    Hello i have a questions i have a court day (New brunswick)in the end of September for driving while suspended the problem is that my work permit expired in the beginning of September i cant renew the work permit i have to leave the country i try to call and ask if the can move the day in july or june but it was impossible i really dont what to do any advice on what to do ?

    Hey, I received a DL suspension for a month due to violations of Ontario Highway Traffic Act. Is this considered a criminal offense? If no, then why do insurance companies call it “conviction”? I have paid my fine along with my reinstatement fee. Please let me know. Thanks!

Convictions under the Highway Traffic Act of Ontario are not criminal convictions because these laws are provincial, unlike the Criminal Code of Canada, which is federal and criminal by design.     If I get a record suspension/pardon will I be able to enter the US without incident? Will the DUI conviction and criminal record no longer show up to US border agents/future employers?

      Pardons / Record Suspensions are not recognized by the U.S. Customs and Border Protection Agency. However, even if the US CBP sees your conviction, not all criminal convictions are considered a crime involving moral turpitude, ie: not all crimes will deem you inadmissible to the United States.     But wouldn’t you be able to tell if someone was impaired after pulling someone over anyway? This doesn’t make sense and is against our character not to be unreasonably searched

      Great point! You're right, police officers are trained to detect signs of impairment during a traffic stop. In my opinion, this mandatory alcohol screening policy will have two significant impacts on DUI charges. Firstly, it will effectively catch novice drivers (such as G1/G2 drivers) who have consumed any amount of alcohol, as they are subject to a zero-tolerance policy. Secondly, this policy is likely to increase the number of refusal charges, as some individuals may decline to take the alcohol screening test, which will lead to a DUI charge. Thanks for watching!

    And what are the costs? Conveniently the canadian website to submit your application and all the steps only tells you about the $50 for your application and fails to mention the fingerprints, police records, court info, and local police records

      Hello - In addition to the $50 application fee (charged by the Parole Board of Canada), additional costs: (1) fingerprints - $50 to $100; (2) court records - $0 to $50+; (3) local police record check - $20 to $150. Costs vary by government agency.

      Great question, thanks! -- In Canada, individuals have a constitutionally protected right to remain silent when questioned by police, with some exceptions. They must provide their name, address, and date of birth if arrested, and show license, registration, and insurance if driving. While they cannot lie to police, they are not obligated to provide any statement, and their silence cannot be used as evidence of guilt in court.

    I've been wondering for a while now, and I'm assuming many others have the same question (It would be very nice if you could make a video on this topic) I've never been convicted of stunt driving, and hope to never be, although I do stay up to date with the stunt driving laws in Ontario. My question is, considering that Canadians have the right to be "innocent until prove guilty" why do police officers have the ability to take away our cars and licenses, therefore punishing you for a crime, while you're currently innocent and before being proven guilty? This seems against our charter of rights and freedoms... And my part 2 to this question is, if you do get convicted of stunt driving, have your car impounded and license suspended, only to have the charges later dropped because you were wrongly convicted, what are your options after being wrongly convicted and punished for something you shouldn't have been punished for?

    I’m barred until 2026 for driving under suspension, the first time I was on a 4 wheeler on a gravel road, the second time I took my gfs car 3 blocks up the road to the grocery store.

    Hello my wife got caught driving on a suspended once she was pulled over for driving to slow and found out her license had been suspended due to failed to prove insurance she went to court for that the judge gave her a chance to fix her license no fines etc. she started a new job and had to drive and got pulled over for her tint being too dark and was caught on a suspended again no tickets didn’t get took to jail just got a citation she has court this coming week the same day she got pulled over she went and renewed her license and has insurance since it’s her second offence do you believe she will have to do jail time

    How cooperative are the Kawartha Lakes OPP on a domestic violence where it was put on the record that no criminal offence was committed whatsoever that resulted in a withdrawn charge and peace bond?

      @@NextLaw Police state powers there. One of the many violations of rights allowed in this country. No finding of guilt, but police can decide to treat as guilty. The power of No contact orders to extended periods with no due process is another example. They ruin many times more lives than they help or save here.

    I’ve been out of trouble now for 12 years, but a medical injury that affected what I can do for work prevented me from paying my fines off until two years ago. My first offence was in 1999, but my last offence was in March 2012 before the cut off date. Would I apply for a clemency application or wait 3 years and have a record suspension?

      @@NextLaw I did. The first time they told me was ten years and I have to apply for a Clemency RPM. Then I had everything ready to go and then called them back to confirm that I had everything then they said that I only had a 5 year wait because my first offence was in 1999. That is what made me confused about this whole thing, even the Clemency division told me it was a 10 year wait and sent me out the required paperwork to help finish my application. This is why I am so damn confused and am kinda pissed off as I did spend $2,000 getting everything for that Clemency application just to find out that I would be able to get a record suspension faster.

    I got charged with driving under suspended today and i wasnt aware i believe its for unpaid fines once i go in tomorrow and pay the fine can i get reinstated after payment shows up in service ontarios computer or once i reinstate it I still stay suspended?

      Get in touch with the Ministry of Transportation of Ontario. They're the ones who make the rules about suspended licenses and can tell you exactly what you need to do to get your license back. Give them a call and they'll guide you through the process.
