- This video is on Citizenship Amendment Act CAA 2019. The objective of this bill is to give citizenship to illegal migrants of Pakistan, Bangladesh and Afghanistan belonging to Hindu, Sikh, Christian, Parsi, Buddhist and Jain communities.

In my understanding - There was no better way to address the problem.
👉We have similar provisions, like
1. reservation is based on caste, because backwardness is somehow related to caste based differences/discriminations (of past).
2. Minority status is based on religion.
In this (CAA) case persecution is based on religion.

... if you read out the whole CAA bill or act ...you will not find "religious persecution" there...not even word "persecution" written in the bill.
@@kamilraza8722 true. Neither (religious) persecution nor (religious) minority is mentioned in the CAA. In fact, they clearly mentioned 6 religious groups.
My view :
1. Is it possible for someone to prove that he/she is persecuted? It may be possible for someone. But definitely not possible for everyone.
Suppose one house has been burnt by persecutors and the whole family got killed and then rest of the villagers crossed the border in fear (or to escape) of their persecution. [maybe it sound hypothetical but DATA and News shows the worst situation of them. ]
So they are deemed to be persecuted.
2. We can't be dependent on the parliaments of these three countries. If we use a term like 'religious minority of Pakistan' and then they amend their constitution and give a minority status to a small number of people (hypothetically some 5000 people's group) or they can assign a non-Muslims group to a second majority/ non-minority. This can become a loophole in the Act itself and we will be dependent on their constitution while applying our Constitution's Act.
So the government is saying different things and the Act shows a mis-match in their words. What's their intention ?
To know the intention of the government we need to refer the 'on record ' discussions of the parliament.

If they had written persecution in bill they had to include other persecuted groups like Ahmediaa in pak..,Hazaras in Afghanistan (persecuted by Taliban .), Rohingya in myanmar which they not included i dont know why( becz 2013 UN said ..word most persecuted people)..

#mythought on article 14. It says "state shall not deny any person". the bill is only reducing the years of some community.other communities can still enter through legal means if they want citizenship.

I concur, other's aren't being denied citizenship, so the argument of opposition stands falsified. Also, claim over citizenship isn't even a right, the grant of which depends solely on the statute legislated by Parliament and discretion of executive government.
Rather bestowing citizenship upon those who are persecuted on the basis of religion is in coherence with the recognized principle of non refoulement of refugees save infiltrators/illegal immigrants.
On the second note, SC can't question the wisdom of Parliament regarding the intent behind the passage of any legislation.
@@NoneOfTheAbove123 Reasonable classification test and conditions under article 14 is met, so the legislature have had given strong case for providing exception to the minorities of these 3 Islamic countries.
Actually this bill is introduced after NRC in NE,,,and in this 1.9mn have been declared illegal migrants,,by this amendment all communities still can become indian citizen and what about muslims they will either be thrown out or will be jailed.
@bscrazy007 in the NE the protest against CAB is not based on religion. The protest is to protect their delicate and distinct culture and language. And the protest is based on demographic facts found in Census 2011 and Tripura is the lesson learnt.

About Article 14, I'll clarify here that "any person" includes non-citizens as well. This isn't a loophole in the constitution. Constitution uses word 'citizen' specifically wherever required, you may check Art. 19 for an instance.
Also, Prohibition of discrimination is in Article 15 and not in Article 14 as mentioned here in the video.
Agreed Article 14 is available to everyone irrespective of his nationality.

Sir, IMPORTANT: The article 14 text that you have shown in VIDEO is wrong. Someone had edited the site purposefully after this CA ACT came into force. The actual text of the act ends at "........ territory of INDIA." There is nothing beyond that.

Article 15, 16, 19, 29, 30, are applicable only to Indian citizens. While rest of the articles in part 3 of the constitution are applicable to both indian citizens and foreign nationals. Refer for 9:10 .

Article 14 : I think this Article does not apply to the foreign indigenous people. It directly says " The state shall not deny to any person's equality before the law " WITHIN THE INDIAN TERRITORY." Means NOT OUTSIDE THE COUNTRY.
