    Got stopped just a few weeks ago while driving my brother's car. My parents (who are addicts) were using it beforehand and had substances in the car. But the reason for the stop was to train the officer on how to conduct searches. When I denied them the search they brought the k-9 out and it got a hit. Luckily I was able to let them know what was going on and they didn't find anything anyway because my brothers and I had cleaned it out before I started using the car. Turns out, some substances can leave a scent in the car for up to six months. Make sure to deep-clean your cars when you get them back from friends and family.

I turned right onto the road they stopped me on, and stopped after less than 200 feet. They said I had come from a neighborhood half a mile away and "people who look like me" only go there for drugs. Meanwhile I'm in my work uniform and presented my ID with my address on it, and you can see both my house and my employer from the place they stopped me at. It was a half mile drive to work and I was 45 minutes late over that nonsense while they brought out a dog, lied about it signaling, and destroyed my car searching for drugs I didn't have. Ftp.

    • @bewbew0016
      @bewbew0016 6 місяців тому

      There have been plenty of payouts from these lawsuits. The thing that most often will occur (in the situation you guys are describing) is the police agency you're in a suit with will eventually (sometimes very quickly) make an offer to settle. The majority of people will take that offer, or if the initial offer is too low, will take a subsequent offer for a higher dollar amount, depending on the specifics of the case.
      Yes, you do have to pay an attorney (they don't usually work for free), but oftentimes you'll find one who is willing to take the case with an agreement of being paid a percentage of your settlement. That will usually be about ⅓ of whatever you get. So, in the end, you'll keep about ⅔ of the settlement.
      Now, depending on the actual lawsuit, the specifics of what actually occurred, and the evidence you have to show what happened, we can be talking about a very large sum of money in a short period of time.
      Law enforcement agencies have insurance policies for civil litigation. So, that is where this money comes from. I know it's a common belief that the police just take money from taxpayers to pay out these settlements and then continue abusing people, but that isn't really what happens. This not only will make their premiums increase, but people in their jurisdiction will often know the name(s) of the offending officer(s) and demand they be let go. If the agency is generally good, they'll fire the officer(s) regardless of any protests.
      So, if something like this happens to you, don't not act because you assume nothing will ever come of it. Try to make sure there is evidence, such as a recording you made during the incident. Don't just count on obtaining the body worn camera recording during discovery, as they sometimes have a way of deleting the footage 'totally by accident'. Then, contact some attorneys. Many have free consultations.
      Hopefully, that's helpful. If Mike (or any other attorney) sees this and wants to jump in here, he can certainly add more to this. Especially if they want to get into the weeds of section 1983.
      This isn't legal advice, and I'm not your attorney.
