it because they're not getting paid at all by the brokers, or the brokers aren't paying what they offered when Agility and its affiliates took the loads?
    There must be some reason.....

    Youre missing some critical information: all of these loads are being held hostage from brokers that screwed them over first.
    Is it wrong that theyre doing it? Yes. Is it understandable as to why theyre doing it out of frustration?also yes. I only feel bad for the customers that are caught up in this mess

With roughly 97,000 Russian-speaking drivers working in the U.S. trucking industry today, it’s plausible that Kutsko has organized a group of carrier owners and drivers who share his language and values to execute this load hostage scheme. It’s not surprising to see Russian gangster tactics infiltrating our trucking industry if the affiliate network is dominated by Russians.

    I have been working for CH Robinson sense 2012 never been late never had a problem with the load. I only have one truck and now they want you to have so many loads per month in order for you to do some there loads I consider myself to be a very reliable carrier

    You so wrong about one or two units because there’s most likely an owner operators that would probably provide best possible service. If companies have 200 trucks that company drivers will haul your load. Good luck with them. They don’t care about you and your load. There are many damage goods that company drivers hauling. Although Ron your are many years in business but you don’t have any glue about this business and how everything works. I am over 23 years in business and dispatch my husband. We had one truck and provided best service for our customers. We were not cheap because we knew our rates per mile. Brokers loved to work with us rather than with stupid company drivers that haul their loads like bags with potato. Don’t look for Google reviews because there friends and family write them. You probably was born like yesterday and don’t understand anything.

    Almost all of the contracts have this included. You have to be full of shit. Every contract Ive seen in the last 3 years has this addressed in it.
