Five-month-old Evan Karmel dies suddenly and is found to have been poisoned. Suspicion falls on his au pair Lila Crenshaw. She is arrested when Briscoe and Curtis find evidence of her buying pesticide the day before Evan’s death, and her personal diary in which she expressed frustration toward Evan. The case against Lila rests on the idea that she was unhappy with the Karmels and wanted to return to her home country, but she couldn't afford the airfare. However, the prosecutors know a jury may not be convinced this was enough to drive Lila to kill; and the defence has already had her diary excluded as evidence.
At trial, more damning evidence comes out about Lila, including the fact that she was previously fired from another childcare job and that Evan had other "accidents" whilst in her care. The defence, in turn, suggests Evan's mother is to blame; she has a demanding career and is rarely ever home, so she hired Lila, an inexperienced teenager, to care for the baby. The case returns a hung jury, and now the prosecutors have another trial to prepare for. Things change when Kincaid and McCoy catch Evan's teenage brother Ben in a lie about seeing the pesticide in Lila's room. They initially think he's trying to get revenge on his brother's killer - until they discover he knew she'd bought pesticide for her plants, and that he skipped school on the day of Evan's death. Ben turns out to have killed Evan because he believed his parents were unfairly neglecting him in favour of the baby. The prosecutors allow the defence to lure Ben into confessing on the stand, and he is charged with his brother's murder.

Man after watching this episode years ago this left me in a complete shock I mean it shook me out knowing that was the sun all along it almost felt like screaming
This is heartbreaking. That poor little baby.
To say this clip was dissatisfyingly short it an understatement.
So was that baby's life.
I used to think that this episode was inspired by the Louise Woodward case, but when I looked it up it turns out that this episode came out a year before the real life murder. The similarities are sort of eerie though.

Law & Order episodes are usually taken from the headlines. When the subject matter is little bit "tweaked" fans still know...especially when its in the headlines.

This couold be my favorite episode of all. I love when, after McCoy tells Dr. Olivet she's an expert in the psychology of murder, that she replies something like that's the nicest thing he'd ever said to her, haha. The defense attorney and the unfolding courtroom drama in general are very good too.

Fun fact, this was adapted into the Law and Order UK episode "Shaken". As you can guess by the new title, the baby in the UK episode died from Shaken Baby Syndrome, not poisoning.

@@RLucas3000 No it was the husband’s ex. She couldn’t get pregnant and was jealous. She visited the baby and while holding it, she just dropped it out of despair for the baby she never had, so death was shaken baby syndrome
His son killed the baby and framed her out of jealousy as I recall
Youre correct, i dont remember if she was convicted before they found out it was him or before.
@tahnalos It wasn't overturned. The babysitter wasn't convicted, it was a mistrial, the jury hung.

There was a case on Forensic files that was a little like this, a little girl from a migrant family died on the porch of their apartment. Turns out that the landlord had been forging signatures on safety waivers for all the tenants, and that the paint on the apartments still contained lead. Which the baby had eaten. The only reason the police found out they were forged was because the mother hadn't yet learned how to sign her name and had been marking her signatures with x's instead.

This was just sad. A baby died because of a selfish, cruel father having a midlife crisis and dumping his son for the young wife and baby. 😢

They should be put to sleep on their backs yes . Some babies turn themselves over onto their stomachs
I suspect when this episode was filmed that may not have been the standard advice it is now. It was 1990. Really can give you a glimpse into history for things you never think about.

No, cause if he spits up in his sleep he Hendrix's... Sleep on belly is how I was always taught, choking has them spit it up & hopefully droll it out instead of being unable to sit up coughing or turn over, so they choke suffocate & get fluid in the lungs all because of being on the back... I've never heard of sleep on back!! It makes more sense to prop them up sideways to allow choking to aid, but pillows or toys can smother so it's the lesser of two issues...

@@zacherymayer4847 Maybe in 1990 it wasn't widely recognized that back sleeping is better. 🤷🏼♀️ One of the downsides of trying to find "clues" in old shows just from casual watching.
back then stomach sleeping, crib bumbers, toys in the crib, and blankets were all part of putting baby to bed. for decades that's what you did. research changes things all the time and now we know safe sleep practices. unfortunately it doesn't save all babies from SIDS

She's English (although the accent isn't great..!), and au pair is another term for nanny, although au pairs usually live with the family and get a monthly allowance, whereas a nanny comes during the day and then leaves and is paid a salary
It’s a fancy term for a slightly different kind of nanny
And just to be more precise, an au pair in addition to what was already said is a foreigner to the country they work and live in (for a limited amount of time), part of sort of an exchange program limited to young people. Often limited to young women, too.
