- The plaintiff dated the defendant long ago, and when she got pregnant, she told him he was the father. However, the plaintiff has doubts, so he has petitioned the court for a DNA test. He’s also suing for an overpayment of child support. The defendant cannot believe the plaintiff waited over 20 years for a paternity test. She’s suing for child support.

You do realize this is a court case? Newsflash, the judge has to be involved, and their thoughts count. When you go to court and a judge is presiding over the case, their thoughts figure into the outcome.

I would have got the dna when she was born flat out. He knew her name then and he definitely had the money. 23 years later, it has to be more to the story

I kind of get where he’s coming from, but twenty three years is a long time to wait to have a DNA test. But let’s not forget he was incarcerated for sixteen of those years. Maybe if he didn’t get himself locked up he would have done it sooner. But end of the day he’s only got himself to blame. The defendants actions by naming her daughter and her daughters child by her exes name was downright wicked and vindictive, and would definitely raise suspicion in anyones mind. I’m glad that at least he got his answer. What makes him look worse though, is having the gaul to ask for the overpayment back, considering he hadn’t paid anything for sixteen years. He may have wanted to satisfy his own suspicions with the DNA test, but by asking back for the overpayment, he showed that he has bitter feelings towards the mother. Naming those kids after her ex has really hurt him deeply, and she did that out of sheer spite because he was cheating on her when they were living together. She even had the Gaul to invite the same ex onto the stand, wow she foul and still bitter. Hope the daughter can find it in herself to forgive him, but by the way she looks so brainwashed by the mother, I doubt she will.
Her father's previous and current actions led to part of her behaviors also. I don't see the plaintiff asking for forgiveness.
If he was incarcerated for 16 years, and he hadn't paid in 16 years, it stands to reason he was unable to pay because be was INCARCERATED. The fact that he did pay it off and in fact overpaid tells me he was paying regularly after he was released.
There are people out here who still owe tens of thousands in child support. My exwife's father still owes back child support which now directly goes to her since she's an adult (43 years old right now). He deliberately works cash only jobs and gets paid under the table to avoid garnishment.

I think that's the general sentiment from most women. They get offended at the mere idea that a man wants to confirm paternity. My now exwife and I had a hypothetical argument about mandatory DNA tests at birth, which I was for, and then she got offended when I said I would request one just to prevent any future concerns about paternity that could come up later.

If he was in jail for 17 years the child was almost an adult when he left. Meaning he probably never had the resources to try for a paternity test while he was in prison. She probably didn't sue for child support until he got out because she could still sue even if the child was an adult at that point.

If I the plaintiff I would, one humble myself, two apologize to my daughter and her mother, three forgive her the overpayment and four profess love to my daughter to reclaim her trust. Humility is power not weakness. It's human nature to recognize one's mistakes to learn from them and move forward. But if you are drunk with pride, you can't see the truth and accept it.
