    "We knew we were right" says the head of the organisation which used emails obtained illegally, that had been edited in order to portray a misleading picture. They were warned by a portuguese judge who presided over the hacking case that using the emails was wrong. Of course under Swiss law it was ruled they could be used but also that they would then have to be evaluated on their merits, which led to UEFA's case having no standing. And that was because their case was mostly based on the emails and that includes the time barred charges, so they would also have had no standing.

      The whole concept of FFP is destroying the integrity of a league that has existed for over 130 years.
      FFP needs to be consigned to the history books, leaving a more financially stable division.
      How can the influx of investment provided by wealthy owners be a bad thing?
      Get rid of FFP, and by doing so, we will have a more competitive division.

      The proceedings before the Commission will, in accordance with Premier League Rule W.82, be confidential and heard in private. Under Premier League Rule W.82.2, the Commission’s final award will be published on the Premier League’s website.

    As I see it, and I am sure that the Man City lawyers will to, the PSR rules were flawed from the outset when brought in during 2013. The first role of the independent commision should be, and which they failed to do in Everton’s case, is decide if the system of PSR rules for regulating the actions of PL members was lawful and ensured that breaches can be enforced by the imposition of specified sanctions which it did not. The rules were rushed in without a sanctions policy or inbuilt review stages to consider things like inflation and case law on the impact of fans. I am sure the PL realised this when why they tried to introduce a sanctions policy/formula retrospectively to the Everton Commission Panel that was rejected and PL were admonished for attempting to change the goal posts. It is ironic that whilst they acknowledged the need for a sanctions policy by trying to introduce one midway through a hearing, that Richard Masters said the sanctions policy has always been an Open one for the commission to determine which we feel is fair! If the Commission hearing the Everton appeal had any sense they would dismiss all current cases including Man City’s as the PSR rules are fundamentally flawed. This would also get the PL off the hook and put the farcical situation to bed!

      I'm not really sure arguing about the rules in court is worth it. In the court of public opinion that's another matter.
      Facts are unless the prem has obtained new evidence then there really is no case to answer. The hacked emails were distorted (probably by the hacker in order to sell them), a German newspaper fell for the scam and ran the story. The original emails paint a pretty boring picture, the kind that takes place in accounting offices up and down the country.

    Of course Manchester City are guilty of many of those 115 charges. Otherwise the groundwork to put forward 115 allegations would have been done really unprofessionally by the Premier League.
    And more over, many of those 115 charges are very serious in their nature, much more severe than for example Everton's one minor breach, so the penalty to City should be outright relegation; even if Everton would get all their 10 points back, which would be a justified ultimate decision.
    The UEFA knew the handlings of City, CAS was timid to act.
    If the Premier League wants to avoid destroying itself completely, its commission should be brave enough to punish City according their breaches, and in relation to sanctions against other clubs.
    You can't argue that it's difficult to punish City because they are now so rich and successful and have top lawyers. In democratic countries, like Britain, those factors don't count, only the factual matters. So it's in the court rooms, too.

    I lived and worked in the Middle East for a good few years, and I can tell you in these autocratic countries, the leaders make others wait upon them for hours and hours - and then tell them how it is.     Regarding this story and as a small disclaimer I do like Manchester City for the way they play and have followed Guardiola since he was at Barca, I am also just a layperson, I am not a lawyer, barrister, work in a law firm or have a law degree, these are just my thoughts that come to mind.
    I do think that Simon is correct in stating this is a serious issue, which Manchester City obviously understand, however, it is one thing proving that they there has been a breach of FFP due to overspending such as Everton and Forest and another thing entirely where they are in essence accusing not just Manchester City but City Football Group, UAE and its associated partners of systemic fraud.
    Also, take into account that one of the owners of City Football Group is Silver Lake who are not stupid and would not have funded half a billion pounds in 2019 into City Football Group without doing due diligence.
    Then of course there is Marcelo Claure who is part owner of Girona and once had a stake in Inter Miami before selling his stake to Beckham and was once CEO of Softbank.
    Also, a large amount of these charges will also have to deal with limitation periods, just because the Premier League as far as I am aware doesn't explicitly advise these don't apply or do apply, will mean, I would argue that the independent commission alongside trying to consider that there is this amount of fraud in this case will also have to take into account whether as it was in the CAS case that the Premier League have simply left it too late to challenge any particular breach, as they six years as per the Limitation act from the date of knowledge to put forward a claim.
    If the independent commission agrees with that, then I can imagine there will be arguments as to what the date of Knowledge actually was if it was when Der Spiegel released the news story about Rui Costa and the hacking of Man City's servers then it could be argued then they are just within the limit if however, it was when the breach occurred then a lot of these charges could get wiped.
    Also, although having looked at the rules of the Premier League they allow any information that comes from reliable means, so I can imagine that could be argued as well, considering this whole thing started due to the illegal hacking of their computers, so I would argue that there would be an issue about the fruit of the poisonous tree.
    Then, of course, there is the matter of the release of information, I remember that there was a listing of a Court case between Man City and the EPL which was quickly removed, no idea why it was there but it wouldn't surprise me if it was about the release of confidential information as there may have been an argument between the two entities about whether Man City had a legal or contractual requirement to release information to the Premier League if it was commercial sensitive in these circumstances which the Court had to adjudicate as an example.
    If I a simple layperson can come up with this, within minutes of the video, it is no wonder it has taken so long to get to this stage when you have an eloquence of lawyers, just my 2 cents. :P

      Small disclaimer, the PL invited city to cooperate in this case, opened the doors for them. They have willingly declined to do so, one of the charges. On the evidence the PL gathered there’s 115 charges, when city start to defend themselves and provide info it could be another 115. If Everton are being taken apart over PSR and fined, city are screwed for year long fraud. The second Everton were docked 10pts it’s a precedent. City are next & all others who cooked their books. It’s football not a billionaires plaything. This is a real disease in the game & needs to get back to the most important thing football. City are the best team in Europe, how they got there that’s all on their owners. No blame at Pep or the team & its fans. But the mgt that’s where the problem is

      So city stopped cooperating and got fined.

      Having looked at the rules, Man City were not exactly invited they are required to cooperate in a similar vein to UEFA, however, from what I understand from legal circles it is perfectly normal for one side or both to delay, prevaricate and cause barriers to be created.
      Regarding Man CIty providing information and more charges being presented, I don't think that can happen without the Premier League starting a new investigation and setting up a new independent panel as per its rules of association
      Regarding Everton and Forest, it is a completely different scenario and is relatively straight forward where it is a matter of calculation and determining whether you are or not breaching a defined limit.
      Regarding Man City, in essence, the EPL are attempting to prove fraud which is obviously a lot higher standard than someone breaching inadvertently or otherwise FFP due to a difference of opinion in calculation.
      It is not a clear-cut situation where Man City are guilty, as it is innocent until proven guilty and it depends on whether the EPL actually has evidence that actually proves its charges, just because it thinks it has doesn't mean Man City are guilty is what the independent panel is there to determine.
      Also, it depends on how the independent panel is going to rule as the situation is spread over 9 years, there are bound to be differences in the rules and any lawyer worth their salt is likely to be able to exploit this
      If they are found guilty, it depends on whether the rules that are breached are sporting, technical or serious ones
      Even when the decision is made, it still remains open for either side to make an appeal to a different independent panel in the same vein as Everton and Forest.
      It is also possible for them, should they feel that they have a strong enough case to appeal via the Courts, not CAS the domestic Courts but as it is an Arbitration award it would be very difficult to overturn as far as I understand it. @@patcronin9132

    It is blatantly obvious that in Everton’s appeal case the independent commission should dismiss any charges as fundamentally the PSR regulations have been systemically flawed since they were introduced in 2013.
    This is because they had no related sanctions policy/formula based on the principles of proportionality as essential components to consider if any breaches are to be properly addressed. They should also have had an underpinning policy to regularly review the regulations to consider such as the impact of inflation particularly on spending limits and also case law on the potential impact on fans.
    In addition the PL should withdraw all charges of breaches against all clubs and look to introduce the UEFA regulations as long as they have the necessary underpinning policy’s. This would allow the PL time to address the mess they have put football in including the farcical situation of the transfer window, and look to how they should support all clubs to fulfil their ambitions and potential to improve the game overall.
    I am sure Manchester City’s legal team will rip the current regulations to shreds and get all 115 charges dropped and if the PL had any sense they would accept that the current rules are unworkable. They have as good as admitted this when trying to introduce a sanctions policy during the first commission hearing which was quite rightly rejected by the panel who admonished the PL for doing so.
    It was excruciating watching Richard Masters in parliamentary hearing saying the PL have promoted an open sanctions policy for the independent commission to decide upon based on the circumstances which the PL thought was fair, then says they are changing the rules to UEFAs. This was an admission that the current rules are flawed and an utter embarrassment. It is also obvious that the PL forced the panel to impose a 10 point penalty based on the sanctions policy that they tried to introduce retrospectively and the ‘independent’ commission allegedly dismissed!
    What has also come to light in this debacle is the corrupt relations PL has with the media inc Sky and leaking stories to certain click bait journalists who are trying to be relevant. I for one will never read the Daily Mail or The Athletic again or listen to the self obsessed clueless wannabe Simon Jordan on Talk-sport and I urge all football fans to boycott them until a more balanced form of journalism is adopted.
    Bring on the independent regulator and get football back into the interests of the fans. 👍

    This will leave cristal clear one of two things: either that the Premier League is really the most organized football league in the world or..... that Manchester City is a monster way bigger than the Premier League itself than cannot be stopped even with 115 charges on the table... Like a mafia that is just too big to stop and it's above the law

    Difference is a westener going to a country like Saudi Arabia doesn't get everything catered for them. Where as an Arab going to a western country has everything they need.

    Well, duh. It was CAS who found that the main basis for UEFAS case (the leaked emails) were mainly selected parts of emails, from which certain information had been deleted. One purported email was in fact a combination of two separate emails. This gave a somewhat distorted impression.
    In other words CAS ruled that their case was built on faked evidence.

      I don’t think a deal will get done here Simon. If the 10 pt deduction for Everton sticks with threats of more to follow & a deal is done for city then the premier league is done as a competition. It will have no further standing & it will be a free for all. All clubs signed up for FFP and clubs that knowingly break this and are openly fraudulent should be relegated, it’s disgusting

      Which is true and I think is disgusting. A serious shortcoming of our justice system if is just about applying procedures and finding failures enabling to avoid penalties for obvious offences, without any room for common sense or human intelligence.

      @@BambinoAmericano I'm not so sure if it's an indictment on a properly working justice system as opposed to a system like UEFA (and our FA) where the judge and jury are the same.
      In the original case UEFA were the prosecution and UEFa were the judge. This happens in our Football system where the FA acts as both judge and jury.
      Why anybody thinks it is prudent to cooperate with a prosecutor who is also going to be your judge is beyond me. City have always cooperated with proper judicial systems which is why they cooperated fully with CAS.
