Agree with you totally, brevity is key to helping them say yes to a claim. I supplemental claimed on a 4138 and *started with my summary* and THEN listed my why- fors they should find in my favor. I think they get a lot of forms filled out that look like they were written by a teenager describing a UFO abduction, who the hell wants to figure that out, just make it as easy as possible for them to say yes and move on to the next claim.
Thank you very much. I already have 10% for Tinnitus, but someone in VA really did all the work, including the appeal. Now I am starting a claim for rash, MH, and hypertension. Holyshamoly, it is really difficult to figure what to do, without screwing yourself somehow. Thank you again for your time.
Greatest Video, granted 100 P&T effective 1/21,VA recently said after a review my PTSD increase is now deferred because my dbq was based on DSM4 and not DSM5. Now they wanna send me to a c&p exam with VES. that’s so unfair considering they already made a decision based on DSM4. Thats not my fault.
I'm a RVSR used to be a VSR no one is going through all that paperwork...all we do is control F for what ever you're claiming to make a decision or to order an exam
When I rated, I only looked at what I needed as well. Question, why are some VSR's requesting C & P exams when veterans submit actionable and sufficient DBQ's and/or nexus statements? A VSR tried me on that right before I retired (I refused the C & P exam and the rater used it to rate my claim), and some RVSR's are not granting it and the vet does a higher level review and the DRO use the same information to grant. It seems like a waste of time and prolonging the claim. What does QRT think about that, is anyone there pulling quality reports and getting errors when this happens? Thanks for sharing
@@DewayneKimble well what is supposed to happen is when VSR receive a private DBQ they are supposed to put a RVSR examination special issue flash on the claim and add a RVSR complex review examination tracked item to the claim, this procedure routes the claim to an RVSR for a review to see if they are discrepancies on the private DBQ and if there isn't we take the Private DBQ/ Nexus at face value. Now let's say they ordered the medical opinion any way. Then we have to weigh all the evidence and if the VA examiner gives a negative opinion and the private doctor gives a positive opinion then we grant in favor of the veteran, assuming the private doctor wrote a well thorough statement acknowledging that he reviewed all the evidence and meet all requirements and etc..Besides the VA law allow us to rule in favor of the Veteran in these situations. Sadly, like you mentioned in the video, many VSRs just want the production points for ordering exams. But what helps veterans combat this is if they write on their 4138 that they DO NOT WANT A C&P EXAM That really force VSR to not order the exams.
@@hggfu Thanks for sharing, I wrote that on mind when I was a rater and the VSR requested one anyway but when the RVSR received it, they used it to rate my claim. I'm hearing from veterans every week that the C & P exam is being requested and when the veteran goes, the RVSR is using it over the private doctor and not applying reasonable doubt. When they don't go, the RVSR is not granting S/C and/or the increase. Not in all cases but most. This is where the veteran has frustration. Your example (the 38CFR and M21) is not being applied across the board. Thanks again for sharing. Is it still 79 production points every pay period for raters?
@@DewayneKimble no problem sir your channel is awesome. The production points is based on the amount of experience a rater has. I want to say 6-12 months is 6.3 points a day which will add up to 63 points per pay period 13-18 mo this is 7.0 points or 70 points per pay period.(this is what I have to meet) There are higher production points from 19-24 months and 25 months and above, just not sure what their production standards are but it's up there for those guys...LOL
@@hggfu I was well over the 24 months, and I think it was 79 every 2 weeks, but they took away excluded time and points to request exams and gave that duty to the VSRs. I am about to file for PTSD ( combat) I have my dd214, diagnosis, doctors statements, and personal statement. I have already secured the intent to file notice and the VA acknowledged. My question is, what other forms should I put with this. Thanks for your service.
@@DewayneKimble I was in a combat arms mos, still have all the symptoms …. Experienced plenty of all the so called stressors. Just wasn’t sure of any forms I may need to include other than these items, thanks. Been seeing a VA psychologist for a while now.
Wow, you took me back with this one. I'm going to have to do a video on this. If someone submits tons of paperwork but the VA employee may not be able to get through all the paperwork. Vets can submit as much as they want. Good question. Like I said, you took me back with this one.

My husband was recently service connected for hearing loss and tinnitus (0 % for hearing loss snd 10% tinnitus). He will now file for depression for which his primary care doctor is prescribing meds. Major depressive disorder is shown on his primary care medical records. Would copies of those medical records showing that diagnosis suffice for a doctors nexus letter which we can gather immediately thru the patient portal. He’s Ready to submit the 526ez but still waiting on nexus letter from this particular physician. Hate to keep waiting.

Honestly this is the step I am stuck at. filed intent last November 2021, Lower back MRIs show DDD ruptured disk,lets just say very bad-documented many back pain,injuries in my SVT's my cervical is the same ON MRI stenosis DDD Bulging disk but only a bad AC Seperation on STR's and head would with stiches from an A7 Radome slamming on my unprotected head. GERB in STRs Sinusitus in SRTS many times-antobiotics prednisone-all these issues still being treated for 32 years after Discharge. Throw in Anxiety for years from pain,worrying about how to continue working long enough. how the heck do I know what to submit? i gathered Alot of great test and doctors notes to include a lazy doctors nexus written into his notes stating his medical opinion is more likely than not these issues are related to my military service as indicated in the military records i presented. I left Anxiety out so far because I still dont know if i can submit my years of treatment from my PCP including meds for a secondary claim and hope a C&P will work? It is difficult to get my busy doctor to write full letters and a DBQ Is too long for all these issues,so it turns doctors off on helping Too much time. Sorry i didnt want to write my life story here lol but I could surely use more videos exactly like this. Love your straight out explanations and references to how you handles your claims. Wow, i want to file for a increase for my anxiety but man that's a lot of work. So we have to go retrieve our medical records by ourselves if we want to file for an increase? Since I got out of the military, we moved to 3 or 4 different states and I've been to so many different clinics and emergency room for my anxiety. Is there a place or anywhere where I can get all of my medical records from one place instead of having to go to each individual clinic/emergency hospital for my records?
Why would you need the medical records since you are already service connected, do you know the criteria for the percentage you are seeking is the question.

When I got out back in 2008, I got service connected for anxiety for 10 percent only, about 2 years ago my anxiety has got alot worse to the point where I can't drive or go out in public anymore, I'm always on the edge of getting a panic/anxiety attack everyday. I don't really know the criteria for the percentage that I'm looking for, new to this stuff.

What does it mean when the VA does a Procedural or regulatory review of a claim that I have already won? Does anyone on here know? I can’t find the answer anywhere and when I call the 1800 number they don’t know either.
Was that put in a letter to you of that action. It sounds like a review by the quality review team or a review to determine benefits based on a discharge from service if it's not honorable. Without looking at any information/evidence. PTSD has stressors. Also, the criteria for 0, 10, 30, 50 etc for all mental conditions.
