    There was a young boy selling ice cream and he was shut down by a neighbor calling. The young boy was raising money for his baseball club. He reopened with the sign "Ice Cream" donations accepted. He raised over $1,000.00 that day.

      That's how I get around an ordinance that doesn't allow me to sell chicken eggs. I give the eggs away and accept donations towards feed cost or barter them. People even decide how much money they give. I don't even offer a suggestion.

    56 years old, born, raised and still living in Michigan. I've been so disappointed with our state since Whitmer. But anyways I live for our farm stands and I go all the time. I buys eggs, jellies, Jams, honey, fresh veggies and fruit and have never bought any of that face to face. It's always been the honor system.

      This was my first thought. I see people commenting that this is for the safety of the public. No, it’s for control. Big food and big ag can make all the people sick but you’re right, they never get shut down.

      @@jennwatson74 Don't leave out all the dept. and agencies. Municipal water with fluoride doesn't keep anyone save. Chemicals are all approved. Iodine cleans water and the oceans are full of it. God's gifts ruled by .... (can't say it). We have to follow the laws but we don't have to respect them.

    Meanwhile in the state of Michigan you have water treatment plants selling/giving away Bio waste as fertilizer and it is loaded with PFAS (forever chemicals) and you have farmers using that on their crops and in their pastures which leads to animals having high amounts of PFAS in the meat! Honestly things like this really can tick someone off! I hope you guys can get this sorted out!

    Little village homestead on UA-cam is in Michigan and has a farm stand. She has a ringer on hers when someone visits it so she can go out and help them. I wonder if you had any questions if you could reach out to her for help as someone who already follows the laws.       that was my first thought - just add a buzzer or ringer and go out when needed. If not home, close it up. Not ideal, but not totally closed.
      And the "no set prices" approach is good, too, maybe with "gently suggested donations". No actual prices. That makes it not-for-profit and likely sidesteps many of the official sales rules.

    As a former health inspector for the state of Florida, I encourage you to reach out to your inspector and discuss your options on how you can operate and meet the state expectations. Most inspectors are not looking to hurt people or prevent them from operating. I worked with many restaurant operators with finding alternative ways to operate their business and meet state laws/rules. I hope you find a way to be able to operate your stand.

      No. Very simple: Americans should simply label items "govt compliant" or "non-compliant" and allow customers to assess risk themselves. Where I live they turn a blind eye to Amish neighbors that sell FOOD. Old Order, so no coolers or anything. My door would be kicked in and my home surrounded by guns. Real sick and tired of this shit. The state is incompetent and has no place with doling out "rules". Everything is in the name of helping us, isn't it?

    I used to know someone who had "open houses" regularly. That way she would have visitors come, maybe 10-1 on a saturday. She would have snacks set up and sell her goods in person at that time. That way people got to taste her jams and things, and she sold face-to-face, but not every day.

    I am in SE Michigan, I stop at farm stands all spring, summer and fall. I buy my eggs every week from one. I've never seen a person! I think someone made specific complaints against you for some reason and looked at the Cottage laws while they were doing it. I'm so sorry this happened! Your stand is beautiful! I hope you figure something out AND that Michigan isn't getting even crazier they better not take away my farm stands!!

    Have it open for specific hours during the week and do the sales face-to-face if that is a main requirement. Maybe even have a volunteer to be present during some of the times the stand is open. Do not give up. Your Farmstand is awesome!!!!

      I am guessing that most of these laws spring from a time that didn't have the technology we do today. People got sick and someone probably died and the government reacted by creating a law that restricted that thing that caused the incident in the first place. What needs to happen is to go back and question those laws. If they are truly outdated and are no longer needed, then the state legislature needs to change the law.

    Also, we used to have a raw milk dairy near us. It was amazing. And then a pregnant woman consumed raw milk, got sick (what knows what caused the sickness) and then reported them and shut this small family farm down. Seriously, people have lost their minds.

      You have to do herd shares to sell raw milk. I personally think it’s a flex on the Dairy industry’s part. We would have more small family dairies of all kinds if the consumer was trusted to process this milk like they are trusted to process thier pork purchase

    I have a friend who does a farm stand and she has a motion ringer that goes off whenever a customer walks up to her stand. She has the stand open on days when she's doing things around the house and can hear it. She picks her days "open" as her work days and has them on the same days every week.

    It’s not just your state. I had one come by my store just looking around like a peeper, never said who they were just being weird till I questioned her. Someone made a complaint, but I had all my paperwork in order and she changed her attitude quick. One thing I’ve discovered in my situation is no one in the office will tell you what you can and can’t do, but they sure can tell you what you are doing wrong once you start. I do hope that you get it worked out. I guarantee you there are people that appreciate what you do!

    I live in Michigan as well. We have a person who sells at the farmers market and anytime they hear about someone they think is taking away from their profit they reposrt them until they get shutdown.

    I have a home cottage food business and yes, that’s the law here in Florida too. Proper labeling that includes (your address, description, ingredients, and amount), it’s have to be face to face, no shipping, only you can deliver or sell, no one else, no online ordering. Also stuff like jams and jellies, you cannot leave at your stand, or under the sun outside. Mine is a cookie shop, that’s a different than yours but rules are kind of the same, sorry for the bad experience you had! 😢

      Yeah, just "sell" merch on your stand, that's not regulated. And give away the food free. Like this: buy 1 T-Shirt, get a free 8oz jar of jelly! You can figure the rest out from there.

    I live in Colorado and was selling jams, jellies and pickles under cottage laws at farmers markets for awhile, so I completely understand what you are going through. I did all the classes too, the requirements are overwhelming. After 2 years, I ended up closing it down because I was getting too big for the cottage laws and I couldn’t navigate all the requirements and laws to expand on my own. It was either invest several thousands of dollars to expand or close it down. It was devastating.

      Actually this is a loosening of regulations and Florida is more restrictive. Every state has thier own laws over health and safety because those are state rights. If you want to change it, you have to demand your state expand the cottage food options

    What a bummer, indeed! Thank you for addressing it with calmness and grace and using this experience as a teaching moment for all of us. I love that you are looking to working with the inspector as a partner, vs bashing the government even though there are a lot of things we don't agree with. I know you are SO busy, but could you take your show on the road to a farmer's market or craft show? Keep up the great work in all the things you do!

    I know of a veteran who had a couple of project cars in his yard.A messy neighbor called building inspector on this veteran.The least our country could've done was let a hero have his cars.Prayers on your situation.

    So sorry you are going through this. I know you both put a lot of time and effort into the farm stand. I’m sure the majority of the community appreciated it; it seems there is always THE ONE. Take time to regroup but don’t give up. Where there is a will there is a way. What advice would you give your kids if they were in this situation? You and Todd are strong and I can’t wait to see you guys reflecting on this moment years down the road.

    True story: I moved from a big city to a suburb to work from home so I could homeschool my daughter who was struggling in school (this was 25 years ago and I was a single mom). I registered my business as a piano teacher with the county, and taught children and adults Monday thru Friday after school hours in my living room. This worked out beautifully bc I was a classically trained musician who studied with a music professor my entire childhood, and grew up in a von trap type family. LOL. One day, I received a letter from the local tax man, claiming I owed taxes based on the inventory value of my home studio. Mind you, my net income at the time was paltry at $9,000 per year after paying federal taxes, and had given up a huge salary as a FT computer engineer. After certified letters went back and forth, I was told I needed to pay taxes on the music lesson books I maintained inside the residence, since it was considered inventory. I sent a spreadsheet of the value of my well-worn beloved music books to the official, wherein the owed tax came to approximately $1. LOL. I never heard back from him after that. 🧐

    There is alot of this type of stuff going on in our state of Michigan co ops getting closed down for raw milk and butter and made to throw it all in thentrash I wouldnt have been so nice about it .😮 I'm glad you're contacting the inspector and hope it all works out. very sad 😢

    It's disappointing that you received the letter. However, it appears that there are a few things you can do about it to get your adorable stand up and running again. I appreciate that you are having a mature response to the enforcement of safety regulations in your county. Not everyone is as responsible about their products as you are, so it's understandable that health standards need to be in place. I hope 🙏🏼 it goes well for you. Thanks for sharing this video.

    I can see why they want “face to face”. Someone could come to your stand and put something on it that you did not make. It is getting really creepy out there who knows.

      Yes that makes sense but I am thinking the same could happen in a grocery store, where do you draw the line? I saw someone holding a fork eating out of the salad bar at a grocery store once, another taking food and eating from dry food bins, and another munching on grapes as she shopped. It looked to me like all of her items were sealed. 14:50

    So sorry. We live in California. My olive oil friend has to sell out side her building because she bottles oil inside. (She now uses the porch overhang)She had a cute table and shelf on the other side of the wall where they bottle. Not allowed. And she can’t have bread to sample the oil, that’s serving food. They needed an “act of congress” to put in a flush toilet. They were expected to have an out house for themselves, an employee or customers. The laws here are oppressive if you are a small operator. And the taxes are crippling. Another friend who sells jam and jelly at events has made a sticker that says “all food prepared and bottled in my home kitchen.” SorryRachel. I love your recipes

    I’m in west michigan. My husband and I were doing a mental count of several
    Stands that are probably not in compliance. I wonder if someone reported you or if it’s because you had a public forum. Otherwise you may have gone unnoticed. Either way God had a plan and his plan is always best. So sorry because we could see the excitement and joy this stand brought you!

    You know what I find sad the most out of this whole situation is that you can easily see it's not the inspector that's the problem. A member of their community instead of just simply going to them and saying, "Hey, love what you're doing, but to my knowledge, there are some problems with your stand that I believe are in violation. Would you mind if I shared them with you?" This simple opening to conversation would have allowed Todd and Rachel to then talk to their governing agency. I am sure they would have corrected what was wrong and things that were not they would have some information for that concerned citizen to explain why they are doing what they are. Why can't we just talk to each other instead of being jealous, or scared of each other? It's so sad.

      But Rachel knew what was wrong before she even got the letter. Some of those rules are ridiculous IMO, but she knew she was breaking them so I don’t think a conversation would have helped. For example, the label. She knew she had to put her address. She did not. The face to face. She said it was open to interpretation but then said if you read all the way down it is clear. Again, rules might be absurd, but she knew she was breaking them. And she wasn’t fine or cited, so that’s a good thing.

    I’m so sorry that happened to you. I’m with you, I try to be a law abiding citizen but I also feel like that is up to me as a consumer to decide if it s safe for me. In Texas we have folks sitting in lawn chairs selling tamales and I am like no way! I think it’s a great idea to speak to the inspector and see where you can find a path.

    I feel like you shared some edifying information, like classes that may be offered by extension office or who ever in a state may be in charge as you put it. I would not had realized to research or where to potentially search such information. I also appreciate your humble approach realizing simply you may need to simply have a conversation to define interpretation.
