For PDP to go to court to defend 27 lawmakers as a valid law makers is a testament to the fact that PDP IS NOT IN PEACE WITH FUBARA
The so called pdp presidential candidate has been silent on all matters and he expects to rule Nigeria when he cannot even control a single state or should i say a single man....

The problem is that Fubara is not a sound politician. The man (Wike) that handed the power to you is a real politician. If you want to outsmart Wike, you must be a sound politician because he is often many step ahead of you. Now Fubara has made hot bed for himself to lay on, by listening to those who did not supported him during his election for the governorship. He already pre-planned his onslaught against Wike before his election as governor, but was deceiving Wike then.

What is the law? That public declaration of defection is not a valid declaration for any reason? It's a clear case of validating technicalities against the naked truth.

These are the kinds of rulings or judgements that are destroying Nigeria. People are going everywhere saying "we are no longer members of PDP. We are now APC members". And a judge is saying what they say about their membership is immaterial.

This judgement on the 27 law makers that defected from the PDP to APC that they have not defected because PDP says that their register of members still contains the names of the said law makers therefore they have not defected is a judgement that make people lose trust in the judiciary.
If any crisis broke up in Rivers State, the judiciary is fully responsible bc there is more to come.
From what is happening now, Wike is really in charge of rivers, both their APC and PDP in rivers. Secondus and co. who worked for Atiku was just noise makers. Fubara should either apologize, and take his corrections by making peace with his team, which is wike's Team (political structure). Or then he should fight with all his might to complete his first tenure, and then forget second tenure, if he can really be trusted for second tenure by the same team he is fighting now. Fubara should not forget that there was no miracle for him to become the Governor today without Wike. Don't bite the finger that feeds you.
The coast was and is never clear for the defected 27 lawmakers to make laws for the good governance of the people of Rivers State.
Once the lawmakers defected, they are deemed to have changed their allegiance to another party in this case, the APC.
One do not need a Party's membership Card to show a change of allegiance in the case of a defection.
A court of law do not need proof of communication of change of membership ( Party membership card) for a defection to take effect.
By section 122 of the Evidence Act 2011 (as amended) a court of law is presumed to take judicial notice of records of proceedings of both the National Assembly and the State House of Assembly. Hence what happened in the floor of the Rivers State House of Assembly, the court is bound to take judicial notice of it.
Similarly, the same 27 lawmakers had in a suit filed on their behalf at the Federal High Court at Abuja sought for an order for their seats not to be declared vacant by reason of their defection from the PDP to the APC.
That suit and the court processes filed on behalf of the defected law makers also forms a record of court proceedings which a court of law is also bound to take judicial notice of in line with section 122 of the Evidence Act.
In summary, the 27 defected lawyers cannot approbate and reprobate at the same time. They have lost their seats.
Did they send resignation letters to the PDP? It's pretty straightforward and simple. Mere declaration on TV or whatever affidavits deposed to are not enough.

Defection is renouncing your allegiance to one party and declaring your allegiance to another party. Verbal public announcement is sufficient to establish this renunciation. This is the substance of a defection. Entering their names into party register and giving them party cards are merely documentary activities. It is not the duty of the defectors to expunge their names from the party register. They absconded from the party , denounced and renounced the party and swore to affidavits documenting their renunciation. This is stronger than a resignation letter. They can defect from the party PDP and become partyless...which is still a defection. Their registration in APC is not a necessary leg to have them evicted from the house of Assembly given that our laws in section 106 does not allow for members in the House without a party. They're gone . This matter should quickly proceed to the supreme court

It is state affairs, therefore it is the state courts that have jurisdiction of state matters.
So they will be forced to stay in PDP.
The speaker is not the ward chairmen to receive resignation or defection letters from a party member. Such letters written to the Mr Martins on the floor of the house were directed and presented to a wrong person, address and venue. Those would not have any more effect than such a declaration or pronouncement of defection of a member in a bear parlour by the street corner. The law is trite, he who asserts must prove, any assertion that those H of Ass members have defected to the APC would invariably require the provision of membership register of the APC containing the names of the new members. The party's membership register or membership card is the credible evidence to prove, not a public pronouncement of any sort. A political statement or suggestion contained in a letter read in the floor of the house and not formally communicated to the party is not enough to constitute a proper act of defection in my opinion. No one becomes a member of any association by going publicly and announcing that he is now a member of such an association. It is like saying that a person automatically transfers his pupilage from one school to another by may public pronouncement when the new school when he is yet to fill admission or entrance form to the new school, and when the first school was yet to be notified properly In the instant case the house is not the Party(PDP) neither is the speaker the party Chairman at the ward or any other level of the party The judex should know nothing except what he knows judicially..

Verbally declaring to the whole world (by air, TV, newspapers, etc) to say that they had defected from the PDP to APC suffices, to say that they, indeed, had defected from that party to another and should be acceptable at law, anywhere in the world. Surrendering the one's membership card of a party as evidence of having defected from that party is irrelevant as long as the party is aware of it by public announcement as made by the so-called 27 law makers.

The 25 lawmakers has defected because they are different ways you can officially make your claims, which the 25 lawmakers has done by writing a letter and going to the court to declare an affidavit that they have defected, therefore they do not have to write to the PDP officially or return their membership cards that they have defected, letters and affidavit are official.
