Can We Work / Train at Clients site during our CPT period which can be generally utilised for Internship or Co-op ?? Generally what will happen if someone does his Co-op /Internship at clients site but not utilizing his OPT & working under CPT regulations ?? Is the Same OPT extension rule is still applicable to CPT also ?? Please can you answer this ??
What about employees of bonafide IT service companies like Infosys, Cognizant or Deloitte who has most of their employees at client sites? Is that situation any different from staffing agencies regarding this new interpretation of STEM OPT guidelines?
No, the new policy does not discriminate against smaller firms. The big firms will have similar problem and will either have to directly hire the STEM OPT employees or have them work remotely at the consulting firm's location using technology to connect them onsite and only have the STEM OPT employees visit the client location when needed instead of being stationed there.
Thanks for the clarification. This brings me to your advices in this video. Firms like Infosys and Cognizant have very small in house establishments mostly working as sales offices. Thus their teams work at client location and these teams are usually big reaching 100 members or more at the client site. As several of those employees are on H1B these clients usually provide authorization to ICE for inspection. And ofcourse the mentor or manager (from the employer) of the OPT employee will be at the client location as well. Coupled with that, following your guidelines in this video should be relatively safe I presume.
That's a sharp observation. I would like to add that this issue is probably being aggressively lobbied behind the scenes. ICE may retreat from the new policy or provide clarification about access to the work site and additional requirements that will satisfy the bona fide employment relationship. So, in other words, we will see what happens (a la Donald Trump).

I just want to confirm with you once again as you made this video in May according to April rules. Don't mind bothering you again but there is no where written on the websites about not allowing anyone to work from home. I called USCIS support and they told me there is no such rule of not allowing employee to work remotely from home. Just to add a note to my case: I do visit my employee location once in two months for meetings, trainings etc. But most of the work is from remotely from home. I am not working with any staffing or any consultancy or anything like that. Just direct employe. Please clarify again. Sorry for long comment.

What would be a good strategy to get STEMP OPT approved if the student were to work through a third party staffing agency but work at the location of the client (ultimate company hiring the student)? My employer A is E-Verified through employer B, employer B is a Professional Employer Organization (PEO). Employer A and B are co-employers. Will this relationship work for STEM Extension? My employer A is E-Verified through employer B, employer B is a Professional Employer Organization (PEO). Employer A and Employer B have a co-employer relationship. For E-Verification purpose, the Company Name, and the Client Name is the same as the employer B (PEO) name, Company ID, and Client ID are also the same numbers. Employer A's name is not listed anywhere for E-Verification but all employees that work for employer A are E-Verified through employer B (PEO). I have to list my employer A's name and EIN number on form I-983 as employer A will fill the Training Plan for me. However, on form I-765, I have to mention the name of Employer B (PEO) as their name is listed for the E-Verification purpose. How the USCIS will look at this case and will they reject my STEM Extention because I mentioned two different employers on two different forms? Who should be reported on the I-765 form? Now you would wonder if employer A has the E-Verified Client Company Identification number? The Company client ID is the same as the company ID.

My contract is up to December 2018. But because of this rule, my current employer wants to end the contract now. I know one new employer in Austin who works for the same client and also have their office in Austin. I would like to join the same client with new Austin Employer? Can i do that ? Any suggestions for me? I am not hoping for H1B visa, i applied this year but not selected. I have last chance next year, if possible i will try. Right now it's difficult to find a employer who is willing to take OPT students and hence I choosed staffing companies who can help me reach employers who are willing to take OPT students
I think this problem is more unique in the Indian community because 99% of my Chinese clients on STEM OPT work directly with employer and they seem to have no problem finding a direct hire arrangement. All I can say is good luck and keep looking!

Jack Sung that's true. Also the ratio of Chinese students applying for jobs is way too less
