The 'red meat' has been fed by right-wing media increasingly since the late 80s in particular when Rush Limbaugh exploded on the scene. The amusing thing about LegalEagle videos (and other Nebula creators) is that while Devin is one of the main creators on Nebula and asks people there to give him feedback, there is no comment or chat function on Nebula. You have to come to UA-cam to make comments on the same video posted here. So here goes... Personally, I think the J6 committee was a success in that it documented what happened and who was to blame, but it's somewhat limited power means that for it's work to reach fulfillment, it requires the Justice Department and courts to act on its information.
Could the fact that he didn't act on the insurrection for 3 hours be something that they consider for the "aiding and comforting" charges? His inaction certainly contributed to just how far they got, and likely emboldened some of them with how little resistance they were met with. Sort of like a security chief having the on-shift watchman "just ignore that jewel thief over there", as it were.
I think so-- and him telling people he supported it, and that Pence deserved it, and that he was watching it unfold live and did nothing [despite almost everyone around him, including his dear soul mate [Ivanka], telling him to call them off]. These are all meaningful factors in providing comfort/aid to insurrectionists. In a functional Republic, he would be tried for treason by a military court
I think that's part of what they're relying on, yes. The question is whether practical inaction is an actionable offence. It generally isn't an offence to stand by and let an offence happen, so did he have a legal duty to act that he didn't fulfill? Moral duty, certainly, and that might be enough for civil responsibility, but may not be enough for criminal responsibility.

Treason is the third category of crime, above felony and misdemeanor. A conviction for treason permits not just a death penalty, but a cruel and unusual death ("hanged, drawn and quartered"), and seizure of the traitor's wealth and any other rights ("attainder"). §2383 and similar felonies may cover the same ground as the constitutional limits on charging treason, but that doesn't elevate them to treason. Imagine trying to apply the Greathouse reasoning to a misdemeanor that resembled a felony: "Your Honor, dropping a lit cigarette in a wooded area may indeed be littering, but it also counts as arson, so this misdemeanor charge is improper."

14:50 - "...treason was only applicable if a foreign country levied war against the United States" This comes up often, but it makes me curious of the question - as a lawyer, what is the definition of "or"? Because treason is defined as "...levying war against [the United States], *_OR_* in adhering to their Enemies, giving them aid and comfort." Colloquially, the word "or" generally means that at least one of two surrounding statements, but not necessarily both, must be true for the condition to hold. But in this case, and basically any other time I read some law people are arguing about that contains the word, people tend to read "A or B" as "A or, but really, A, please ignore B". It is really annoying. Applies also to the punishment for treason - people like to trot out "the punishment for treason... IS DEATH!" when it's actually "death... or a pretty mild fine (not adjusted for inflation) and like 5 years in prison" iirc.

I remember when the campaigns were running for the 2016 election, Trump suggested that Clinton would take Americans guns, I literally saw him say that the second amendment people will know what to do. He showed the world exactly who he is that day. Nothing that came after shocked me.
GOP candidates love to claim that the left is coming after their firearms. Every time they make that claim, sales go through the roof. (There's a reason that firearms manufacturers love the GOP.)

The 'red meat' has been fed by right-wing media increasingly since the late 80s in particular when Rush Limbaugh exploded on the scene. Then you had people like dinesh d'souza, and laura Ingraham stirring up hostilities by getting very controversial and nasty towards liberals, and because their comments were so shocking the media picked up on them, and they gained a large following from disgruntled whites. The red meat filtered through congress with Gingritch, and just got worse and worse over the years.
Or telling them "we love you," and that they were "very special ppl?" Lol
I think that's part of what they're relying on, yes. The question is whether practical inaction is an actionable offence. It generally isn't an offence to stand by and let an offence happen, so did he have a legal duty to act that he didn't fulfill? Moral duty, certainly, and that might be enough for civil responsibility, but may not be enough for criminal responsibility.
NO. Don't be stupid. No one can be charged for not doing something. All these pathetic corrupt politicians would be in jail just over the George Floyd riots if this was the case. Politicians even said to do something, which is worse. They didn't get charged, or botted from office.
It's hilarious to me that, after 9/11, our country invested BILLIONS of dollars into hardening federal buildings.
A riot of rednecks still got into one of the most important buildings in Washington. Donald Trump didn't control the security, so... How is it his fault?
If it does go to trial, how would you even begin to form an impartial jury for something like this?
Good point, anyone who claims not to have a pre-existing opinion of Trump is either a liar or a moron.
It can be done.
Use a jury from us territories like Puerto Rico that cant vote on the President.
Probably will end up with a settlement anyways
It will not even see a jury, bets bet would be a judicial panel. A judicial panel is a group of judges selected from all the judges of a particular court. Usually, this panel refers to the three-judge panel that constitutes a federal appellate court in accordance with Section 46 of the Judiciary and Judicial Procedure of the United States Code.

The 1863 case referred to at 14:42 was US v. Greathouse, in which a learned Supreme Court justice somehow got confused about the nature of treason.

I would GLADLY ditch my Netflix and Disney+ subscriptions for exclusive LegalEagle, Hbomb, Patrick Willems and Linsey Ellis content. This is the second year in a row where I contemplate a huge holiday break without Nebula :(
On a different note, did you have something to do with the wonderfully short and crystal clear Nebula Terms of Service wording?
14:59 Impeachment is an adminstrative action, like a disciplinary review before getting fired from your job, rather than a criminal proceeding. Getting convicted by the Senate imparts only one punishment: Losing your job and _not_ your freedom. Hence there is no double jeopardy because impeachment does not imperil the defendant's liberty nor property.
Let's go! Finally the law starts catching up to the orange parasite!

@@jaxsterminator8634 ...We just watched the same video, right? If you believe in democracy you can't just throw it out when things don't go your way.
@@Cheshire020 DEMOCRACY SHOULD BE ILLEGAL

@@jaxsterminator8634 Go bother the far right, troll. Their reactions will be funnier. 😄
Many of them need to be in jail, not just dumpo.
14:50 - "...treason was only applicable if a foreign country levied war against the United States"
This comes up often, but it makes me curious of the question - as a lawyer, what is the definition of "or"?
I just hope there's enough people in our government and justice system, from both parties, with the integrity needed to stop any future attempts. Because there WILL be future attempts.
Ok, I'm definitely getting Curiosity + Nebula
Why?
@@mousermind honestly, the sale. I've been waffling back and forth about getting the two for a while and the sale was enough for me XD

I'm subscribed even though UA-cam is a better way to watch their videos. They deserve the money more than google does
I think it’d be interesting if you covered Angels in America, though there are no courtroom scenes.

Biden should be in jail
They're probably rattling the bars screaming about Hilary's emails

@@superk9letsplays419 She incompetently handled emails, which got leaked. A rather large issue with many congressmen, since they're almost all old. Trump's daughter had the same issue with leaked emails, but it was glossed over in the rolling news that was Trump. They all might be corrupt af, but the email issue isn't the smoking gun many think it is.
So, i got a question... when do people of high status actually be eligible to go to prison? Since it kinda appears they dont have to most of the time where a normal man has a lifetime sentence already.
If trump were normal, he would have been in jail over the classified documents.
People in high status can afford high end attorneys, as well as filing never ending appeals, which can be very expensive. But eventually, it will all catch up to them. You can only appeal for so long.

I must say I really love that description you put underneath all of your videos, befitting of a lawyer’s UA-cam channel.
i hope everyone who is coming forward is protected in some way because some of people worship these politicians like they are gods and will do anything for them.
Yup, the US really need to step up their law enforcement efforts vs domestic terrorists to the same level they are pursuing international equivalent movements like IS and Al Quaeda.
Thanks for simplifying important events and helping educate the population in a fun and creative way

I can vouch for Nebula, I always watch content there if it is available. I'm glad you guys are keeping it going.
I want to see it because it has Issac Arthur.
I stay away because it has Anita Sarkeesian.

oh my god, it's the two year anniversary of Jan 6 in 2 weeks, it feels like it was just yesterday.
9:22 - As an experienced carpenter and joiner, I just want to say - you know what? Never mind...
"What were the Jan 6th committee basing their criminal referral on?" It was based on the crime we all watched him commit on live TV. I know in lawyer speak there is a lot to talk about here. Just saying, he is guilty. As guilty as a murderer caught on live tape killing the victim with a close up on their face while doing the deed.
Charles Manson I find is a good comparison.
i think ketchup on a porcelain plate is such a wonderful metaphor for the type of ridiculous mistake of a person that trump is.
I dunno, ketchup should be enjoyed, regardless of class, without shame.
I literally come to this channel for my news more than big news outlets. Everyone has an agenda, except a nonpartisan lawyer. Knowing only the facts of what's happening and a lawyer's expertise on what means what is a lot more valuable than talking heads pointing fingers for an hour.
From the nebula video, "Thanks for watching on nebula, if you agree or disagree, let me know."
You know we can't comment on nebula, right? ;)
