Can I Get the Same Results as My Friend in My Stunt Driving Case?

I’ve been making this series of videos to give you insight into how the legal process works regarding your stunt driving charge. What are the conversations I have at least once a week on the phone is someone that tells me that they know of someone or had a friend that got a stunt driving charge thrown out, dismissed or achieved a certain result somewhere else. So of course, this follows with the question “can you get me the same result? “. This is not such a simple question and is actually quite complicated to answer. I will do my best to answer in this video and explain the details.

    First, let’s start with the actual charge of driving. Every single case is different. Who knows what your friends case entailed. What speed were they going? What age were they? What was their driving record? What court were they in? Who is the prosecutor? Was this during Covid? Was it related to speed or related to action such as donuts or spinning wheels? Stunt driving maybe one charge, but it is a charge that has over thousand variations.
    The biggest distinction between two driving charges that are related to a speed is the speed itself. One case could be 55 km over the speed limit and another could be 95 km over the speed limit even though these charges are treated differently in the court system, generally, the higher, the speed, the higher, the potential penal that is why there is a range of penalties instant driving for example you can get a minimum one year license suspension or maximum three-year license suspension for the same charge. You can get a fine of $2000 or up to $10,000 for the same you can also avoid jail time or spend up to six months in prison for a stunt. Depending on your circumstances, this is never the same in two different cases.
    Another major distinction between two different cases is the speed limit of the road you were caught stunt driving. For example, the law has determined that any road below an 80 km speed limit is called “residential “. It doesn’t mean there houses around, necessarily, but it is treated very differently by the court than a stunt case on a speed limit over 80 km/h. Speed limit over 80 km/hrs. and make no mistake, the court treats these two speed zones very differently. In a residential zone, the law believes that someone could’ve been crossing the road, so not only were you putting other cars at risk, you were putting pedestrians lives at risk. Where is on a highway the odds of someone crossing the road are very slim. So it is a different version of a stunt driving charge.
    Another major distinction between stunt driving charges is the court or area which you were caught stunt driving. There are over 70 quarts across Ontario. Each court has its own prosecutor. Each prosecutor is unique and makes up their own way in which they treat stunt driving. Keep in mind that if a radar in the evidence is shown to be correct. Each of these different prosecutors has a lot of power. Prosecutor may be more lenient, we another prosecutor may pull out the highest versions of all of the penalties. And this is their right. Calibrated radar, prosecutor makes their own assessment of the penalties. They wanna apply to your stunt driving case.
    Now let’s look at the obvious factors that would differentiate to different driving cases. You’re driving record will have an impact on the way in which your driving case penalties are evaluated by a prosecutor. With a poor, driving record, showing a prosecutor, a pattern of behavior and speeding. This may increase your penalty range in a stunt driving case. A clean record doesn’t necessarily help your case, but it certainly doesn’t hurt your case other factors include your age, your license status, the time of day, the weather, and whether or not the road are on, has a history of death or accidents due to driving in fractions.
    So next time you hear of a friend or someone you know, they got a certain result in a certain court, you have to ask yourself all of these questions before you compare your case to theirs.
