If a person doesn't either opt-in or opt-out they don't go on the list. They will however be 'presumed willing' to donate. If the family is always consulted anyway, and they flat out refuse donation, presumably the medics are not going to force the issue and there will be no donation. So, if the family are always consulted and can refuse, how is this actually any different than it was before?

the issue comes when they cant contact next of kin for someone who wouldnt be ok with their organs being harvested
