    Question: If an employee does not want to return the Certification of Health Care Provider because they do not wish to use FMLA leave, what steps should the employer take? Answer:
    🖍 Keep a record of the communication with the employee regarding their serious health condition and their decision not to return the certification form.
    🖍 Clearly inform the employee in writing that the certification is necessary to determine their eligibility for FMLA leave and that without it, the leave may not be designated as FMLA-protected. Explain the benefits and protections that come with FMLA leave.
    🖍Explain that if the certification is not returned, the absence may not be protected under the FMLA, which could impact their job protection and benefits during the leave.
    🖍 Offer to assist the employee in obtaining the certification, such as providing additional time if needed, or helping them understand the form and its importance.
