One thing I've noticed is cops across this country Just don't know the Constitution and the people's rights and their servants to the people. They need to remember that and qualified immunity should be abolished.
They need to make it a job requirement for all government workers especially cops to pass a mandatory course the Bill of Rights as part of their training

How many cops for a camera and a reporter? This is what I call over policing. Too many cops no real crimes being solved. There are sections in Poster 7 that specifically pertain to those employees conduct on postal property. For them to be unaware of being able to record, tells me that they are unaware of anything in the rules and regs.
Nobody was educated during that interaction. Never state that you're done. Tell them that you're reviewing postal employee conduct and will be there until closing. Show up after lunch and watch what they do then. They may be educated now that they've had time to research the issue, but nobody was schooled during that interaction. If they failed to research the interaction and the laws governing conduct on postal property, they'll do it to the next guy. These clowns are some of the most uneducated group I've seen as a whole.
The police or the CIA or FBI do not have the legal standing to remove a person from ANY public property without a violation of law. He could have been arrested or threatened with arrest but that is unlawful in a Federal Civil Court and they can pay in dollars for that. We see this happen all the time in these first amendment audit cases. Authorities get sued for threatening to make an unlawful arrest and remove you from a public building. No person under color of law or under color of ANY authority has the right to threaten, intimidate or coerce a US citizen out of their civil rights. This is called US Code Title 18 Section 242 "Deprivation of rights under color of law" and is punishable by death. Read the last paragraph of the statute. That's what it says. The people wrote this after the civil war in response to protecting American rights but specifically African American's civil rights.
If an "Agent" of the property tells you to leave....". A sales clerk IS NOT an agent of the property, the Postmaster is the Agent. Clerks, and Supervisors are just employees.
There might be an agreement between the PO and the local police. That "should" be public knowledge and would be something I would look into before doing an audit. For sure, I would be showing them those rules and regs to make them aware of them.

Long Island Audit was arrested by ordinary non-federal cops at a post office and in court they dismissed all the charges they levelled at him because the LEO's had NO AUTHORITY to arrest him in the Post Office as he was breaking no FEDERAL laws. These cops were unforgivably stupid and ignorant operating untrained where they had no authority.

Unless they have an inter-agency agreement in place. I can’t remember if it is between local police and the FPS, USPS or town, but an agreement in place allows local police to carry out the functions of federal LEOs under these circumstances. I think you see it more in rural locations. It’s also limited federal functions I believe, but certainly with an agreement in place, local police could do things like trespass. If you’re lawfully recording, the trespass would still be illegal of course.
Immediate training of these postal employees is needed. It is also clear that this facility is unkempt and there is no manager in place to manage the facility.
It s sounds like they were trying to bluff you and that you didn’t know your rights. You definitely need to file complaints against the staff with the USPS and police department so they maybe will learn the law and your rights…

This is the problem with local cops called onto federal property when they are clueless of the rules and regs. If there is an agreement for them to enforce laws on federal property, they ALL SHOULD KNOW Poster 7 and interpret if properly. I've seen some cops, like the idiot "frauditor" crowd that will try and twist a simple paragraph around that has two sentences.
You need to do a records request with the police to determine if there's an interlocal law enforcement agreement with the post office for local police to have jurisdiction on postal property. Without that, local police don't have jurisdiction on federal property. Do the records request prior to the audit. The correct law enforcement agency for most post offices in the country is the postal inspectors.

I do believe that there has to be some sort of agreement, due to it being federal property. Title 39 CFR 232.1 says the law enforcement on postal property is the jurisdiction of the postal inspectors unless there is a concurrent agreement that is authorized by the postal inspectors. If there is no agreement, and the property is owned by the federal government, local police do not have jurisdiction to enforce law on the property. They are allowed to serve summons and subpoenas. That is all. That's why I said that finding whether or not it's a concurrent jurisdiction is desirable beforehand. That's like a Dallas, TX police officer showing up in NYC and enforcing law. Your argument has no merit.

If the local PD is NOT contracted with the FEDERAL Post Office, the local PD violate the law of no firearms inside the Post office. They have no jurisdiction. It is the Post Master and above

I can't understand how a USPS office has no single stamps for sale. How does that happen? Also, for them to refuse to take cash in payment for goods and services is unacceptable. This place deserves to be shut down until the Postmaster General can straighten it out.

Suggestion: BEFORE undertaking a USPS audit, the auditor should investigate whether the local PD has a WRITTEN agreement with the USPS. If not, local PD has no jurisdiction on Federal property unless they are responding under emergency circumstances for the commission of a CRIME. Public photography would not be covered in such a case.

If you go back, all they gonna do is call the police again and you gonna have to go through all that again. First off, that police station probably don’t have a written agreement which state/city police HAVE to have on federal property to enforce anything. The PO needs to be calling federal law. Not city/state law. Second, the federal police more so than not, will know you have a right to film on federal property. And if they trespass you while not engaged in a crime or you aren’t being disorderly, then the trespass would be illegal and that illegal trespass would give you standing in a court of law. This is how change is made.
You need to ask for a trespass notice. This has to be filled out by an officer or the person asking you to leave or you can tell them you're going to leave under threat of arrest. Also, they can't just make you leave just because they want you to. That would be just like them saying that you have to leave because you're wearing a pink shirt, or leave because you're black!!! He could have been arrested or threatened with arrest but that is unlawful in a Federal Civil Court and they can pay in dollars for that. We see this happen all the time in these first amendment audit cases. Authorities get sued for threatening to make an unlawful arrest and remove you from a public building. No person under color of law or under color of ANY authority has the right to threaten, intimidate or coerce a US citizen out of their civil rights. This is called US Code Title 18 Section 242 "Deprivation of rights under color of law" and is punishable by death. Read the last paragraph of the statute. That's what it says. The people wrote this after the civil war in response to protecting American rights but specifically African American's civil rights.
If an "Agent" of the property tells you to leave....". A sales clerk IS NOT an agent of the property, the Postmaster is the Agent. Clerks, and Supervisors are just employees.

Long Island Audit was arrested by ordinary non-federal cops at a post office and in court they dismissed all the charges they levelled at him because the LEO's had NO AUTHORITY to arrest him in the Post Office as he was breaking no FEDERAL laws. These cops were unforgivably stupid and ignorant operating untrained where they had no authority.

Unless they have an inter-agency agreement in place. I can’t remember if it is between local police and the FPS, USPS or town, but an agreement in place allows local police to carry out the functions of federal LEOs under these circumstances. I think you see it more in rural locations.
It’s also limited federal functions I believe, but certainly with an agreement in place, local police could do things like trespass. If you’re lawfully recording, the trespass would still be illegal of course.

This is the problem with local cops called onto federal property when they are clueless of the rules and regs.
If there is an agreement for them to enforce laws on federal property, they ALL SHOULD KNOW Poster 7 and interpret if properly.
I've seen some cops, like the idiot "frauditor" crowd that will try and twist a simple paragraph around that has two sentences.
It's so interesting to me when police respond to a call and refuse to investigate the contradicting positions being presented to them.
You need to do a records request with the police to determine if there's an interlocal law enforcement agreement with the post office for local police to have jurisdiction on postal property. Without that, local police don't have jurisdiction on federal property. Do the records request prior to the audit. The correct law enforcement agency for most post offices in the country is the postal inspectors.
Bingo. Knowledge is power. Knowing if there is an agreement or not can make a big difference.

Title 39 CFR 232.1 says the law enforcement on postal property is the jurisdiction of the postal inspectors unless there is a concurrent agreement that is authorized by the postal inspectors. If there is no agreement, and the property is owned by the federal government, local police do not have jurisdiction to enforce law on the property. They are allowed to serve summons and subpoenas. That is all. That's why I said that finding whether or not it's a concurrent jurisdiction is desirable beforehand. That's like a Dallas, TX police officer showing up in NYC and enforcing law. Your argument has no merit.

The Federal Law Enforcement Training Center released a podcast entitled "Territorial Jurisdiction on Federal Property". These are the people that conduct ongoing training for federal law enforcement officers. I suggest you watch or listen and become more educated.

If the local PD is NOT contracted with the FEDERAL Post Office, the local PD violate the law of no firearms inside the Post office. They have no jurisdiction. It is the Post Master and above

Suggestion: BEFORE undertaking a USPS audit, the auditor should investigate whether the local PD has a WRITTEN agreement with the USPS. If not, local PD has no jurisdiction on Federal property unless they are responding under emergency circumstances for the commission of a CRIME. Public photography would not be covered in such a case.

If you go back, all they gonna do is call the police again and you gonna have to go through all that again. First off, that police station probably don’t have a written agreement which state/city police HAVE to have on federal property to enforce anything. The PO needs to be calling federal law. Not city/state law. Second, the federal police more so than not, will know you have a right to film on federal property. And if they trespass you while not engaged in a crime or you aren’t being disorderly, then the trespass would be illegal and that illegal trespass would give you standing in a court of law. This is how change is made.
You need to ask for a trespass notice. This has to be filled out by an officer or the person asking you to leave or you can tell them you're going to leave under threat of arrest. Also, they can't just make you leave just because they want you to. That would be just like them saying that you have to leave because you're wearing a pink shirt, or leave because you're black!!! Stand strong my friend
