IS RIGHT TO MARRY A FUNDAMENTAL RIGHT?? FREEDOM OF CHOICE II LANDMARK SUPREME COURT DECISIONS

  • Hello guys!
    Recently the Uttar Pradesh Government promulgated an ordinance namely, Prohibition of Unlawful Conversion of Religion Ordinance, 2020 and reportedly multiple arrests have already been made thereunder.
    A resultant Public Interest Litigation has been filed in the Supreme Court challenging the constitutional validity of this ordinance alongwith the Freedom of Religion Act, 2018 enacted in Uttarakhand. One of the main contentions is that such anti-conversion laws violate a person’s right to marry that has been established to be included within Article 21 pertaining to right to life and personal liberty.
    In this video I explore the validity of this aforesaid right and its acceptance as a Fundamental Right. I have referred to the following judgments in lieu of this -

    3. Justice K.S. Puttaswamy (Retd.) vs. Union of India (2017)
    4. Shakthi Vahini vs. Union of India (2018)
    5. Shafin Jahan vs. Asokan K.M. (2018)
    6. Salamat Ansari vs. State of U.P. (2020)
    7. Wajeed Khan H.B. vs. The Commissioner of Police (2020)

    Can this discussion trigger further discussion of right to marry for people belonging to LGBTQ community?

      I am sure. With the Navtej singh johar case, right to choose sexual partner is now a established fundamental right for LGBTQIA community. Hopefully once the marriage laws are amended or another SC decision, gay marriage may become a reality. Already some gay couples in kerela and delhi have moved their respective high courts for allowing them to marry under the Special marriage act.
