- The plaintiff hired the defendant to create a replica of her earring. When she went to pick it up, she claims the defendant melted down her earring, so the plaintiff is suing. The defendant argues the plaintiff gave him the okay to melt down the earring and create the replica pair. The defendant is countersuing for money owed.

Real answer, he's not a jeweller. Jewellers can make jewellery. He's a reseller / store.
Most jewelers dont make it anymore they send out to a company and get it back where i live theres like 20 jewelers and only one makes it in house but the guy is really old and his business is soon closing up

i dont agree that he should have to return the 150 because he is out alot more than that as a result of fulfilling the plaintiff's order . I have seen this judge do rough justice many times but she fails to do it so often as well .

He has done this many times over the years he has had this jewelry store, a profession scammer. You can make a duplicate earring from one earring. My family has had this done many times. This guy reeks of scam.

He should’ve done exactly what he was hired to do and that was to make a duplicate earring.
Exactly, wasn't that hard and if he couldn't then let it be known upfront and let her decide from there.
Depends on the style of the earring. It would involve a mold, injections, etc. And if it's super delicate that can be quite difficult.
He was holding her earring hostage until he got the $600. Glad he lost his case.
She should have called him a liar to his face, he lied about having the earring made originally, he lied about melting down her earring and he lied about when he'd claimed he ordered the new earring after her approval that never happened, everything this man says is a lie.
He's a scammer. He knew he couldn't deliver.
I wonder if he told her that it was outsourced. He was acting as if he was going to make the replica. Whether it was another pair or a replica it wasn't made by his hands. Glad she just got her original back.

Legally you cannot change a contract that you have with someone without getting their approval. What he did was unlawful.

...not clear scam, he did pay $500 for it, bad business communication, but she also full of it, no way wearing 24 /7 causing neck problems.
Poor lady. She trusted him with something invaluable and was deceived. He lied and lied and lied. She didn't deserve that! If he couldn't do it she could have gone somewhere else!

even so , he should not have to return the 150 because she actually cost him 500 . he would have been better off if she never even walked into his store . court is about making people whole but this judge totally shafted the defendant and only made the plaintiff whole but allowed the defendant to eat 500 bucks . he made the other earing and the judge just decided to ignore that there is still at least a minimal cost that should be provided for that , like not having to return the 150 .

@@kimr282 he is old enough and he has been in business long enough to know that its a bad move to pay out money without first getting approval . there is no way that old business man is gonna fork out money for this lady unless she made it clear that she wanted the work done for sentimental reasons and the exact cost was not a factor . im convinced that she simply changed her mind and did not care how much effort and money it cost the defendant to try to do what she requested of him . dont make excuses for bad customers , the judge was wrong on this one .

My device was in another room as I was listening to the case. I thought the plaintiff was a young girl. When I looked my iPad and show her I was shocked. Ironically, the judge says, “she not a child; she had a very specific request of you that you said you could do,” but she does should like a child. 😂

My best friend is a master jeweler. He does occasionally make duplicate jewelry for situations just like this. There are plenty of jewelry stores that CAN do this. Make sure they have in house jewelers and they aren't going to send the stuff off. A good shop will bring the jeweler out and let you talk directly to them and they can tell you exactly what is involved at the time.
Bless both of them really, the Lady was lovely and easy to understand why she wanted the earring , the Gentleman probably needs to pass the baton on and take life easy instead of getting into handgrips with customers and stressing himself out at this stage of life.

He is a liar, if he says he can make an identical earring, then why is he asking a 'factory' to send him similar earrings, first of all jewellery is not made in a 'factory', so he is NOT a jeweller, and he lied about having melted it down, trying to force her to buy his expensive stuff from the factory. She should have accepted the other earring but for the price he initially quoted so only owing him an additional $125...

AGREED. She was unreasonable. It was obvious that given the price of a solid gold earring versus the hollow original earring, that the duplicate would have to cost more because it was solid and based on the price of gold. She had to pay based on that price. He should have just given her her one earring back, kept her deposit and said BYE BYE don't come back.
How about she is just told what it really costs from the beginning and then she signs off on a work order or contract if she wants to move forward and pays her deposit. Then she can’t complain after and the gentlemen gets his deposit and can sue HER for the rest if work was done. It’s very simple. If you take a car in and more work needs to be done, you get a phone call and you authorize them over a recorded line that they do the work for whatever the supplement is, otherwise they just complete the primary task if the customer doesn’t have the money for it

Milian wanted to give him every out to prove his side over the plaintiff's. It's just another show of bias but luckily for the plaintiff she had ample evidence and proof.
The only thing the judge believed is that he had a replacement made for $500 and that's because he had the receipt to prove it. She basically threw everything else he said out the window..... it's kinda why the plaintiff so overwhelmingly won the case.

It is quite clear she did NOT believe anything he said except for what he actually had proof of (which was a receipt, and that actually proved he was lying). For the plaintiff really wanting the earring made and then not even trying it on I’m surprised. After you wear earrings for a while, you don’t even really notice them. The weight couldn’t been more than 5 to 10 g difference.

I'm pretty sure this guys specialty is doing shady business. He just comes across as the guy who will say anything to make a sale & he sizes people up before he gives them a price based on how much money he thinks they have (i.e., if you walked in wearing all designer clothes, shoes, purse, jewelry then a necklace he'd normally sell for $500 would magically become a $700 necklace).
