There was a young boy selling ice cream and he was shut down by a neighbor calling. The young boy was raising money for his baseball club. He reopened with the sign "Ice Cream" donations accepted. He raised over $1,000.00 that day.
That's how I get around an ordinance that doesn't allow me to sell chicken eggs. I give the eggs away and accept donations towards feed cost or barter them. People even decide how much money they give. I don't even offer a suggestion.

As a former health inspector for the state of Florida, I encourage you to reach out to your inspector and discuss your options on how you can operate and meet the state expectations. Most inspectors are not looking to hurt people or prevent them from operating. I worked with many restaurant operators with finding alternative ways to operate their business and meet state laws/rules. I hope you find a way to be able to operate your stand.

No. Very simple: Americans should simply label items "govt compliant" or "non-compliant" and allow customers to assess risk themselves. Where I live they turn a blind eye to Amish neighbors that sell FOOD. Old Order, so no coolers or anything. My door would be kicked in and my home surrounded by guns. Real sick and tired of this shit. The state is incompetent and has no place with doling out "rules". Everything is in the name of helping us, isn't it?
Meanwhile in the state of Michigan you have water treatment plants selling/giving away Bio waste as fertilizer and it is loaded with PFAS (forever chemicals) and you have farmers using that on their crops and in their pastures which leads to animals having high amounts of PFAS in the meat! When I was shopping for my land, when I came back to Maine, I was hard core checking the difficult to find, and often shut down, map of farms that use it. Once you do, it’s there.

In Niagara falls there is a food digester plant that was shredding all the plastic from expired dairy goods etc. The plastic was hauled in tankers and put in willing farmers lagoons then sucked up with plastic and spread on fields of soybeans and corn..Unreal
I am in SE Michigan, I stop at farm stands all spring, summer and fall. I buy my eggs every week from one. I've never seen a person! I think someone made specific complaints against you for some reason and looked at the Cottage laws while they were doing it. I'm so sorry this happened! Your stand is beautiful! The best sweet corn I've ever had came from a Cass County farm stand. I fell out of love with Michigan 20 years ago. Regulations and government overreach finally chased me out in 2018. I am now a completely happy resident of Alabama. I miss the fishing, but I do not miss the taxes, the car insurance prices, or the snow in Michigan!

that was my first thought - just add a buzzer or ringer and go out when needed. If not home, close it up. Not ideal, but not totally closed. And the "no set prices" approach is good, too, maybe with "gently suggested donations". No actual prices. That makes it not-for-profit and likely sidesteps many of the official sales rules.

I bet she could set one of those up inside the stand (with the solar panel outside) and have it alert her when someone was on site. That way, she wouldn't even have to shut down when she's not home.

You're right 2016 should have never happened. If anyone had done a little research down from Grandpa, Pa, and It they would have known what was to come. Sitting back being docile and lazy, accepting what is told to you is very dangerous. We've seen examples.
We got shut down selling plants at a farm market. A competitor reported us. We were upset for a few days. But we applied threw the state and the inspector was very helpful and we obtained our license. So we went back to business within a month. Don't give up, talk with the inspector; and fix what you have to. We had to put our license number on each plant, it was just a bump in the road.
We did the farmers market circuit in central Maine back in 2016-2019, we used to kill at the markets…so much that jealous vendors would sabotage us…fully licensed insured etc. The state of Maine was not as bad as NY….NY was the absolute worst. The made it as hard as they can because big corps don’t want the competition.
Rural Michigander here. For many years I set up a table at the end of my driveway with my excess vegies grown in the garden. After much thought I decided to just put up a sign saying "Free" but donations are appreciated. I never was trying to make money; mostly trying to help others. Then one day someone took my table and saw horses that made up the table...lol My upset wife got on one of the local social media sites and in a couple days our stuff magically reapeared in the middle of the night!

56 years old, born, raised and still living in Michigan. I've been so disappointed with our state since Whitmer. But anyways I live for our farm stands and I go all the time. I buys eggs, jellies, Jams, honey, fresh veggies and fruit and have never bought any of that face to face. It's always been the honor system.

While healthy food is outlawed, the grocery stores are full of processed and over processed poison for our children and all of us. It’s a disgrace. Where exactly is the regulation that outlaws healthy food? Please point me to it so I can read the regulation. How is it fresh fruit and veg are sold in supermarkets and farmstands all over the country if it's not allowed? No one but no one forces us to buy the over processed crap from the store. Have it open for specific hours during the week and do the sales face-to-face if that is a main requirement. Maybe even have a volunteer to be present during some of the times the stand is open. Do not give up. Your Farmstand is awesome!!!!

I used to know someone who had "open houses" regularly. That way she would have visitors come, maybe 10-1 on a saturday. She would have snacks set up and sell her goods in person at that time. That way people got to taste her jams and things, and she sold face-to-face, but not every day.

Also, we used to have a raw milk dairy near us. It was amazing. And then a pregnant woman consumed raw milk, got sick (what knows what caused the sickness) and then reported them and shut this small family farm down. Seriously, people have lost their minds.
You have to do herd shares to sell raw milk. I personally think it’s a flex on the Dairy industry’s part. We would have more small family dairies of all kinds if the consumer was trusted to process this milk like they are trusted to process thier pork purchase
My mom sold goats milk for pets. If people wanted to drink it themselves she had no control over that. I am afraid to sell my chicken eggs. People are crazy. I think the food manufacturers are behind this because if the FDA cared about our food supply the food manufacturers would be shut down for all the chemicals they put in our food. It’s killing us.

I live in Colorado and was selling jams, jellies and pickles under cottage laws at farmers markets for awhile, so I completely understand what you are going through. I did all the classes too, the requirements are overwhelming. After 2 years, I ended up closing it down because I was getting too big for the cottage laws and I couldn’t navigate all the requirements and laws to expand on my own. It was either invest several thousands of dollars to expand or close it down. It was devastating.

If you have to sell face to face, why doesn’t the big stores with self checkout? You walk in get your product, walk to a machine, scan it, pay for it bag it, and leave without any “face to face’”.Just wondering who makes these laws?
Because someone is there on site to supervise the store. Hers is COMPLETELY unattended. It would be like if you walked into the grocery store and there were no employees working. If your product is completely unattended, someone could come up to her farmstand and contaminate her product, an enemy, former lover, any number of scenarios.
It’s because she is not producing in a commercial kitchen that is being inspected. As a cottage food producer myself in Michigan, I can only sell shelf stable baked goods made in a home kitchen. Michigan may seem restrictive but many other states are even more restrictive. Cannot use butter or chocolate, etc. it’s working with other cottage producers and changing the laws. Plus many states the restaurant and commercial vendors lobby to keep these restrictions on the mom and pop sellers to stop competition.
This is what our government wants. Please vote people to BRING OUR FARMERS BACK....even the ones like her who are keeping people healthy. Fight on. So sad. ❤

Your farm stand is the cutest I've ever seen. I really love the design of the building and how easy it is to close up. You could have a hay day decorating it for the different holidays and high light your items to sell. It would be nice to have it on the top of a flatbed trailer and take your cute farm stand to the farmers market 1 or 2 days a week. You could even add fresh baked goods. Good Luck

I have a friend who does a farm stand and she has a motion ringer that goes off whenever a customer walks up to her stand. She has the stand open on days when she's doing things around the house and can hear it. She picks her days "open" as her work days and has them on the same days every week. Blessings to you ❤

Inspectors don't drive around hunting for issues. They rely on the snitch. And snitching is being quietly pushed more and more. In fact, some areas, it's loudly encouraged.

I live in Michigan as well. We have a person who sells at the farmers market and anytime they hear about someone they think is taking away from their profit they reposrt them until they get shutdown.

True story: I moved from a big city to a suburb to work from home so I could homeschool my daughter who was struggling in school (this was 25 years ago and I was a single mom). I registered my business as a piano teacher with the county, and taught children and adults Monday thru Friday after school hours in my living room. This worked out beautifully bc I was a classically trained musician who studied with a music professor my entire childhood, and grew up in a von trap type family. LOL. One day, I received a letter from the local tax man, claiming I owed taxes based on the inventory value of my home studio. Mind you, my net income at the time was paltry at $9,000 per year after paying federal taxes, and had given up a huge salary as a FT computer engineer. After certified letters went back and forth, I was told I needed to pay taxes on the music lesson books I maintained inside the residence, since it was considered inventory. I sent a spreadsheet of the value of my well-worn beloved music books to the official, wherein the owed tax came to approximately $1. LOL. I never heard back from him after that. 🧐

I don’t know what your community is like. Maybe you could just have a donation box, and not charge for the products? You are such an amazing example of copious fruit of the Spirit. I had a friend in Yuma AZ that had a goat dairy. She couldn't sell the milk because is wasn't pasteurized. So she would milk the goats put it in a refrigerator with a donation jar. People would come get milk and put the money in the jar. She wasnt selling it and didn't know who picked it up, so there. If man make something hard man can get around it.

I have a home cottage food business and yes, that’s the law here in Florida too. Proper labeling that includes (your address, description, ingredients, and amount), it’s have to be face to face, no shipping, only you can deliver or sell, no one else, no online ordering. Also stuff like jams and jellies, you cannot leave at your stand, or under the sun outside. Mine is a cookie shop, that’s a different than yours but rules are kind of the same, sorry for the bad experience you had! 😢

Actually this is a loosening of regulations and Florida is more restrictive. Every state has thier own laws over health and safety because those are state rights. If you want to change it, you have to demand your state expand the cottage food options

That's how I get around an ordinance that doesn't allow me to sell chicken eggs. I give the eggs away and accept donations towards feed cost or barter them. People even decide how much money they give. I don't even offer a suggestion.

As a former health inspector for the state of Florida, I encourage you to reach out to your inspector and discuss your options on how you can operate and meet the state expectations. Most inspectors are not looking to hurt people or prevent them from operating. I worked with many restaurant operators with finding alternative ways to operate their business and meet state laws/rules. I hope you find a way to be able to operate your stand.

No. Very simple: Americans should simply label items "govt compliant" or "non-compliant" and allow customers to assess risk themselves. Where I live they turn a blind eye to Amish neighbors that sell FOOD. Old Order, so no coolers or anything. My door would be kicked in and my home surrounded by guns. Real sick and tired of this shit. The state is incompetent and has no place with doling out "rules". Everything is in the name of helping us, isn't it?
Meanwhile in the state of Michigan you have water treatment plants selling/giving away Bio waste as fertilizer and it is loaded with PFAS (forever chemicals) and you have farmers using that on their crops and in their pastures which leads to animals having high amounts of PFAS in the meat! Honestly things like this really can tick someone off! I hope you guys can get this sorted out!

I am in SE Michigan, I stop at farm stands all spring, summer and fall. I buy my eggs every week from one. I've never seen a person! I think someone made specific complaints against you for some reason and looked at the Cottage laws while they were doing it. I'm so sorry this happened! Your stand is beautiful! I fell out of love with Michigan 20 years ago. Regulations and government overreach finally chased me out in 2018. I am now a completely happy resident of Alabama. I miss the fishing, but I do not miss the taxes, the car insurance prices, or the snow in Michigan!

And the "no set prices" approach is good, too, maybe with "gently suggested donations". No actual prices. That makes it not-for-profit and likely sidesteps many of the official sales rules.

I bet she could set one of those up inside the stand (with the solar panel outside) and have it alert her when someone was on site. That way, she wouldn't even have to shut down when she's not home.

You came at the end of the Reagan years. The most free time since before FDR.
We got shut down selling plants at a farm market. A competitor reported us. We were upset for a few days. But we applied threw the state and the inspector was very helpful and we obtained our license. So we went back to business within a month. Don't give up, talk with the inspector; and fix what you have to. We had to put our license number on each plant, it was just a bump in the road.
That! There is a way around your problem.
We did the farmers market circuit in central Maine back in 2016-2019, we used to kill at the markets…so much that jealous vendors would sabotage us…fully licensed insured etc. The state of Maine was not as bad as NY….NY was the absolute worst. The made it as hard as they can because big corps don’t want the competition.
Rural Michigander here. For many years I set up a table at the end of my driveway with my excess vegies grown in the garden. After much thought I decided to just put up a sign saying "Free" but donations are appreciated. I never was trying to make money; mostly trying to help others. Then one day someone took my table and saw horses that made up the table...lol My upset wife got on one of the local social media sites and in a couple days our stuff magically reapeared in the middle of the night!

56 years old, born, raised and still living in Michigan. I've been so disappointed with our state since Whitmer. But anyways I live for our farm stands and I go all the time. I buys eggs, jellies, Jams, honey, fresh veggies and fruit and have never bought any of that face to face. It's always been the honor system.

I used to know someone who had "open houses" regularly. That way she would have visitors come, maybe 10-1 on a saturday. She would have snacks set up and sell her goods in person at that time. That way people got to taste her jams and things, and she sold face-to-face, but not every day.

Also, we used to have a raw milk dairy near us. It was amazing. And then a pregnant woman consumed raw milk, got sick (what knows what caused the sickness) and then reported them and shut this small family farm down. Seriously, people have lost their minds.

I live in Colorado and was selling jams, jellies and pickles under cottage laws at farmers markets for awhile, so I completely understand what you are going through. I did all the classes too, the requirements are overwhelming. After 2 years, I ended up closing it down because I was getting too big for the cottage laws and I couldn’t navigate all the requirements and laws to expand on my own. It was either invest several thousands of dollars to expand or close it down. It was devastating.
It's just not right. All the glamorizing of Venture Capitalism a la the Shark Tank and Dragon's Den (Canada) isn't helping. People don't understand how important 'local' really is. Also, you were doing something you love, and that is the Way. Love & light to you, from Canada.
If you have to sell face to face, why doesn’t the big stores with self checkout? You walk in get your product, walk to a machine, scan it, pay for it bag it, and leave without any “face to face’”.Just wondering who makes these laws?

Because someone is there on site to supervise the store. Hers is COMPLETELY unattended. It would be like if you walked into the grocery store and there were no employees working. If your product is completely unattended, someone could come up to her farmstand and contaminate her product, an enemy, former lover, any number of scenarios.

It’s because she is not producing in a commercial kitchen that is being inspected. As a cottage food producer myself in Michigan, I can only sell shelf stable baked goods made in a home kitchen. Michigan may seem restrictive but many other states are even more restrictive. Cannot use butter or chocolate, etc. it’s working with other cottage producers and changing the laws.
Plus many states the restaurant and commercial vendors lobby to keep these restrictions on the mom and pop sellers to stop competition.
This is what our government wants. Please vote people to BRING OUR FARMERS BACK....even the ones like her who are keeping people healthy. Fight on. So sad. ❤

Your farm stand is the cutest I've ever seen. I really love the design of the building and how easy it is to close up. You could have a hay day decorating it for the different holidays and high light your items to sell. It would be nice to have it on the top of a flatbed trailer and take your cute farm stand to the farmers market 1 or 2 days a week. You could even add fresh baked goods. Good Luck

I have a friend who does a farm stand and she has a motion ringer that goes off whenever a customer walks up to her stand. She has the stand open on days when she's doing things around the house and can hear it. She picks her days "open" as her work days and has them on the same days every week.

Yeah, just "sell" merch on your stand, that's not regulated. And give away the food free. Like this: buy 1 T-Shirt, get a free 8oz jar of jelly! You can figure the rest out from there.
I live in Michigan as well. We have a person who sells at the farmers market and anytime they hear about someone they think is taking away from their profit they reposrt them until they get shutdown.
@@design2c436 you would think that they would look at the fact that it is the same person and see what is going on but there are no laws to protect people trying to make a little extra money. It just is what it is.

Farmers markets cost to much. I had to stop shopping at them. They cost more than whole food’s. I do shop road side stands. Always on the honor system too. I live in Rhode Island there’s plenty of them. Sorry they are picking on you.
Let me clarify. I don't have a farmstand or the land to do that. This is just what I have seen a person do to several others. Something that they have loudly and proudly made known to others.

True story: I moved from a big city to a suburb to work from home so I could homeschool my daughter who was struggling in school (this was 25 years ago and I was a single mom). I registered my business as a piano teacher with the county, and taught children and adults Monday thru Friday after school hours in my living room. This worked out beautifully bc I was a classically trained musician who studied with a music professor my entire childhood, and grew up in a von trap type family. LOL. One day, I received a letter from the local tax man, claiming I owed taxes based on the inventory value of my home studio. Mind you, my net income at the time was paltry at $9,000 per year after paying federal taxes, and had given up a huge salary as a FT computer engineer. After certified letters went back and forth, I was told I needed to pay taxes on the music lesson books I maintained inside the residence, since it was considered inventory. I sent a spreadsheet of the value of my well-worn beloved music books to the official, wherein the owed tax came to approximately $1. LOL. I never heard back from him after that. 🧐

I had a friend in Yuma AZ that had a goat dairy. She couldn't sell the milk because is wasn't pasteurized. So she would milk the goats put it in a refrigerator with a donation jar. People would come get milk and put the money in the jar. She wasnt selling it and didn't know who picked it up, so there. If man make something hard man can get around it.

I have a home cottage food business and yes, that’s the law here in Florida too. Proper labeling that includes (your address, description, ingredients, and amount), it’s have to be face to face, no shipping, only you can deliver or sell, no one else, no online ordering. Also stuff like jams and jellies, you cannot leave at your stand, or under the sun outside. Mine is a cookie shop, that’s a different than yours but rules are kind of the same, sorry for the bad experience you had! 😢

Michigan is getting far too out of line with all these regulations.
Actually this is a loosening of regulations and Florida is more restrictive. Every state has thier own laws over health and safety because those are state rights. If you want to change it, you have to demand your state expand the cottage food options
