These can include, inter alia, any requirements in the Contract; the records available; the timing of the analysis, i.e. during the currency of the project or post project; and the complexity of the matter etc. However, post project, my experience is that courts or arbitration tribunals prefer retrospective analyses where it is known what actually happened. To this extent, the as-planned versus as-built windows analysis has proven to be reliable in such forums.
