The trouble is that when the constitution was hammered out, societal attitudes were such that is was presumed that marriage would be between man and woman. Like it or not, that implicit presumption is baked into the constitution. The presumption should not have been made but the matter needs to go back to the legislature to consider the matter from first principles without making any presumption. Furthermore, court decisions should not be relied upon; see Roe -v- Wade in USA relating to abortion.
