What if the deceased received VA benefits and Social security and no W2 . What forms do you need to file a final return for the estate?
Thank you for this video. If I file a 1310 for my parents, who both died recently, with their 2023 tax return, will the IRS issue their refund check to the estate of his name or my name? There will not be a court appointed rep at this time.
According to the Internal Revenue Manual (IRM 21.4.4.5.1), the IRS is supposed to use the name of the person claiming the refund as the payee for refunds issued on decedent accounts.

Can the 1310 be filed for a decedent in regards to previous years? And would W-2s for the decedent be required, or could you ask the IRS to assess all accounting for you?
@@brian-patrickjones You may need to do this, particularly in a situation where prior year tax returns were not filed or require an amended return using Form 1040-X. You would attach a copy of Form 1310 to each return that you file.
If you need to file additional returns, you may need to attach the requisite tax forms to each particular tax return. However, you can also request a copy of the decedent's tax transcript by filing IRS Form 4506-T. This might help you understand if there are refunds from prior year returns that were not yet issued.

If a person passed away in 2022 do you file a return form 1040 for the year 2022 or 2023 ? The Estate didn't receive income . Do you have to file a 1041 form also ?
My father died in 2023 and had all legal documents in place (will, POA, irrevocable trust) appointing me as Executor/Trustee. As a result, probate was avoided and courts not involved. What supporting documentation do I need to submit with Form 1310?
I've heard some people say that the IRS has required them to file IRS Form 56, Notice of a Fiduciary Relationship. However, I don't see any mention with in the form instructions. I would say that you should at least answer 'Yes' to question 3, if there is no court documentation in place.
